Hannah, presiding; Members Bricker,. Hilton, Hines and Lott. Motion by Mr. Hines, .seconded by Mr. Hilton, that the Public Hearing called for .7:30 p.m. to consider subdivision of the north 100 X:118 feet of Lot ~+, Block ~+1, West University Place First Addition, be opened. Voting Aye: All Voting No: None Chairman .Hannah stated for tY~e record that notice was published in the Southwest Peach Section of -the Houston Chronicle on March 23, 1966 and mailed to all property owners. within 200 feet of the property on March 25, 1966 as required by law. Mr. E. J. Simons, 6703 Rutgers, appeared before the Commission in behalf of his application for subdivision, number 66-2, stating that he desired to subdivide. the lot into two lots, each to front on Rutgers Street, one lot to be 55 X 100 feet and one 63 X 100 feet. He stated-that there would be no encroachments. There being no other property owners. desiring to be heard, Mr. Hannah read a letter from Mrs. W. M. Lawrence, 3220 Bellaire Boulevard, advis- ing that she had no objection to the proposed subdivision. With no further questions or information to be presented, the following action was taken: .Motion by Mr. Bricker, seconded by Mr. Lott, that the Public Hearing be closed. Voting Aye.: All Voting No: None Motion by Mr. Lott, seconded by Mr. Hilton, that the north 100 X118 feet of Lot ~+, Block 41, West University Place First Addition be subdivided into two lots, one 55 X.100 feet and one 63 X 100 feet,. each to front on Rutgers Street, as requested by theowner, Mr. E. J. Simons, provided necessary easements are granted and provided there are no encroachments. Voting Aye; All Voting No: None Upon motion duly made, seconded and carried, the meeting was then recessed to the Community Building, where a Public Hearing was called for 8 p.m. ~~~ The Zoning and Planning Commission reconvened in regular session at the Community Bui:6dxng, 610- Auden, at 8 p.m. with the following members present: Chairman Hannah, presiding; Members Bricker, Hilton, Hines and Lott. City Attorney Charles Cockrell and Attorney Paul Strong were also present, to give legal advice to the Comm}"ssion. Motion by Mr. Hines, seconded by Mr. Hilton that the Public Hearing called for 8 p.m. to consider Application number 66-3 submitted. by Mr. Horace M. Mann, optionee for rezoning of Lots 1 through 15, Block 2, Monticello Addition, and also to consider rezoning for townhouse development Lots 1 through 16, Block 1, Monticello Addition, be opened. Voting Aye: All Voting No: None Chairman Hannah announced that this Public Hearing had been called for 8 p,m. for-the purpose of hearing any interested persons- in connection with. the rezoning of Lots 1 - 16, Block 1 and Lots 1 - 15, Block 2, Monticello Addition, for townhouse development. He stated that for the record, notice was mailed to all property owners within 200 feet of the property, according to the city's tax roll, on March 25, 1966, and that notice was published in the regular section of the Houston Chronicle on Sunday, March 27, 1966. Chairman Hannah stated. that an application had been received by the Zoning and Planning Commission to rezone Lots 1 - 16, Block 1, Monticello Addition for townhouse development. He stated that the Commission felt that any consideration should ineludo both Blocks 1 and 2, facing on Bissonnet, as they both were in .the same circum- stances. Mr. Hannah. then read the preliminary report of_the,Zoning and Planning Commissi,cn which was filed with the City Secretary on March 23, 1966. He read the procedure and regulations for conducting of the. Hearing, and asked that those desiring to be hear. please comply. Mr. Horace M. Mann, optionee and Mr. Clifford Parks, designer, wire then intro- duced as the applica.hts. Mr. Mann stated to those presentf that the application proposed to con- struct a ~+8-unit townhouse project along the lines shown on the draw- ings which Mr. Parks had prepared on Lots 1 through 15, Block 2, Monticello Addition. He stated that there would be an inv~atment of approximately $700,000, and that they were interested in the prapre;~y of the project, to protect the citizens.' property and their own investment. He advised that it would be an expensive project by any standard, one of which they as investors would beproud and of which the residents would also be proud. Mr. Mann stated that the project 4~ would be well managed, with on premises management. He stated that he himself was a management consultant, and then asked for any questions from those persons present.. Proctor, x+102 Case;. Mr. 0. H. Moore, 2910 Wroxton Road; Mr. Roy Pickering, 3021 Wroxton Road; Mrs. Dozier, 3737 Nottingham; Mr. Steve Walters, 291- Wroxton Road; Mrs. Leslie Ribbeck, 2917 Wroxton.. Road; Mr. D. H. Guidry, owner of Lot 12, Block 1, Monticel7o'Addition; Mr. Carroll Brown, 3035 Wroxton Road; Mr. Page, 3708 Wroxton Road; Mr. Harold Adam, 2911 Wroxton Road; Mrs. Davis, 300- Wroxton Road; Mr. Randolph, 3128 Wroxton Road. The questions concerned the following matters: amount of rental to be charged for the townhouses, reason for choosing this particular property, definition of townhouses, whether the units would be rented sold or leased, number of lots the drawing shown by Mr. Parks would cover,_demand for rental units in this are€~, where the parking area would be located, whether the air conditioning would. be central or individual units, what safeguards would prevent anything other than townhouses>~being constructed if it were rezoned, how .much tax contribution is estimated, meaning of 'density' in preliminary report, number of units=proposed, location, setbacks, etc; what control the city would have over whether the units were sold, leased or rented, whether courts have upheld zoning laws where owners were tal~a.n~ finan- cial loss, what consideration had been given to over~'low parking, amount of equity money required for-this type project, whether the application was made in the name of .the property owners or Mr. Mann, and whether consideration could be given to changing the ordinance governing fences. These .questions were answered, insofar as possible, by Mr. Mann, Mr. Parks and the Zoning`Commission. With no further questions to be asked, Mr. Hannah announced that after a five-minute recess, statements would be heard. Statements were made by the following persons, opposing the proposed townhouse project: Mr. O. H. Moore, 2910 Wroxton Road; Mr. H. A. Weatherby, 2708 Wroxton Road; Mr. Carroll Brown, 3035 Wroxton Road; Mrs. Harold Wey, 2920 Wroxton Road;. Mrs. Leslie Ribbeck, 2917 Wroxton Road; and Mr. Milton Schwartz, attorney for the group, who stated that the application must show that. the proposal is in the best interest of the general welfare, safety, public health and morals to justify the change.
