HomeMy WebLinkAbout03081977 ZPC Minutes RErULAR MEETING ZONING AND PLANNING COMMISSION MARCH 8,1977 The Zoning and Planning Commission of the City of West University Place convened in regular session at the City Hall at 7:30 p.m. on Tuesday, March 8, 1977, with the following members present: Chairman Bartholomew, presiding; Members Dahlin, Norton and LaCook. Mr. Weatherby was absent. The Chairman ascertained from the secretary that proper notice of the meeting had been posted on the bulletin board at the City Hall three (3) days prior to ,~,;, the scheduled meeting. t.t~ p Preliminary plans for the construction of townhouses were presented for considera- ~ tion by Messrs. Perry Whitacre and Kevin Stuckey, representing Doyle Stuckey ~ Homes, owner, on Lot 4, Block 2 West University Place 1st Addition Northeast corner of Belmont and Bellaire Boulevard. The plan presented proposes eight units, each unit containing 1,680 square feet to 1,620 square feet all units facing on Belmont. It was pointed out that the brick wall along the entire front of the project as shown on the plans would be deleted. Discussion of the proposed plans concerned minimal space for backing out of garages toward parked vehicle in parking space provided directly behind garages and the .requirement of the Townhouse Ordinance in regards to construction of no more than four units in a row without a separation. In answer to a query, it was explained that the intent of this requirement was evidently concerned with aesthetics to attempt to break up a continuous row of townhouses. Mr. Dahlin stated that in his opinion the proposal presented is not as desirable as the one presented at the February 8, 1977 meeting, and that he would like to go on record as stating that it was his feeling that part of the design problem encountered in townhouse proposals is because. we have a very difficult mechanism for achievin the goals of the ordinance and that it is the fault of the system that we g(Zoning and Planning Commission) have noway. to bargain with the developer. Motion by Mr. Norton seconded by Mr, Dahlin, that the plan as presented for construction of townhouses on Lot 4, Block 2 West University Place 1st Addition Northeast corner of Belmont and Bellaire Boulevard be rejected because it does not meet the requirements of the ordinance prohibiting. more than four units in a continuous row without a separation. Voting Aye: All Voting No: None _~ ~: Messrs. Whitacre and .Stuckey were advised they could re-submit this plan or a new proposal with the required separation for consideration at the next meet- ing of the City Commission or at the end of this meeting after the conclusion of business concerning other agenda items. Preliminary plans for the construction of townhouses were presented for consid- eration by Messrs. Scott Ziegler and Michael Cooper on Lots 14 and 16, Block 5 Virginia Court Addition Northwest corner of Rice Boulevard and Kirby Drive These plans were presented to the Zoning and Planning Commission at their regular meeting on February 8, 1977 and approved subject to approval of the City Com- mission for off-street parking on Rice Boulevard. The Chairman advised that he attended the City Commission meeting on February 14, 1977 along with Messrs. Ziegler and Cooper and that the off-street parking for two parking spaces 50 ft. from corner was approved and that plans were returned to the Zoning. and Planning Commission for their determination of the fence pro- blem and a recommendation to be furnished to the City Commission. Discussion included requirements of the Fence Ordinance, Townhouse Ordinance fence requirements, fronting of lots, definition of a fence, retaining walls and authority of the Zoning and Planning Commission. Motion by Mr. Dahlin, seconded by Mr. LaCook, that the overall plan for the construction of townhouses as presented by Messrs. Ziegler anal Scott on tots l4 and 16, Block 5 Virginia Court Addition Northwest corner of Rice Boulevard and. Kirby Drive be approved as presented. Voting Aye: All Voting No: None. Mr. Blake Mooney, owner, presented .final plans for the construction of town- houses on Lot 3, Block 43 West University Place 1st Addition Northeast corner of Sewanee and Bellaire .Boulevard. It was noted that Preliminary plot plans were approved for this construction on January 11, 1977. After a review and study of the plans the following action was taken: Motion by Mr. LaCook, seconded by Mr. Dahlin, that the final plans presented by Mr. Blake Mooney for construction of townhouses on ~~ Lot 3, Block 43 West University Place 1st Addition Northeast corner of Sewanee and Bellaire Boulevard be approved as submitted subject to compliance with all building codes, or other governing ordinances, whether or not herein specified, for any subsequent construction, There was a brief discussion concerning number of units al]owed in a continuous row. ~., Voting Aye: Dahlin Voting No: Norton ~ LaCook C~ Bartholomew ,~ ~ An application from Mrs. Pauline Waters, owner, for subdivision of Lot 14, Block 16 West University Place 1st Addition , Northeast corner of Vanderbilt and Duke into