The Zoning and ~'lanning Comonission of the City of West University Place convened
in regular session, Tuesday, July 9, 1974, with the following members present:
Chairman Hines, presiding; Members Barthol~new, Dahlin, Lipscomb and Weatherby.
The Chairman ascertained from the secretary that proper notice of meeting had
been posted on the bulletin board at the City Hall three days prior to the
schedule meeting as rec{uired by HB3, Amending 6252P17 V.C.S.

for townhouses amd/or clusterhouses, was presented to the Corrnnission for their
consideration.
Mr. Atkins stated that he had previously made application to the Commission for
rezoning this property for an office building and such application was denied..
He was of the opinion this property should have been included in the public hear-
ings held by the Zoning and Planning Commission in considering recommendations
to rezone certain peripheral properties. Mr. Atkins stated that he believed
the character of his property had changed more than any other in West Univer~
sity Place due to the Edloe overpass, and that it faces all commercial property,
including a cafeteria, bar, moving company, a church on the east and Poor Farm
Ditch on the west.
The Chairman advised that in their study of peripheral property this property was
considered, but it had been the decision of the Commission not to include this
property in their recomanendations until it could be seen what. impact .the open-
ing of the Edloe overpass would have on the development of the area.
Motion by Mr. Lipscomb, seconded by Mr. Bartholomew, that the application to
rezone

Further discussion was held on this property, specifically as to whether or not
considering it alone would constitute "spot'F zoning.
Motion by Mr. Dahlias, seconded by Mr. Lipscomb, that the Zoning and Planning
Commission seek the advice of the City Attorney concerning the following:
1. Tf rezoning the property coverdd by the application
would constitute "spot" zoning
2. Tf properties from Buffalo Speedway to Poor Farm Ditch
are included in the consideration for rezoning, what
effect, if any, would there be in excluding curch
properties;
request that this opinion be given to the chairman, in writing, before the
next regular meeting of the Zoning and Planning Commmission on`August 13, 1974,
arld that the application be tabled pending receipt of this information from
the City Attorney.

Application from Mrs. Paulus Hofheinz, owner, to rezone.

for townhouse and/or clusterhouses, was presented to the Commission for their
consideration.
Mrs. Hofheinz stated she thought her property should have been included in the
d" recommendation to rezone certain peripheral properties made by the Zoning and
~ Planning Commission to the City Commission; that she is surrounded now across
Q Kirby (which is in Houston) by commercial businesses and if it was rezoned be-
~ hind her r ert she would have commmercial ro ert there also.

Tt was explained to Mrs. Hofheinz that their recommendation for rezoning on
Kirby Drive was not commercial, but residential.
Mrs. Hofheinz was advised that this property had been considered in their study
of land use of peripheral property, but that it had been concluded that this was
an entrance into .the City of West and that attractive homes could be maintained
or built on vacant property at University Boulevard. and Kirby Drive and that in
their opinion it was desirable to leave these lots facing on University at Kirby
single family residential status rather than"a townhwuse and/or clusterhouse
package. Tt was also pointed out that although the original lots were dedica-
ted towards. Kirby Drive, the subsequent building of a house facing University
Boulevard, and the use if the two lots as one did in their opinion constitute
a single building site facing University Boulevard.
Motion by Mr. Weatherby, seconded by Mr. Lipscomb,. that the application to re~

be denied, because it is located at what is considered an entrance way on
University Boulevard, into the City of West University Place, and that is is
to the overall betterment of the city to leave this property for single family
residential use.
Voting Aye: All Voting No: None
Mrs. Hofheinz left the meeting at this time.
After a study of the budget material presented to the Commission, the follow-
ing figures were submitted to be forwarded to the City Manager as requested in
his letter dated June 4, 1974, for the 1975 Budget for the Zoning and Planning
Commission:

The following letter was presented to the Zoning and Planning Commission for
their information:

Dear Mr. Hines:
Tn regular session on Nbnday, June 10, 1974, the City Commission in-
structed that members of the Zoning and planning Commission be advised
that tFie .following action was taken:
Tn response to a ree{uest presented by residents of the area, the
Cartnnission took official action to temporarily close Algaiis Road
at its intersection with Bissonnet by the construction of•a barriF
cade. Except for the moving of .one fire plug in the area, the
cost of the project will be borne by area residents. Design and
materials to be used will be decided in the near future.
A rec{uest received from Mr. Thomas M. Weaver, president, Weaver
Dasek, on behalf of St. George Orthodox Church, for permission
to encroach on the Sewanee Street rightaof-way with one drive
approach and for ten cars of head-in parking was approved by the
City Commission.
Plans for the proposed church parking are on file in my office should mem~
hers of the Zoning and planning Commission desire to review them.

The Chairman was authorized to ascertain from the City Attorney the status of
a new definition of "family: as contained in Ordinance No. 111. (The Zoning
and Planning Commission had previously consulted with the City Attorney and ad-
vised it was their opinion that if the definition is to be changed it should
follow the language as used in the recent Supreme Court decision titled, Village
of Belle Terre, et al, Appellants, vs. Bruce Borass, et al, decided April 1,
1974.)
Minutes of the regular meeting off' the Zoning and planning Comanission on
June 12, 1974 were approved as sui~mitted.
Upon motion duly made, seconded and carried the meeting adjourned at 10:10
p.m.
