REGULAR MEETING OF
ZONING AND PLANNING COMMISSION
SEPTEMBER 12,.1968
The Zoning and Planning. Commission of the City of West University Place convened in
regular .session at the City Hall on Thursday, September 12, 1968 at 7:30 p.m., with
the following members present: .Chairman David W. Hannah, presiding; Members R. C.
Hilton, E. Gene Hines and H. E. Lott. L. B. Bricker was absent. Mr. Tom I. Jones,
City Engineer, was also present.
The meeting was called to order by Mr. Hannah.
Mr. Guy Robertson, President of Pilgrim Launderers and Cleaners, and Mr. Jim
Russell, representative for Mr. Robertson, appeared before the Corrnnission and made
application for the°rezoning of Lots 9, 10 and. ll. Block 3, Cunninghat~ Terrace
Addition, City of West University Place, Texas, for commercial buildings and use,
Mr. Robertson presented architect's plans and specifications for improvements he
plans for these lots if same are rezoned. Mr. Robertson owns Lots 4, 5, and 6,
Block 7, Cunningham.; Terrace Addition, and the north l65' of Lot 26, Cunningham
Terrace, which adjoin the above described property, and also presented plans and
specifications for development of these lots which will go .forward soon.
Mr. Tom Wheat and Mr. Sam Jett, owenrs of Block 2, Cunningham Terrace Addition, City
of West University Place, Texas appeared before the Commission and indicated they
would make application for the rezoning of this property for commercial buildings and
use.
After a detailed discussion between the members of the Zoning and Planning Commission
and owners and representatives of the above properties, Mr. Hannah advised both
parties that consideration for rezoning would be given to both properties at the
same time upon receipt of proper application. Mr. Robertson, Mr. Russell, Mr. Wheat
and Mr. Jett left the meeting at this time.

Mr. Hannah called the attention of the Commission to two .letters received from
Mr. Whitt Johnson, City Manager, and Charles F. Cockrell, Jr., City Attorney,
respectively, concerning the size of Lot 2, Block 35, Colonial Terrace Addition,
City of West University Place, Texas. It was pointed out that. this lot is 140'
in depth, whereas the adjacent lots being considered for rezoning are only 120'
deep. This variance was brought about by several transactions concerning this
property and also the deeding of a right-of-way for Cason Street.
After a general .discussion by Commission members and Mr. Tom .Jones, City
Engineer, motion was made by Mr. Hilton, seconded by Mr. Lott, authorizing Mr.
Hannah to write a letter to the City Commission setting forth its position on

~ "That Lot 2, Block 35, Colonial Terrace Addition, City of West
+-, University Place, Texas (also known as the south 140' of Tract 9,
U Cambridge Place) be treated .as a single lot and be .rezoned to its
V entire depth of 140` subject to the following easements:
Utility easement across Lot 2, Block 35, Colonial Terrace Addition,
City of West University Plce, Texas (also known as the south 140`
of Tract 9, Cambridge Place) from David W. Feldman to the City of
West Uni ersity Plce, Texas, and, t
Sanitary sewer easement across Lot 2, Block 35, Colonial Terrace
Addition, City of West University Place, Texas (also known as the
south 140' of Tract 9, Cambridge Place) from David M. Feldman to
Kennth J. Stenger., and ,
That the rear setback line of Lot 2, Block 35, Colonial Terrace
Addition be forty (40') feet."

A copy of proposed Ordinance No. 902 creating a Professional and Business
Office Building District on the twelve lots facing Bellaire Blvd., and between
the YMCA property and Acadmey Street was. presented to the Commission for revaew
and study. Special note was mde of the two variances from the Zoning and
Planning Commission's Final Report in regard to a twnety (20') foot rear building line
instead of the ten (10') foot rear building line; and the stipulation that the five
(5`) foot public utility easment on the lots in such district shall not be paved
or covered with concrete, asphalt or other materials. There were no objections
to these two changes.
It was suggested that the insertion of the word "street" inn Paragraph (2) ans (3)
Section C would help clarify the intention for the side set backs.. It could be
changed to read as follows:
"(2) No building or structure of any kind shall be constructed
or erected within ten (10') feet of the street side property
line of a corner lot, which sides on a street fifty (50')
foot or less in width' no building or structure of any kind
shall be constructed or erected within five (5`) feet of the
street side property line of a corner lot which sides on a
street sixty (60') feet or less in width.
(3) Buildings contructed or erected on corner lots which side on

a street having a width of seventy (70')-feet or more shall
not be required to set back from the street side property line;
buildings constructed or erected on inside lots shall not be
required to observe any side setback from the property line."
Mr. Hannah advised that Mr. Charles Cockrell, Jr., City Attorney, was invited
to attend this meeting but was unable to do so. Several questions remain in front
of the Commission which need a legal opinion, and it was decided to invite Mr.
Cockrell to attend the next regular meeting of the Zonin .and Planning Commission.
There being no further business to come before the Co fission at this time, upon
motion duly made, seconded and carried, the meeting ~.journed.
