REGULAR MEETING
ZONING AND PLANNING COMMISSION
May 11, 1976
The Zoning and Planning Commission of the City of West University Place convened in regular
session at the City Hall, 7:30 p.m., Tuesday, May 11, 1976, with the following members present:
Chairman Barthlomew, presiding; Members Dahlin, LaCook, Norton and Weatherby.
The Chairman ascertained from the secretary that proper notice of meeting had been posted on
the bulletin board at the City Hall three (3) days prior to the scheduled meeting.
Motion by Mr. Weatherby, seconded by Mr. Dahlin, to open Public Hearing scheduled for this
time to consider application from Mr. Thomas R. Jackson and Mr. James Richards, Jr., to
subdivide
Lot 6, -Block 1
West University Place 1st Addition
2803 Cason.
into two lots, each 70 ft. x 200 ft., each fronting on Cason Street.
Voting Aye: All Voting No: None
The Chairman. advised that Mr. Richards had called him a few days before the meeting and
stated he would_be arriving from out of town on a 7:00 p.m. plane and asked that the Hearing be
postponed until; 8:00 p.m. so that he could be in attendance.
Motion by Mr. Weatherby, seconded by Mr. Dahlin, that Public Hearing be recessed until 8:00
p.m.
Voting Aye: All Voting No: None
Mrs. Bert McDaniel came to the meeting at this time and on ascertaining she was there for the
Public Hearing was advised of the above action.
Mrs. McDaniel stated she had another appointment and could not stay but would like to have the
Commission aware that she was not against the subdivision but against any access into the east
one-half of the proposed subdivision from Werlein Street. which dead-ends at the property.
The Chairman advised Mrs. McDaniel that the Commission had received a letter from her
husband stating the above. objection and that their views would be taken into consideration and
that the letter would be made a part. of the Public Hearing official minutes. He also advised
that. the application. as presented to them had no reference to a Werlein Street access road and
therefore that aspect was not under consideration from this body.
Mrs. McDaniel left the meeting at this time.
Minutes of the regular meeting of the Zoning and Planning Commission on April 13, 1976, were
approved as corrected and .minutes of the Workshop meeting on April 20, 1976, were approved as
submitted.
The. Public Hearing was. called to order at 8:00 p.m. from recessed session.

Notice of Public Hearing was published in The Houston Chroncile, April. 23, 1976 and Notice to
All Property Owners within a 200 ft. radius of the property was mailed April 23, 1976.
The Oath was administered to Mr. Richards.
Mr. Richards stated that he and Mr. Jackson were co-owners of Lot 6, Block 1, West University
Place lst Addition, and they desired to divide the property into two lots, each 70 ft. x 200 ft.
and each fronting on Cason Street with Mr. Jackson having ownership of the east one-half and
Mr. Richards having ownership of the west one-half. He said he planned to sell the west one-
half, and it was the intent of the purchaser to .live in the exiting house for about two years and
then either completely remodel the house or demolish it and construct a new one. Mr.
Jackson's plans are to construct a house attaching it to an existing garage which was recently
constructed. He also stated that Mr. Jackson was out of the country and could not attend the
meeting.
`~ On questioning as to any plans for permission for access to .the proposed east one-half of the
~ property,. Mr. Richards said he could not speak for Mr. Jackson's intent, but at this time he knew
~ of no such plans.
It was brought to Mr. Richard's attention that the survey presented to the Commission showed
2.5' as the,side setback from the existing garage and that the requirement is 3'. That should the
subdivision be approved this line must be 3' from the garage in accordance with the Zoning
Ordinance. It was also brought to his attention that according to the survey presented, the
front setback to theexisting garage is 29.5', whereas, the front setback requirement is 30 ft. in
accordance wi h the Zoning Ordinance -and that this should be checked" with the surveyor and
city officials as to the correct measurements and, if incorrect, ascertain the proper steps to be
taken for conformity.

In regard to the application of Thomas R. Jackson and James Richards, Jr., to rezone the
aforedescribed property, please be advised as follows, to to-wit:
1. ,The undersigned has no objection to the request for rezoning if Three. Zoning District is
single family .residential. Objection would be to a proposed rezoning which would allow the
construction of townhouse, condominium, or more than one single family residence on each
of the two lots, i.e. 70' x 200'.
2. That all entry to said two proposed lots would be from Cason Street and that all entry'-
would seek to perpetuate.

Mrs. Denny and I will not be able to attend the hearing on May 11th, but we have no objection to
the subdivision of Lot 6, Block 1, into 2 lots 70' x 200', each facing Cason Street - as long as it
does not disturb our present dead end Werlein Street. We want Werlein to remain as it is.

Motion by, Mr. LaCook, seconded by Mr. Dahlin, that application to subdivide
Lot 6, Block 1
West University Place 1st Addition
2803 Cason
into -two Lots, each 70 ft. x 200 ft., each fronting on Cason Street, be approved subject to
compliance with all building setback requirements, building code, or other governing ordinances,
whether or not herein specified, for any subsequent construction.
Discussion included general requirements for subdivision, future requests of other citizens, size
of these .lots after proposed subdivision.

Mr. Wm. Perlmutter appeared before the Commission and presented a building site plan for the
construction of five (5) townhouses on the northwest corner of Buffalo Speedway and Bellaire
Boulevard, being described as
So. 124 ft. of Lot 1, Block 41
West University Place 1st Addition..
During discussion of the plans Mr. Perlmutter was advised that in accordance with a previous
interpretation of the Ordinance pertaining to the townhouse lots on Bellaire Boulevard by the
Commission concerning construction of townhouses fronting a side street instead of Bellaire
Boulevard, it was the opinion of the Commission that the front of the properties faced Bellaire
Boulevard. In light of that interpretation, the plans presented did not meet the requirements of
the ordinance in that a 20 ft. setback is required as a rear setback, whereas his site plan only
allowed fora 5 ft. setback on the north.
Mr. Perlmutter was advised they could not approve the plan at this time, as it appeared not to
conform with the Ordinance, but it would be studied and a decision given at the next regular
meeting of the Commission on June 8, 1976.
In further discussion of recommendations to the City Commission concerning amendments to
the Zoning Ordinance and other land .uses, it was the decision of the Commission to submit
recommendations as now approved, with the exception of CIRCULAR DRIVEWAYS which will

be further considered and submitted at a later date.
With no further business to come before the Commission at this time, upon motion duly made,
seconded and carried, the meeting adjourned.
