HomeMy WebLinkAbout10081981 ZPC Minutes8 ~ REGULAR MEETING ZONING AND PLANNING COMMISSION OCTOBER 8, 1981 The Zoning and Planning Commission of the City of West University Place convened in regular session at the City Hall, Thursday, October 8, 1981., 7:30 p.m., with the fol- lowing members present: Chairman Casey, presiding.; Members Abel and Norton. It was ascertained from the secretary that notice of meeting had been posted in the City Hall on October 2, 1981. Mr. Allen came to the meeting at this time. Preliminary plans for the construction of four townhouses were presented by Ted Anderson on Lot 1, Block 43 West University Place 1st Addition 3400 block of Bellaire Northwest corner of Westchester and Bellaire Blvd. Mr. Farrell came to the meeting at this time. Members reviewed the plans with Mr.Andersan which included-the following: 1. Access street from Westchester St. extending over utility. easement. Mr. Anderson stated the street would be asphalt which had-been allowed in a utility easement in the past. 2. Curb cut on Bellaire Boulevard. It was generally agreed that the curb cut on Bellaire Boulevard was approved for ingress and egress to the five town- houses now under construction and that if Mr. Anderson had obtained-the sub- ject property at a date subsequent to the completion of these townhouses, the curb cut would be completed. 3. Height requirement.- Mr. Anderson advised the units would be within the height requirement of 35 ft. as they are two story units and that this figure would be included on the final presentation. Chairman Casey entertained a motion that preliminary plans for the construction of four townhouses submitted by Ted Anderson on Lot 1, Block 43 West University Place 1st Addition 3400 block of Bellaire Blvd. Northwest corner of Westchester and Bellaire Blvd. be approved as submitted. Voting Aye: All Voting No: None On discussing with Mr. Anderson .the requirements of fences and/or walls in the townhouse district, i.e, allowing an 8 ft. fence and/or wall from the front building line on the side property line and along the front property line on ~9 Bellaire Boulevard, instead of a 6 ft, fence and/or wall, members agreed the ordi- nance was specific and only-an 8 ft, fence and/or wall was allowed in the areas described. Mr. Joseph Marques and his attorney, Mr. Nitsch appeared before the.Commission con- cerning-the validity of a subdivision of Lots 1, 3 and 5, Block 13 Virginia Court Addition 6200 block of Lake St. docketed #78-1 (decision 7-11-78), into two lots, each 75 ft z 100 ft., one facing Amherst, one facing ,Lake. It is their contention that the subdivision was granted "subject to-presentation of surveyor's plat plan showing the subdivision'' and since Mr. Marquar had not following through with the submittal of a surveyor's plat plan, the subdivision approval was in effect not granted.. The Commission was advised that in 1978 Mr. Marques was negotiating the sale of the 75 ft. x 100 ft. lot facing Amherst, but that it was not concluded.. He further advised that at this time he is closing on-the sale of a 100 ft, x lOD ft. section on-which the house Q is located facing Amherst ST. .and that he desired to retain 50 ft, x 100 ft., facing Lake.St. to build a home for himself. During-discussion with Mr/ Ntsch_and Mr. Marques, it was: the feeling of Board members that in order to replat the properties in any manner, a public hearing was required; that_the requirement fora surveyor^s plat plan were a substantiation of the Commission's decision to subdivide the lots into two lots; and that a legal. opinion should:be required concerning this point.. Motion by Mr. Farrell, seconded by Mr. Abell, that. a legal.apnion concerning the. requiring of a public hearing to replat Lot l $ no. 25' of Lot 3 (one lot) AND So. 25; of Lot 3 .Lot 5 (one lot) Block 13 Virginia Court Addition be obtained from the City Attorney. Voting Aye: All Voting No: None Mr. Bob Musemache appeared before the Commission concerning the same requirement of fence heights in townhouse district as discussed with Mr. Anderson. He was advised the same as Mr. Anderson and it was suggested.that both Mr, Musemache and Mr. Anderson might make an application to the Zoning Board of Adjustment requesting a variance for the fences. Chairman Casey read the following communications into the minutes: "September 11, 1981 Mr. Mike Casey, Chairman Zoning and'Planning Commission City of West University Place Houston, Texas 77005 90 Dear Mr. Casey: I am requesting a special meeting of the Zoning and Planning Commission for the purpose of approving the minutes of the August and September regular meeting. Certified copies of these minutes are required in the course of imminent legal proceedings concerning my proposed townhouse development. Your continued coope- ration is appreciated. Williamson 6714 Belmont Houston, Texas 77005 Dear Mr. Williamson: This letter is in response to your letter of September 11, 1981, requesting a special meeting of the Zoning and Planning Commission for the purpose of approv- ing previous minutes. It was determined that the earliest that we could meet would. be September 24, 1981 and that this. was just two weeks before our next regularly scheduled meeting. In view of this, and after taking a poll of the other Zoning and Planning Commission members, I have .determined .that calling a special meeting in your behalf is not warranted. Please do not hesitate to 1et'me know if I may be of further assistance to you. Sincerely, /s/ Michael'E.- Casey, Chairman Zoning and Planning Commission" Minutes of the regular meeting of the Zoning and Planning Commission on August 14, 1981 were approved with the following corrections: (1) Page 2, last paragraph, first sentence, to read ''The giving of easements and right-of-ways between the two develop- ments was discussed, with Board members feeling that thexe would have to be agreed to and granted by the adjacent property owners involved:" (2) Page Three, second paragraph, to read"Mr. Casey stated it appeared Unicenter was not returning Mr. Williamson's calls and that he did not have any leverage aver them for anyting." Minutes of the regular meeting of the Zoning. and Planning Commission on September 10, 1981-were approved as submitted.
