HomeMy WebLinkAbout03091976 ZPC Minutes REGULAR MEETING ZONING AND PLANNING COMMISSION MARCH 9, 1976 The Zoning and Planning Commission of the City of West University Place convened in regular session at the City Hall, 7:30 p.m., Tuesday, March 9, 1976, with the following members present:. Chairman Bartholomew, presiding; Members Dahlin, Norton and Weatherby. Mr. LaCook was out of town. The Chairman ascertained from the secretary that proper notice of :meeting had been posted on the bulletin board at the City Hall three (3) days prior to the scheduled meeting. Mr. Bob Hendrickson appeared before the Commission to discuss possible-rezoning of Lots 2, 3 and 4, Block 4 Collegeview 3rd Addition for townhouses. The Chairman briefly explained that during a land use study of the entire city approximately two years ago, the Zoning and Planning Commission recommended that this property, along with lots to the east and west, be used for park purposes, but. this recommendation. was re- jected by the City Commission and the lots remained zoned for single family residential use. Subsequently, the owner made application to the Commission .for rezoning for townhouses, which application was rejected because in the opinion of the Commission, the proposed re- zoning for townhouses would be inconsistent because of the orientation of the lots, facing both peripheral and interior streets, and the relationship to lots imediately east of Lot 4 and the relationship of the entire Block 4, Collegeview 3rd Addition, to the properties east of College Street. Mr. Hendrickson stated that he resides in West University Place at .2727 Pittsburg and owns the residence at 2632 Pittsburg in which he and his family will move. in a few months. He advised that he could understand two-story townhouses constructed immediately .adjacent to one-story residence might not be desirable, that the property had increased in value so that it is prohibitive to construct single-family residences thereon, and he would like to propose rezoning for one-story townhouses. He was advised that in studying this area and .the surrounding area, the Commission had con- cluded .they would not recommend these lots for rezoning for townhouses because of the angle and location into the interior, there would be no place to stop the change without inviting further encroachment into the interior; that they were appreciative of his imagination for developing one-story townhouses, but they could not rezone or change status of land use under an agreement with a particular property owner because the city could not enforce such zoning in the event such owner for some reason did not develop the property; and unless there should be some dramatic change in land use in the surrounding area to change the philosophy of the Commission, they would not consider an application to rezone these lots. Mr. Hendrickson stated that he understood their reasoning and being a resident of the city also could appreciate their efforts in behalf of the citizens in protecting the zoning. He left the meeting at this time. Application from Mr. M. A. Tallen to rezone Lots 6, 7, 8, 9 and 10, Block B Pemberton Addition 2600 Block University Boulevard for townhouses was. presented to the Commission for consideration. Motion by Mr. Weatherby, seconded by Mr. Dahlia, that application to rezone Lots 6, 7, 8, 9 and 10, Block B Pemberton Addition 2600 Block University Boulevard for townhouses, be rejected for the following: reason: that since the Commission's last study there has been no basic change in conditions of the area and that a change in the zoning would not benefit West University Place. Discussion included where to stop rezoning if this request is considered, i.e., other persons d" could request rezoning of properties to the west in this block and even into the adjacent block and there would seem to be no reasonable stopping place; density of traffic would be increased;. and the Commission considered Kirby Drive and University Boulevard to constitute an entrance ~ into the city and that family residences could be built which would be to the overall ~ betterment of the city; the Commission felt that some flexibility in construction and setback A requirements could possibly be exercised by city officials concerning Lot. 10 which is directly adjacent to Kirby Drive. Special Workshop Meeting, March 1, 1976 Minutes of the Regular Meeting, February 10, 1976 .and Special Meeting, March 1, 1976 were approved as submitted. Minutes of Special Workshop Meeting, February 24, 1976, were approved as corrected. The Commission continued its discussion and study of certain items as related tp the existing Zoning Ordinance.
