HomeMy WebLinkAbout10081974 ZPC Minutes REGULAR MEETING ZONING A PLANNING COMMISSION OCTOBER 8, 197- The Zoning and Planning Commission of the City of West University Place convened in regular session on Monday, October 8, 1974, 7;30 p.m., with the following members present; Chairman Hines, presiding; Meebers Bartholomew, Dahlin, and Lipscomb. Mr. Weatherby was our of town. Mrs. Katy Adams, Mr. Robert Speers, and Mrs. Miriam Banks Israel were in attendance. d" The Chairman ascertained that proper notice of meeting had been posted on the ~ bulleitn board at the City Hall three days prior to the scheduled. meeting as ~ required by HB3, Amending 6252-17 V.G.S. ~ Motion by Mr. Dahlin, seconded by Mrs. Bartholomew, that Public Hearing called Q for this time to consider the application of Ralph M. Scott to subdivide Lot 5, Block 29 West University Place 1st Addition 6414-16 Rutgers be opened. Voting Aye; All Voting No:.None Affidavit. of Publication of Notice of Pub lic Hearing in The Southwestern Argus on September 18, 1974, and Notice to Property owners mailed September 17, 1974 is made a part of this record. Mr. Robert Speers had previously presented Power of Attorney to act for Mr. Ralph M. Scott in the matter of the partition of the ab ove described property. Mr. Speers;.estated_that if subdivided the property will be sold to two owners; that at the present time illegal living quarters are located on the rear of the south one-half. of the property being joint of the garage on the north one-half; that there is no separate utility service to these living quarters, being serviced from the same meters as the main dwelling on the north one - half; that these sevices would be disconnected from the living quarters and the building removed from the garage and enough of it torn down to meet the requirements on the south one-half of the property from the line created by the subdivision, if granted. Upon questioning, it was ascertained that attached to the north side of the garage is a two story structure with living quarters above containing a kit- chen and bath.. and an area used for a workshop below which contains a bath. The garage as shown would extend 1` 11" into the setback line created by this subdivision, if granted. The following letter was read concerning this subdivision and made a part of these minutes: f / !j: October 7, 197+ Zoning and Planning Commission City of West University Gentlemen; I am in favor of letting Mr. Ralph M. Tubb s 6+20 Rutgers St. Motion by Mr. Bartholomew seconded by Mr. Lipscomb, that the Public Hearing be closed. Motion by Mr. Dahlin, seconded by Mr. Bartholomew, that the application of Mr. Ralph M. Scott, to subdivide Lot 5 Block 29 West University Place 1st Addition 6+14-16 Rutgers into two lots, each 50 ft. x 150 ft, each facing Rutgers, be approved. The Chairman pointed out that it is inherent in subdivisions that it be approved subject to meeting all setback requirements, building code, or other governing ordinances, whether or not specified. Mr. Dahlin amended the motion and Mr. Bartholomew accepted the amend- ment to read as follows: Motion by Mr. Dahlin, seconded by Mr. Bartholomew,. that the application of Mr. Ralph M. Scott, to subdivide Lot 5 Block 2g West University Place lst Addition 6+14-1~ Rutgers into two lots, each 50 ft. x 150 ft., each facing Rutgers, be approved sub- ject to meeting all setback. requirements, building code, or other governing ordinances, whether. or not here n specified. Voting Aye; All Voting No: None Mr. Speers discussed with the Zoning and Planning Commission various means, of meeting the setback requirements on the above property. The Final Report of the Zoning and Planning Commission on the approval of the application of Mx'. Charles Atkins, owner, to rezone Lot 1 East 75 ft. x 125 ft. of Lot 2 West 75 ft. x 125 ft, of Lot 2 South 125 ft, of .Lot 2 ,~ Block 93 ~ West University Place 2nd Addition d 3617 Bissonnet L~ for townhouses and~or clusterhouses was drafted to be presented to the Ga City Commission at their regular meeting on October 1~+, 197+. This Final Report is to be made a part of the permanent file on this application. The following letter was drafted to Mr. Mike C. Harris, owner, concerning his application to rezone Lots 2, 3 and ~+ Block 4 Collegeview 3rd Addition for townhouses and~or clusterhouses; Mr. Mike Harris 305 1st National Bank Building Conroe, Texas 77301 Dear Mr. Harris; At a special recessed meeting on September 30, 197+, the Zoning and Planning Commission took action to reject your application to rezone Lots 2, 3 and ?+ Block ~+ Collegeview 3rd Addition City of West University Place, Texas. It was the decision of the members of the Zoning and Planning Commisssion that to consider these lots for rezoning would not be consistent with its recommended plan as contained in t heir report to the City Commission dated March 11, 197+• In the opinion of the Commission, the proposed rezoning would be incon- sistent because of the orientation of the lots, facing both per- ipheral and interior streets, the relationship of these lots to property immediately east of Lot ?+~ and the relationship of Block. 4, Collegeview 3rd Addition to the properties east of College Street. A refund of your 25.00 fee for publications and notices will be mailed to you as soon as it can be processed. Yours very truly, ~s~ Gene Hines Chairman Zoning and Planning Commission Minutes of Special Meeting of Zoning and Planning Commission on September lE, 197+, were approved as submitted. Minutes of Special Recessed Meeting of Zoning and Planning Commission on September 30, 197+, were submitted for consideration. Several changes in wording were made and the secretary asked to resubmit them for approval at the next regular meeting of the Commission. Mrs. Miriam Banks Israel asked questions of the Commission concerning their recommendation to rezone Lots 5,~,7,8y and 10, Block 25, Collegeview 1st Addition,.. for townhouses. Mrs. Israel is the owner of Lot 10, Block 25, Collegeview.lst Addition. She questioned the status of the Telephone Company insofar as being allowed to have a parking lot on Lots 5 and E which they own, and stated her opinions on allowing parking and~or town- houses on any of these lots. She also stated that she did not think that the zoning should have been changed, but if Southwestern Bell is allowed parking on their lots that all the lots should be zoned for parking. The Chairman explained that no application had been received from the Telephone Company to rezone said. lots and that it was his understanding they would. all be rezoned for townhouses in the ordinance now being prey pared for approval of the City Commission.