three lots, one lot 100 ft, x 100 ft, facing Vanderbilt and two lots,. each 50 ft. x l00 ft., each facing Duke, was presented for consideration. After reviewing the .application and sketch submitted showing dimensions of the lot, existing improvements, and proposed subdivision, Mrs. Waters was advised that if the dimensions are correct on this sketch, it does not. allow for a 20 ft, rear yard required by the Zoning Ordinance as the sketch shows only fifteen feet between the rear of the house and the proposed subdivision, Mrs. Waters was advised she had the alternative of submitting the application. subject to this restriction, in which case the subdivision, if granted, would not be valid nor a building permit issued until five (5') feet of the existing structure was removed; or she could amend her application for subdivision and request sub- division into two lots. Mrs. Waters elected to submit an amended application for subdivision of Lot 14, Block 16 West University Place 7st Addition Northeast corner of Vanderbilt and Duke into two lots one lot 100 ft x 115 ft. facing Vanderbilt, and one lot, 85 ft. x 100 ft. facing Duke. Motion by Mr. Dahlin seconded by MrR LaCook, that application to subdivide Lot 14, Block 16 West University Place 1st Addition into two lots, one lot 100 ft x 115 ft, facing Vanderbilt and one lot 85 ft. x 100 ft~ facing Duke, be accepted and Public Hearing called for April 5, 1.977, 7:30 p.m. ~- Voting Aye: All Voting No: None Mrs. Waters was advised that she must submit a surveyor's plot plan showing existing improvements at the time of the Public Hearing. An application from Mr. Stewart Smith, owner, for subdivision of Lot 5, Block 50 West University Place 2nd Addition 3310 Amherst into two lots, each 50 ft. x 150 ft., each fronting on Amherst was presented for consideration. After reviewing the application and explaining the procedure to be followed for subdivision of lots to Mr. Smith, the following action was taken: Motion by Mr. Dahlin, seconded by Mr. Lacook, that application for subdivision of Lot 5, Block 50 West University Place 2nd Addition into two lots, each 50 ft. x 150 ft., each facing Amherst, be accepted and that Public Hearing be called for April 5, 1977, 8:00 p,m. Minutes of the regular meeting of the Zoning and Planning Commission were approved as corrected, Messrs. Stuckey and Whitacre submitted a revised plan for the construction of townhouses on Lot 4, Block 2 West University Place 1st Addition Northeast corner of Belmont and Bellaire Boulevard reducing size of units 6" and making a five (5') foot separation between the eight units, four on each side and reducing the lower story of each unit by 6" to allow for more manueverability for backing out of garages. Motion by Mr. Norton, seconded by Mr. Lacook, that preliminary plans submitted by Messrs. Whitacre and Stuckey for the construction: of townhouses on Lot 4, Block 2 West University Place 1st Addition be approved as submitted. Voting Aye: Lacook Voting No: Dahlin Norton Bartholomew The following actions were taken in regards to a report requested by the city Commission concerning acceptance. of preliminary plans for the development of townhouses on P d" Ltd "~ Q Lots 14 and 16, Block 5 Virginia Court Addition Northwest corner of .Rice Kirby Drive. Boulevard and and the. Chairman instructed to incorporate these actions into a letter to the City Commission: Motion by Mr. Dahlin, seconded by Mr. LaCook, that the Zoning and Planning Commission report. to the City Commission that its concept of the. corner lots on the northwest corner of Rice Boulevard and Kirby is that these townhouses are facing on Rice Boulevard and that the Townhouse Ordinance applies and controls the location of the fences. Voting Aye: All Voting. No: None Motion by Mr. Dahlin., seconded by Mr. Norton, that under the interpretation of the Townhouse Ordinance the front fence and the two side property fences are specifically permitted and the other fences are not prohibited and it is our opinion that the fences as shown on the unit development of proposed townhouses on the northwest corner of Rice Boulevard and Kirby is consistent with-the existing townhouses on Bellaire Boulevard and- Bissonnet. Voting .Aye: All Voting No: None Motion by Mr. Dahlin, seconded by Mr. LaCook, that for purposes of the develop- ment at the northwest corner of Rice Boulevard and Kirby, the Zoning and Planning Commission recommends. that the height of the fence be determined by that portion which is free standing. Voting Aye: All Voting No: None After a further discussion of the section of the townhouse ordinance concerning separation of .units, it was .the unanimous opinion that the fibe (5') foot separa- tion would not be required in preliminary plans presented by Messrs. Whitacre and Stucky and the secretary was instructed to so advise them by phone on Wednesday morning to be followed by a confirming letter from the Chairman of the Zoning and Planning Commission. With no .further business to come before the Zoning and Planning Commission, upon motion. duly made, seconded and passed, the meeting adjourned at 12:.00 Midnight.
