HomeMy WebLinkAbout03071972 ZPC Minutes1$ REGULAR MEETING ZONING AND PLANNING COMMISSION MARCH 7, 1972 The Zoning and Planning Commission of the City of West University Place con- vened in regular session at the City Hall, Tuesday, March 7,-1972, with the following members present: Chairman E. Gene Hines, presiding; Members M. C. Caldwell, Roland Dahlin, and H, Allen Tnreatherby. Mr. Bricker was not present. A letter to the Zoning and Planning Commission from Mr. j~eo J. Rubenstein re- questing a copy of the Caudill, Rowlett and Scott, Land-Use Study was presented to the Commission. The Chairman was instructed to answer Mr. Rubenstein's letter and advise that he would be notified when the`~tudy is available for public distribution. Chairman Hines requested a decision on the attached letter from Mr. Whitt Johnson, City Manager, which is incorporated. into these minutes by reference and which was distributed to the members before the meeting with the Agenda. After discussion of the letter, motion by Mr. Dahlin, seconded by Mr. Weatherby that the Zoning and Planning Commission recommend payment to Caudill, Rowlett and Scott of the full-amount detailed in their December 30, 1971, statement, conditioned, first upon the insertion of a specified errata and agenda sheet, and second upon the substitution of corrected maps in place of those now found on pages ~ and 35: the addenda and errata sheet or sheets and the maps should be bound into the re- port; and that the Chairman be authorized to so recommend by letter to the City Commission. Voting Aye: All Voting Na: None The members of the Zonir_g and Planning Commission dratted a letter and errata and addenda sheet to the City Commission concerning the above recommendation: "March 7, 1972 The Honorable Mayor and Members of the City Commission City of test University glace, Texas Gentlemen: We acknowledge receipt of Caudill, Rowlett and Scott's December 3U, 1971, stat~met of the final increment of the amount due for the Land Use Study, which statement was forwarded to us by letter from Mr. Whitt Johnson, dated February 15, 1972, and requesting from the Zoning and Planning Commis- sion a letter expressing their satisfaction with the completeness and accu- racy of the material received from Caudill, Rowlett and Scott. 1~e recognize minor inaccuracies in the present final report which are de- tailed in the enclosure to this letter as a suggested errata and addenda sheet; we find the land use mays on pages 9 and 35 in error, and in one or two instances we would have selected a different style of presentation. The City Commission may wish to call attention to other inaccuracies which they consider significant. Cognizant of these inaccuraee we ha~Td re- ~`1' viewed the contract. We are of the unanimous opinion that:; .the contract ser- vices have been performed, and that the work and report should be accepted for the purpose of payment. In view of the contemplated public availability of the report, we think that an errata and addenda sheet should be inserted and that :naps indicated above should be corrected. On April 13, 1971, at a regular meeting and after previous inforrna.l dis- cussions, the Zoning and Planning Commission initiated contact with Caudill, Rowlett and Scott, in order to obtain services we required as laymen and real property taxpayers, serving as members of the commission, intent upon ~.,. the conscientious discharge of our responsibilities. We sought the assist- ~y ance of consultants and we understand that to be our statutory prerdgative. Cp Along with the City Commissioners, we have participated in and observed the "'~ progress of the Land Use Study which resulted in the final bound report. We V think we have benefited from the participation, and will continue to find the report most hel?~ful. We feel that the minor discrepancies in the final report in no way dimin- ish the vaaue of the study to us for the purposes for which we sought itr namely as an aid and tool in our plannir~ and decisions. It is important to note that we recommend the acceptance for payment of the work performed and the report. We are not recommending that the Land Use Study of the final report be adopted as the plan for our city. It is our concept that an official plan for the future land use in our city should be the work product of this appointed commission and not of any contract consultant. After earnest deliberatio~h, culminating in formal consideration at our regular meetin on Tuesday evening, March 7, 1972, the Zoning and Planning Commission by unanimous vote of those present recommend payment to Caudill, Rowlett and Scott,. of the full amount detailed in their December 30, 1971, statement, conditioned, first upon the insertion of a specified errata and addenda sheet, and second, upon the substitution of corrected maps in place of those now found on pages 9 and 35; the errata and addenda sheet or sheets and the maps should be bound into the repoa~t. Motion by Mr. Dahlias, seconded by Mr. Caldwell, that the Zoning and Planning Com- mission recommend to the City Commission that before any copies of the Caudill, Rowlett and Scott, study. are made avai'Lable for public distribution that the cover sheet and the un-numbered page l be stamped with the following notation: "This study was authorized by the City Commission at the request of the Zoning and Planning Commission and was prepared for use as an aid to the Zoning and Planning Commission. The study was not intended to be and has not been adopted as a city plan." and that the Chairman be authorized to so recommend by letter to the City Commission.
