REGULAR MEETING
ZONING AND PLANNING COMMISSION
NOVEMBER 8, 1979
The Zoning and Planning Commission of the City of West University Place con-
vened in regular session. at the City Hall, Thursday, November 8, 1979, 7:30
p.m., with the following members present: Chairman Casey, presiding; Members
Abell, LaCook, and Norton.
The Chairman ascertained that notice of meeting had been posted in the City
Hall three days prior to the scheduled meeting:
Members of the Commission discussed the rezoning of
Lots 1, 2, 3, 4, 5, 6, Block 2
Collegeview 3rd Addition
on which a public hearing was held April 10, 1979.
Motion by Mr. LaCook, seconded by Mr. Norton, that after holding a public
hearing on the rezoning of
Lots 1, 2, 3, 4, 5, 6, Block 2
Collegeview 3rd Addition
and .considering the facts and issues, we do not recommend a change in the
existing zoning of these lots.
Voting. Aye: All
Voting No: None
Board members discussed the time element in conjunction with the submittal of
recommendations concerning accessory buildings and garage apartments;
1. Waiting .until previusly submitted recommendations to amend the zoning ordi-
nance has been acted on by the City Commission as some recommendations al-
ready submitted control accessory building use to some extent..
2. Early submittal of recommendations so that City Commission's deliberations
could include accessory building/garage apartment use, as previous recom-
mendation did not encompass enforcement, grandfathering and other points
peculiar to this subject.
Discussion of the use of accessory buildings .and garage apartments included the
manner in which recommendations should be submitted:
1. General broad recommendations to encompass .and emphasize problems and pres-
sures for an ordinance to clarify and enforce single family dwelling concept.
or
2. Specific recommendations in which to achieve the single family concept.
PArticular discussion was held on interpreation of family as defined in Ordi-
nance N0. 1032, exceptions to occupancy of garage apartments, legalities invol-
ved in making recommendations which may be declared unconstitutional, use of
accessory buildings for other than living purposes.

Motion by Mr. Norton, seconded by Mr. Abell, that the Zoning and Planning
Commission recommend to the City Commission that after having reviewed the
existing ordi-nance and having held a public hearing on the matter of accessory
and garage apartment usages, we have resolved that
1. The present ordinance has experienced increasing pressures involving
garage apartments for .commercial purposes.

2. That we feel in the long range interest of the city,. to preserve the. goals
and character of the city as outlined in the ordinance, and to preserve the
single family dwelling goals, that. only one family should b.e permitted: to
-live on one lot in a single family dwelling district.
3. That the City Commission take prompt action to gather the essential expertise
and consultation necessary to achieve this result:
4. That the Zoning and Planning Commission desires to emphasize that this
problem/issue is in need of proper clarification as soon as practical to
preserve the interest of the city in this matter.
Discussion of the motion included suggestions of including a cut off date for
garage apartment occupancy, issuance of temporary permits for exceptions, i.e.,
nursing care, in-laws, etc., agreement that the goal of any recommendation is
to protect the zoning ordinance in the single family. concept, should family
definition as defined in Ordinance No. 1032 be changed, enforcement of ordi-
nances, and legal questions.
Mr. Norton, with Mr. Abell's agreement, withdrew his- motion.
The secretary was instructed to arrange a meeting with the City Attorney for
a workshop meeting to discuss legal questions involved in recommendations for
use of garage apartments.
Minutes of the regular. meeting of eh Zoning and Planning Commission on October 18,
1979 were presented for consideration and approved as corrected.
With no further business to come before the Commission, upon motion duly made,
seconded and carried, the .meeting adjourned at ,10:10 p.m.
