RECESSED SPECIAL MEETING
ZONING AND PLANNING COMMISSION
SEPTEMBER 30, 1974
The Zoning and Planning Commission of the City of West University convened
in special recessed session on Monday, Septeeber 30, 1974, 7:30 p. m., with
the following members present; Chairman Hines, presiding; Members Bartholomew,
Dahlin, Lipscomb and Weatherby.
Proper notice of meeting had been posted on the bulletin board at the City
Hall three days prior to the scheduled meeting as required by HB3, Amending
6252-17 v.c.s.
Mr. Bartholomew reported that he checked with'-.the City Attorney;concerning
procedural points in the meeting of July 9, 1974, concerning a motion calling
a Pub lic Hearing which failed and the meeting of September 10, 1974, whereby
a motion died for lack of a second. He stated it was the opinion of the City
Attorney, in both instances, that the motions constituted no action against
the application or disapproval thereof and the Commission could properly
proceed to try take further action on same.
In general discussion, it was decided to continue procedurally as in the
past; that the aim of parliamentary procedure is to expedite and not obstruct
the necessary business of the Commission and not in anyway to mislead the
public; and that in the future if there is a question in the mind of any mem-
ber that the procedure followed is not correct, it should be resolved at the
same meeting, if at all possible.
Consideration of the application from Mr. Charles H. Atkins, owner, to rezone
Lot 1

West 75 ft. x 125 ft. of Lot 2

for townhouses and~or clusterhouses covered the following points; what
changes, if any, have occured since this property was discussed prior to
the Zoning and Planning Commission's report to the City Commisssion recommending
peripheral changes; effect of City Commission's rejection of recommendation
for park areas west of Poor Farm Ditch; relevancy of properties west of Poor
Farm Ditch to this property; and objections of citizens to traffic and
parking prob le ms.
Motion by Mr. Weatherby, seconded by Mr. Lipscomb, that the application of
Mr. Charles Atkins, owner to rezone

of a minimum of three (3) parking spaces for each unit with one being desig-
nated for guest parking.

A draft of a Final Report to the City Commission concerning this application
will be prepared by the Chairman and presented to the Commission for approval
at the next regular meeting of the Zoning and Planning Commission on
October 8, 197+.

sots 2, 3, and 4

for townhouses and~or clusterhouses covered the following; question of re-
zoning on interior lots, as a protion of Lot. 4 faces an interior street; various
factors involved in including Lots 1, 5, E, and 7, Block ~+, Colegeview 3rd
Addition, in the call for a Pub lic Hearing or only Lot 1; consideration of
a similar situation at Bissonnet and Sunset; vulnerability of position for
rezonng;•nterior street.
Motion by Mr. Dahln, seconded by Mx'. Weatherby, that application of Mr.
Mike C. Harris, owner, to rezone
Lots 2, 3, and ~+

Collegeview 3rd Addition
for townhouses and~or clusterhouses , be rejected, and no Pub lie Hearing
be called.

It was the decision of the members of the Zoning and Planning Commission
that to consider these lots for rezoning would not be consistent with its re-
commended plan as contained in their report to the City Commission dated
March 11, 197+. In the opinion of the Commission, the proposed rezoning
would be inconsistent because of the orientation of the lots, facing both
peripheral and interior streets, the relationship of these lots to property
immediately east of Lot 4, and the relationship of Block ~+, Collegeview 3rd
Addition to the properties east of College Street.
Mr. Hines briefly advised that it was his unders'anding from the City
Attorney that Lots 5, 6, 7, 8, 9 and 10, Block 25, Collegeview 2nd Addition,
would all be included as a townhouse district in the ordinance being prepared
for rezoning certain properties. This is in line with recommendation of the
Zoning and Planning Commission in their report to the City Commission.
With no further business to come before the Commission at this time, upon
motion made, seconded and carried the meeting adjourned at 9:45 p.m.
