REGUhAR MEETING OF ZONING & PLANNING BOARD
OCTOBER 10, 1963
The Zoning & Planning Board convened in regular session at the City Hall on
Thursday, October 10, 1963, 7:30 p.m., with the following members present:
Chairman Gill, presiding, Members Lott, Jones and Hilton. Members Snyder
and Haralson were absent.
Mr. R. P. Ganchan, President of Wier Homes, Inc., and Mr. H. C. Wauson, Archi-
tect, representing Mr. Lawrence J. Lipkin, appeared before the Board asking
approval for ,construction of a residence on the south 1~2 of Lot 9, Block 6,
West Unversity'Place 1st Addition, located in the 00 block of Vanderbilt,
with a setback of 38 feet from the front property line instead of 30 feet.:
Mr. Ganchan stated there were several trees on the front of the lot which
they desired to save, and that other houses in the block were also set fur-
ther back than the 30 foot building setback.
Motion by Mr. Jones, seconded by Mr. Lott, that the Board recommend approval
for a residence to be constructed on the south 1~2 of Lot 9, Block 6, West
University Place 1st Addition with a setback of 38 feet from the front prop-
erty line instead of 30 feet, in order to save as many of the existing trees
as possible.
Voting Aye: All Voting No: None
Mr. A. Ross Williams, owner of Lot 15, Monticello Addition, made inquiry as
to proper procedure to officially request permission to subdivide the lot
into two lots 55 X 96.57 feet to front on Wakeforest in order that he might
erect two residences as rental units. Mr. Williams was given information as
to the proper procedure to follow.
Mr. Don Mathes, 3610 Nottingham, asked permission to install an additional
110 volt electrical circuit in the existing servant's room to accommodate an
air conditioning unit. He stated there is presently afire hazard,. in his
opinion, as the fuses burn out constantly. (Building Permit No. 3'40 issued
10-15-~+1 to remodel garage and add on 20 X 20'6".servant's room and 5 X 6T
tool room)
Motion by Mr. ]Lott, seconded by Mr. Jones that Mr. Don Mathes be permitted
to have an additional 110 volt electrical circuit installed in the garage
servant's room to accommodate an air conditioning unit in order to eliminate
a fire hazard.
Voting Aye: All Voting No: None
The Board was advised that inquiries had been made regarding rental of an
existing garage apartment on the property at the corner of Fairmount and-
Dartmouth Streets, being Lots l~- & 15, Block 8, College Court. It was deter-
mined from city records that Building Permit No. 0 was issued 9-5-35, for
a 6-room frame dwelling and a 2-story garage and Permit No. 6288 was issued
1-26-51 for general repairs to the existing residence and garage apartment.

After discussing the matter. it was. the conssus that the garage apartment
at x+201 Dartmouth Street is a legal non-conforming structure and its use
as a rental unit may be continued.
With no further business to come before the Board at this time, ..upon motion
duly made, seconded and carried, the meeting was adjourned.
