REGULAR MEETING
ZONING AND PLANNING COMMISSION
DECEMBER 11, 1980
The Zoning. and Planning Commission of the City of West University Place con-
vened in regular session at the City Hall, Thursday, December 11, 1980, 7:30
p.m., with the following members present: Chairman Casey, presiding: Members
Abell, Farrell, LaCook and Norton.
The Chairman asked the secretary to read the Notice of Public Hearing and
ascertained that meeting had been posted December 5, 1980 and that Notice of
Public Hearing was published in The Houston Chroncile on November 20, 1980
and letters to property owners mailed on November 25, 1980.
Motion by Mr. Abell, seconded by Mr. LaCook, that public hearing to consider
application #80-4 from Dr. William Attra, President, ST. George Orthodox
Church, to rezone
Lot 2, Block 92
West University Place 2nd Addition.
3505 Bissonnet
for church use - church, church buildings. and appurtenances, be opened.
Voting Aye: All
Voting No: None
Mr. introduced himself and gave his address in the city followed by each member
of the Commission,-explained the procedure: to be followed and administered oath to
those in the audience deisring to speak concerning the application.
Mr. Emil Farrhood, 8523 Clarewood and Mr. Larry Daily, 2009 Bernard, represented
St. George Orthodox Church. Mr. Daily is the architect for: additions and improve-
ments to the church educational building.. He stated the church is in the pro-
cess of adding to their educational building which is located on Lot 1 adjacent
to the subject lot and on which the sanctuary and the existing auditorium are
located. The plans for additional space were presented and showed that a por-
tion of the new .addition would extend into Lot 2 which is owned by the church
(for approximately YO years) and on which the parsonage is now located, therefore,
the church desired to have Lot 2 also be rezoned for church. use to conform with the
Boning of Lot 1.
No one else appeared to speak for or against the application.
Motion by Mr. Farrell, seconded by Mr. Abell, that the public hearing be closed.

Mr.-Ted Anderson presented final plans for the construction of four townhouses on
Lot 2, BLock 43
West University Place 1st Addition

Members reviewed the plans as presented.

be approved as submitted, subject to compliance with all building codes, or other
governing ordinances, whether or not herein specified, for any subsequent con-
. struction.
Dr. Clifford Lawrence, 67:31 Sewanes, said that he lives directly behind these pro-
posed townhouses in a townhouse are and he had been concerned about the developer
cutting down trees which are on the property line between the two projects or that
a drivewy or concrete patio might be located so that .the trees would be killed.
(~ However, he .stated that after seeing the plans and hearing Mr. Anderson, he felt
sarisfied that he was doing all he could to save the trees.
Q Mr. Anderson stated that they felt the trees should be saved and that they had

Mr. Janice Mitchell, 6721 Sewanee, said that her concern also had been for the
trees but that she was .satisfied b9r. Anderson was doing all possible to save them.
Dr. Larence also mentioned privacy factor and a discussion of fence heights
followed, and Mr. Anderson said he planned to speak with all of the property
owenrs on the west side to work out a joint fence and that planting was also
being planned which would supplement the fence for privacy.

Further consideration of application #80-3 from Donald C. Reese to subdivide
Lot 6, BLock 4

into two lots, each facing Cason, was undertaken at this time.
Mr. Reese said he had prepared some schematics of .what he planned to do with the
property which he would like to present.
Chairman Casey advised that in view of the fact that the public hearing was
closed he felt they might be critisized for accepting any further information.
Mr. LaCook concurred and stated that the subdivision of the lot was the main con-
cern of the Commission and not what would be located thereon in terms of struc-
tures as they could not hold anyone to a plan once the. lot was subdivided..
Mr. LaCook said he had read the minutes of the public hearing and it was his
understanding that Mr. Reese had proposed to remove a porch on the east side of
the existing house .which would leave approximately a one and one-half foot set-
back on that side and construct anew residence before removing the existing one
which would make the existing house in violation of .the setbakc requirement. He
stated that in his opinion the Commission could subdivide the lot, if it so de-

sired, but that neither lot so created would be a buildable lot until the vio-
lation was. corrected, or the developer could, after subdivision, make a con-
tract enacted by the City Commission to build the new house before removing
the other, but that Mr. Perry, the inspector, nor the Commission had the autho-
rityto do so.
Mr. Farrell stated that he had read the minutes and noted Mr. Abell's comments
and questioned the number of other 50 ft. lots on the block..
Mr. Abell stated that there were quite a few, in fact that they were predominate.
Members studied a map and noted that most of the lots adjacent and across the
street were fifty foot lots.
Mr. Casey stated that his only opposition was in creating a lot with a violation
and the capability of the owner to then apply to the Zoning Board of Adjustment
for a variance.
Mr. Farrell stated he felt the Commissions only concern was if it was a valid
subdivision: and not what might happen later.
Mr. Abell stated that he felt they should have enough faith in the Inspection
Department and/or other Boards to make later decisions, if any, concerning the
lot.
It was also pointed out that if the subdivision was approved two large lots,
although narrow would be created with 10,000 square feet which is twice the minimum
.requirement.
Motion by Mr. LaCook, seconded by Mr. Farrell, that application docketed #80-3

into two lots, each 50 ft. x 200 ft., each facing Cason, be approved subject to
compliance with all building codes, or other governing ordinances, whether or not
herein specified for any subsequent construction.

Discussion of the application to rezone from St. George Orthodox. Church was
followed by the following action.
Motion by Mr. Norton, seconded by Mr. Abell, that the Zoning and Planning Commission
recommend to the. City Commission that

be rezoned for church use church, church buildins and appurtenances,. and. that
the Chairman be authorized to make a Final Report to the City Commission.

P~tinutes of the regular: meeting of the Zoning and Planning Commission on
November 13, 1980 were approved as presented.
With no further business to come before the Commission, upon motion duly made,
seconded and carried, the meeting adjourned at 8:30 p.m.
