REGULAR MEETING
ZONING AND PLANNING COMMISSION
MARCH. 9,.1971
The Zoning and Planning Gommission of the City of West University Place con-
vened in regular session at the City Hall, Tuesday, March 9, 1971, 7x30 p•m.,
with the following members present: Temporary Chairman E. 4ene Hines, presid-
ing; Members M. C. Caldwell, Roland E. Dahlin, and H. Allen Weatherby.
Mr. L. B. Bricker was absent.
Mr. Leo Rubenstein, 12514 Woodthorpe, Houston 77024, Owner of
Lot 1, Block 1

appeared before the Commission to discuss possible rezoning of this property
for townhouse construction. Mr. Rubenstein was-advised that the .Commission
would study the information furnished to them and advise their opinion by letter.
However, it was pointed out to Mr. Rubenstein-that this property would probably
not be considered for .rezoning as a single section, and that the Commission is
undertaking to make a study of all peripheral property for recommendations for
future usage.

appeared and presented application for subdivision of this lot into three lots,
each 50; x 100, two lots fronting on Georgetown, and one lot fronting on
Westchester.
Motion by Mr. Caldwell, seconded by Mr. Weatherby, that Public Hearing be called
for consideration of application for subdivision of
Lot; ,Block 57
West University Place 2nd Addition
3323 Georgetown
into three lots, each 50 x 100, two lots fronting on Georgetown, and one lot
fronting on Westchester.
Voting Aye: Two Voting No: Two
Due to a tie vote on the above application, decision was made to defer further
action until such time as all members of the Commission were present in order to
obtain a majority vote.

appeared before the Commission for further discussion of allowing an exception
of the 5,000 sq. ft. minimum requirenent;n the Zoning Ordinance for single-
family dwelling construction on this property. She presented a letter from
Mr. Lovelace generally outlining the history of his ownership of this property„
Mrs. .Wright was advised that if Mr. Lovelace would produce acceptable legal
documents showing this property was indeed this dimension and owned by him
before the Zoning Ordinance went into effect (June, 1937), the Commission would
then consider hisrequest for single-family-construction thereon.

appeared before the Commission to discuss possible rezoning of the above property
for townhouse discussion.
Mr. Kubala was advised that this one lot, or even three lots„in which he was
interested in purchasing adjoining the above property, could not be considered
as a separate entity, but the entire face of the block and the effect it would
have on the surrounding area would be important factors for study by the
Commission.
At the suggestion of the City Manager, the Commission briefly discussed city
cost for holding of Public Hearings. No recommendation was :Wade but tYie feeling
of the members was that each Public Hearing should be keyed to the actual cost
according to application, i.e., sub-division applications require only one Public
Hearing by the Zoning and Planning Commission, but applications for rezoning
require two Public Hearings - Zoning and Planning Commission and City Commission.
The following action was taken in electing officers for the Zoning and Planning
Commission:
Motion by Mr. Caldwell, seconded by Mr. Weatherby, that E. Gene Hines serve as
Chairman of the Zoning and Planning Commission.
Voting Ayer All Voting ldo: None
Motion by Mr. Caldwell, seconded by Mr. Dahlia, that L. B. Bricker serve as
secretary of Zoning and Planning Commission.
Voting Aye: All Voting No: 1Vone
With no further business to come before the Commission at this time, upon motion
duly made, seconded, and carried, the meeting adjourned.
