REGULAR MEETING
ZONING AND PLANNING COMMISSION
DECEMBER 9, 1975
The Zoning and Planning Commission of the City of West University Place convened in
regular session at the City Hall, 7:30 p.m., Tuesday, December 9, 1975, with the following
members present: Chairman Bartholomew, presiding; Members Dahlin, Norton and
Weatherby. Mr. LaCook was absent.
Proper notice of meeting had been posted on the bulletin board at the City Hall three (3) days
prior to the scheduled meeting as required by HB3, Amending 625217, V.C.C.
The Public Hearing to consider the application of Mr. W. E. Cole, owner, to subdivide

into two lots, one 112.6 ft. x 100 ft. facing Albans, and one 54.4 ft. x 100 ft. facing Sewanee,
was opened at this time.
The Chairman ascertained from the secretary that notice was published in The Southwestern
Argus, Wednesday, November 19, 1975, and that all property owners within 200 ft. of the
above property were notified by letter dated November 19, 1975, of the Public Hearing.
The Chairman administered the oath to all those present who wanted to make statements 'or=
ask questions either for or against the application and explained the procedure. to be followed
for the Public Hearing.
Mr. Cole reviewed his application, stating he desired to sell the lot facing Albans, if
subdivision is approved, and build a new house on the lot facing Sewanee.
It was pointed out to Mr. Cole that the subdivision, i# approved, would not be a legal
subdivision until off street parking was provided for the premises now existing on the lot
facing Albans St. and the: existing building facing Sewanee Street is removed. Coverage of lot
to leave 4086 open space was also discussed and it was determined that with the existing
house, and even with the addition of a garage, there would be ample open ~ s~laee on the lot
facing Albans.
Mr. Edward A. Borgelt, 3512 Albans, asked if a garage were constructed would it be located
directly against his property. He was advised that a garage attached to the west side of the
existing residence would be within the setback requirements of the Zoning Ordinance, which
requires a three (3') ft. side set back.
Motion by Mr. Dahlin, seconded by Mr. Weatherby, that application to subdivide
Lot 5, Block 92
West University Place 2nd Addition

into two lots, one 112.6 ft. x 100 ft. facing Albans and one 54.4 ft. x 100 ft. facing Sewanee,
be approved subject to compliance with all building setback requirements, building code, in
particular the Offstreet Parking Ordinance, or other governing ordinances, whether or not
herein specified, for subsequent construction
During discussion of the motion, Mr. Weatherby,. Mr. Norton, and Mr. Dahlin stated that it
was their feeling that in most instances key lots, as in this situation should not be allowed, as
the overall benefit to the City is not necessarily served by such a subdivision, as it adds to the
population density, adds parking problems, etc., especially if such action constitutes initial
subdivision in an area where no other key lots exist. They stated that in this particular area a
key lot is already in existence directly across the street and others are in close proximity.

Upon motion duly made, seconded and carried the Public Hearing was closed.
A site plan for construction of townhouses at the northeast corner of Buffalo Speedway and
Bellaire Boulevard was submitted for approval from Mr. Wm. Perlmutter.
After consideration of this application at the November 11th meeting of the Commission, a
request was made to Chief Ben Wilcher, Fire Chief, for his opinion and recommendations in
regards to firefighting on the proposed site.
The following is a letter from Chief Wilcher on this subject:

Dear Mr. Bartholomew:
A site .plan for townhouses at the northeast corner of Buffalo Speedway, and Bellaire
Boulevard has been presented to me along with your request for an opinion as to workability
of the plan as it concerns firefighting.
After a careful study of the plan, I can .see no objection insofar as firefighting is concerned.
The driveways are adequate and the turning radius at the corners are adequate for
firefighting equipment to manuever. There appears to be awalk-through near the center of
the row of houses facing north which could be used to lay hose in the event of a fire in the
front areas of these residences. Of course, the east and west sides of both rows are free for
the laying of hose down driveways and those facing Bellaire Boulevard could easily. be
reached from that street.
I would like for .you to consider requiring the builder to have signs erected in all driveways
which read "NO PARKING. - FIRE LANE", which would necessitate all vehicles to be either
in garages or in properly marked parking spaces.

Motion. by Mr. Weatherby, seconded. by Mr. Dahlin, that the site plan as submitted be
approved subject to the following:

1. "No Parking -Fire Lane" signs be erected in all
driveways.
2. Setback at rear property line be twenty (20') feet
as required by Ordinance No. 1025.
3. Buildings on north side may be enlarged to extend
into. green area, leaving a five (5') ft. minimum setback.
and also subject to compliance with building code or other governing ordinances, whether or
not herein specified, for any subsequent construction.
