REGULAR MEETING
ZONTNG AND PLANNING COMMISSION
FEBRUARY 14, 1978
The Zoning and Planning. Commission of the City of West University Place convened. in
regular session on Tuesday, February 14, 1978, 7:30 p.m., with the following members
present: Chairman Norton, presiding; Members Casey, Johnson, LaCook and Nuffer.
The Chairman ascertained from .the secretary that proper notice of meeting had been
posted at the City Hall three days prior to the scheduled meeting.
T`he following letter from Mayor Philip .Dunn was presented to the Commission for their

Dear Jim:
We have your letter of January 13th, which I recently discussed with you by telephone.
In reviewing the minutes of our meeting of December 12th, it appears that we are in-
rerested in a more comprehensive study then consideration of Mr. Ruckstuhl's request
for- development of a single lot along the Virginia Street right-of-way..
Since we .lost our Community Development block grant the status of Independence Park
Phase I is somewhat. in limbo. Our intent in referring this matter back to the Xoning
and Planning Commission. was, therefore, to consider whether or not the best overall
benefit to the city can be attained through continued search for funding for Inde-
pendence Park or by opening the entire Virginia Street. right-of-way to development.
We would ike for the Zoning. and Planning Commmission to reconsider this matter on a
broader base. We have applied for a Bureau of Outdoor Recreat-ion grant for Phase I
of Independence Park, but if received, it will only provide 50% of the required funds.
At the time we authorized the application fora Bureau of Outdoor Recreation grant we
imposed a sixty (60) day time period for consideration of the overall development of
the Virginia Street right-of-way. Since the sixty (60) day period started on Decem-
ber 12th it will run out on February 10th, unless extended by Commission action.
We recognize the time is short,. but if the Zoning and Planning Commission could con-
sider this question at a special meeting. it will be very much appreciated-.
We have a workshop on Monday evening,. February 6th, and the time element inconnec-
tion with this matter will be reconsidered at that .time.

Mr. Casey suggested that in view of the fact that consideration of the above letter
might be lengthy that Item No. 3 on the Agenda be considered at this time since per-
sons interested were present.. All members agreed.
Mr. Ted Anderson, owner, presented preliminary and final plans for the construction
of townhouses on
Lot 9, Block 18
Colonial Terrace Addition
He stated that four townhouses were proposed with over 2,000 sq. ft, in each lot and
consisting of three units with three bedrooms and one unit with two bedrooms.
Discussion concerned height of fence on south property line belonging to adjacent
property owner, who would be responsible for maintenance of fence, placement of fence
on townhouse property in event adjacent property owner objects to having his tgwn
down and replaced, height of townhouses, fence on west .property line., responsibility of
Zoning. and Planning .Commission requiring driveways accessible to adjoining vacant
property for better planned concept of whole area.
Motion by Mr. Casey, seconded by Mr. Johnson, that preliminary and final plans for the
construction of townhouses on
Lot 9, Block 18
Colonial Terrace Addition
be approved as presented proving it is constructed in compliance with all ordi-
nances, in particular the fence requirements on the south property line as con-
tained in Ordinance No. 1025, Sub-Section G.l.

The Chairman declared a ten minute recess.
Messrs. Bob Dunn, Fred Russell and Charles Robinson, representing St. Andrews'
Presbyterian Church, appeared before the Commission and requested a :recommendation
from the Zoning and Planning Commission to temporarily close Rutgers St. at its
intersection with Bissonnet and the partial closing of it with movable barricades
at its intersection with the south line of the church property. They suggested .that
the barricades at the property line be opened only enough to allow one car to pass
through except on days church services are conducted. They requested that an
acceptable type temporary barricade be erected at Rutgers and Bissonnet for a two
week trial basis and after that period a permanent planter type barricade be in-
stalled with probably a wooden barricade between so that in emergencies it could
be quickly "crashed" into and removed. .They stated. that the: church has a day
school for pre-school, kindergartern and first grade and they desire to stop the
through traffice so that the children .could cross safely to the property west of
the street to a playground. This property is owned by the. church.
Discussion.. included inhibiting movement of people who .do not live in West University
Place, traffic flow through city, setting of precedent for closing streets and re-
commendations from the Fire and Police Chiefs.
The persons representing St. Andrews' Presbyterian Church were advised the Zoning

and Planning Commission would request a recommendation from the Fire and Police
Chiefs to be presented at its next regular meeting on March 14, 1978. and give.
further study to their request and that the Fire and Police chiefs would be re-
quested to confer with any or all of the gentlemen present for any further info-
mation or concerning their conclusions on the request.
Discussion. of Mayor Dunn's letter previously presented included legal aspects of pre-
venting ingress and egress to property owners, rights of city to use property for
anything other than street, responsibility of Zoning and Planning Commission being
concerned about the legal aspects as opposed to a broach recommendation as to the
development as a park or residental development.
~ Motion by Mr. Casey that the Zoning and Planning_Commission respond to Mayor Dunn's
~~' letter by requesting to meet in workshop session with the City Commission to dis-
~ cuss development of Independence Park; Phase I and development of Virginia St. right-
~ of-way for .residential purposes and that the City Attorney also be asked to attend
such meeting..
Further discussion ensued as to scope of request and which issues should-be repon-
sibility of Zoning and Planning Commission.
Mr. Casey withdrew his motion.
Motion by Mr. Nuffer, seconded by Mr. Johnson,.. that-the Zoning and Planning Commis-
sion respond to Mayor Dunn's letter dated February 3,.1978 with a letter stating
the Zoning and Planning Commission is unable to render an opinion on whether the
best benefit to the city would be through the development of Independence Park.,.
Phase I or by opening Virginia St. for development for the reason that there are
a number of unansewered legal questions. (Reference letter dated 6-21-77 from
Howard T. Ayres, Jr. to Mayor.Philip A. Dunn.)
Discussion of whether to include in motion request for workshop meeting .with City
'Commission.
Mr. Nuffer emended his motion that the Zoning and Planning Commission would be
happy to meet with the City in workshop session to consider this matter.
Mr. Johnson accepted this amendment.

1978 were presented for consideration and approved as submitted.
