REGULAR MEETING OF ZONING & PLANNING BOARD
SEPTEMBER 12, 19b3
The Zoning & Planning Board convened in regular session at the City Hall on
Thursday, September 12, 1963,.7:30 p.m., with the following members present:
Chairman Gill, presiding; Members Jones, Haralson,aLott and Hilton. Mr.
Snyder was absent...
Mr. Law L. Lovelace, who owns the west 32 1/2 feet of the east one half of
Lot 12, Block 9, West University Place 1st Addition, appeared before the
Board and requested permission to build an especially designed house on this
32 1~2 foot lot and he presented an architect's drawing of a house which
could be built in the area available.
Motion by Mr. Lott, seconded by Mr. Jones, that the request to build a resi-
dence on the 32 1~2 foot portion of Lot 12, Block 9, West University Place
First Addition,.. be denied, :inasmuch as the lot space would not meet the zon-
ing ordinance requirements for minimum square footage of a residential lot.
Voting Aye: All.
Voting No: None
Mr. R. K. Wark, Jr., 4024 Ella Lee Lane, Houston, appeared before the Board
requesting the east 38 foot portion of Lot 15, Block 2, Evanston Addition,
be rezoned for commercial purposes. He presented a plan showing a one-story
office building and a warehouse building he desired to erect on Lot 16, and
a portion of Lot 15.
Motion by Mr. Lott, seconded by Mr. Jones, that the request of Mr. Wark to
rezone the east 38 foot portion of Lot l5, Block 2, Evanston Addition for
commercial purposes, be denied inasmuch as this would be considered spot
zoning.
Voting Aye: All
Voting No: None
Mrs. Helen K. Milligan, 2600 Cason, appeared before the Board requesting per-
mission to build a town house on Lot 1, Block 5, Belle Court Addition, to be
occupied as a two-family residence by her sister and herself.
It was explained to Mrs. Milligan that a two-family residence on a single
lot would be in violation of the zoning ordinance and it was suggested that
any further. plan be submitted to Mr. Kingman, Building Inspector, in order
to determine whether or not it would comply with the zoning ordinance.
After this suggestion, Mrs., Milligan withdrew her request.
The following letter from Mayor Dupree Holman, addressed to the Zoning and Plan-
ning Board, was read aloud by Chairman Gill:

"At its regular meeting on September 9, the City Commission took the follow-
ing action: 'Motion by Commissioner Rice, seconded by Commissioner Wall,
that the proposal to amend the city's zoning ordinance to establish a new
district to be known as District 0-1 which would ~eover lots fronting on
Bissonnet between Buffalo Speedway and Wakeforest Avenue and permit exec-
tion of single-family dwellings, duplexes and office buildings, be referred
back to the Zoning & Planning Board for further review and recommendation.'
The Commission felt it desirable to take such action because (1) there has
been a difference of opinion .between attorneys as to the validity of the
Public Hearing which was held on August 8, 1963, (2) the Commission felt
that this proposal is:-of_such importance that whatever is best for the city
should be done, and (3) in order to ascertain whether any further action
should be taken and what type action if any.
Your review and recommendation to the Commission will be appreciated."
After the. Letter was read to the Zoning Board,-the following residents who
were present at the meeting expressed their opposition to any change in the.
zoning ordinance, and. offered suggestions as to how the existing zoning
regulations might be maintained: Mr. Frederick Van. Brunt, 3118. Wroxton;
Mr. & Mrs. James R. Suns, 3121 Wroxton; Mr. Robert Hardy, 3122 Wroxton; and
Mrs. Betty Zitzo, 3108 Wroxton.
The Board advised the group that they would give the matter very serious
study before any further recommendation is made to the City Commission.
With no further business to come before the. Board at this time, upon motion
dulymade, seconded and carried, the Zoning and. Planning Board adjourned
