REGULAR MEETING
ZONING AND PLANNING CODM~IISSION
OCTOBER 10, 1978
The Zoning and Planning Commission of the City of West .University Place convened
in regular session on Tuesday, October 10, 1978, 7:30 p.m., with the following mem-
bers present: Chairman Norton, presiding; Members Berg, Casey and LaCook.
The Chairman ascertained from the secretary that proper. notice of meeting had
been posted at the City Hall.. three days prior to the scheduled meeting.
An application from M. A, and Della V. Tallen to rezone and replat
Lots 6, 7 ~ 8, Block B(2)
Pemberton Place Addition
into four (4) lots, each 37.50 ft. x 101 ft., with
frontage on University Boulevard
and
Lots 9 F~ 10, Block B(2)
Pemberton Place Addition
into three (3) lots, each 33.33 ft. x 101 ft. with
frontage on University Boulevard
was presented. to the Commission for their consideration with Whitt Johnson repre-
senting the owners. Mr. Johnson presented a signed statement from Mr, and Mrs.
Taller authorizing him to represent them and also authorizing James Heaton and Peter
T. Serebrenik to represent them and speak in connection with the application.
Mr. Johnson presented a sketch showing the proposed development if they are allowed
to replat the lots. He stated that Mr. and Mrs. Ta11en had owned three of the lots
15 years and .two on the west for 6 years.
Mr. Heaton and Mr. Serebrenik said they would like to build seven single family
residential houses on the five lots on lots smaller than 50 ft. and that the lot
size. would be the only variance from the zoning ordinance; that the houses would
contain 1800 sq. ft. on the smaller lots and 2300 sq. ft. on the larger lots; that
they have surveyed and staked the area in an effort to save most of the trees on
the lots; they propose a brick wall across the front and fenced individual back
yards with an 8 ft. fence on the east side to buffer against the commercial develop-
ment. They stated they have tried to maintain architectural integrity on Univer-
sity Blvd. and the area and they felt they would be doing something better than
what is going up now, i.e., townhouses and suggested that this°.;might be an option
to following in the future instead of townhouses.
Mr. Norton stated that-the developer should be commended for their concern in saving
the trees, but that he has a great deal of concern in reducing lot sizes and especially
on University Boulevard.
Following a question from Mr. LaCook, Mr. Johnson stated that the residences behind
these lots were developed on 65 ft. or larger lots.
Mr. Casey said he also had reservaion on developing seven residences instead of
five; did not know if it was worth this type of sacrifice but he felt that every-

one should be entitled to a Public Hearing and that should be basis of the deci-
sion.
Mr. LaCook said he felt this is the last entrance into the city and needs to be
developed nicely; .that he would like an opportunity to canvass the area; that
he also .did not like the idea of reducing lot size_but if it could be developed to
improve the area this might be considered.
Mr. Berg stated that this was a unique situation in that other entrances had
natural buffers but this would move further inward into. the city; that he did .not
dislike the plan but they would have. to .consider how the. development-would relate
to the rest of the city area and to other entrances .and be consistent with what.
is immediately against the street and the natural flow of the subdivis-on as it
proceeds 'into the ci-y west.. He also stated that he felt everyone should have a
chance to state his views at a Public .Hearing. He continuedf;that another conside-
ration had to be the lots across the street and if this was granted would more.
and more application to do the same be submitted and result in the tearing down of
the old houses to make room for more houses.
Motion by Mr. Berg that Public Hearing be called to consider the application of

and
Lots 9 ~ 10, Block B(2)

into three (3) lots, each 33.33 ft. x 101 ft, with"

at the next. regular meeting of the Zoning and Planning Commission on November 14,
1978.
Mr. LaCook noted that no survey plan had been submitted and Mr. Berg
amended his motion to require that a survey plot plan be .presented to the Zoning
and Planning Commission within five (5) days.
Mr. LaCook seconded the motion and amendment.

Mr. .Mike .Goodwin, representing University Court Townhouses *Unlimited Partnership),
presented preliminary plans for the construction of townhouses on
Lots 2 and Part of Lot 1, Block 93
West University Place 2nd Addition.

After discussion and review of the plans with Mr. Goodwin he was advised that the
plans could not be approved as they .did not meet all the requirements of Ordinance
No. 1033, i.e, front setback must be 10 ft. from property line not street line,.
rear setback {on south side) must be 2O ft. and four of the units covered more
than 600 of the lot.
Minutes of the regular meeting of the Zoning and Planning Commission on September
12, 197.8 were approved as submitted.

With no further business to come before the Commission, upon motion duly
made, seconded and carried, the meeting adjourned at 9:00 p.m.
