HomeMy WebLinkAbout12021982 ZPC Minutes114 REGULAR MEETING ZONING AND PLANNING COMMISSION DECEMBER 2, 1982 The Zoning and Planning Commission of the City of West University Place convened in Special Meeting at the City Hall, Thursday, December 2, 1982, 7:30 p.m. with the following members present: Michael E. Casey, Chairman. Mr. Norton Mr. Abell Mr. Allen Mr. Bettler Mr. Casey opened the meeting stating that three things needed to be discussed and/or decided upon: 1) Discussion of rezoning of Application No. #82-7 2) Consideration for allowing a rehearing of application No. #82-6 3) Approving past minutes for year of 1982. Mr. Casey asked the members if they had any objections to discussing application No. #82-6 first. All members had no objections. Mr. Casey stated that the Zoning and Planning Commission had received a letter from Mr. Wade Kilpatrick, who has been retained by Mrs. Flynn to assist in securing approval by the City Zoning and Planning Coaaamission of the replat application No. 82-6. Along with the letter he enclosed a check for $50.00 and an application request for same. Mr. Casey presented members with a copy of a letter he had sent to Mr. Kilpatrick, Mr. David Allums was consulted before the letter was mailed. Mr. Casey stated in the letter that he would ask for a vote by the Commission members on Mr. Kilpatricks request for a rehearing. A lengthy discussion began concerning should/should not the Commission agree to allow a Public Rehearing of application No. #82-6. It was discussed that no new evidence had been submitted to support a rehearing, but the Commission would consider a rehearing due to the following reasons. 1) It would show that the Commission is open to discussion to consider allowing a Public Rehearing. 2) It would demonstrate the Commissions good faith in listening to the citizens of West University Place. 3) Some of the paperwork had been mishandled resulting in some confiasion concerning the Public Hearing held on August 12, 1982. More discussion followed. Mr. Abell asked about the application submitted to the Commission by Mr. Kilpatrick on behalf of Mrs. Flynn. Mr. Casey stated that Mr. Kilpatrick had submitted an application on a blank piece of paper which he had typed his own version of the City's form. The Citys rules and regulations which the City is authorized to have under the State Laws and Statues has not been followed, so the application was not recognized as a legal form and as such I returned his check along with the letter. More discussion followed. Mr. Norton moved to allow a Fublic Rehearing if the proper applications is submitte~ 1 5 to the Zoning and Planning Commission within the alloted thirty (30) day period. Mr. Bettler seconded the move. Voting Aye: Bettler Voting No: Abell Casey Norton Allen Next on the agenda were the past minutes to be discussed. APRIL 8, 1982 1) Delete the seventh paragraph, page one Mr. Allen moved to approve the April 8, 1982 minutes with amended correction made. (~ Mr. Norton seconded. Voting Aye: Casey Voting No: 0 Norton Q Bettler Abell Allen APRIL 15, 1982 1) Change paragraph seven to show that Mr. Norton moved to adjourn the meeting. Mr. Abell moved to approve the April 15, 1982 minutes with amended correction made. Mr. Norton seconded the move. Voting Aye: Casey Voting No: 0 Norton Bettler Abell Allen MAY 13, 1982 Show Mr. Allen present at Zoning and Planning Commission Meeting. Mr. Norton moved to approve the May 13, 1982 minutes with amended correction made, Mr. Allen seconded the move.. Voting Aye: Casey Voting No: 0 Norton Bettler Allen Abell MAY 20, 1982 Mr. Abell moved to approve the May 20, 1982 minutes as read. Mr. Norton seconded the move, Voting Aye: CASEY Voting No: 0 Norton Bettler Allen Abell ii~~ 1 JUNE 17, 1982 1) Add additional comments concerning application from ,Tames 0. Choate and Evin Thayer to subdivide: Lot 12, Block 12 West University Place 1st 6445 Buffalo Speedway The Commission members discussed at length the benefits to the City and what problems there was for the citizens of West University Place in this regard and how a subdivision would adversely effect the City in terms of health, welfare, property values, etc....., Mr. Norton moved to approve the June 17, Mr. Abell seconded the move. Voting Aye: Casey Norton Bettler Abell Q Allen Q AUGUST 12, 1982 1 11'7 1982 minutes as amended with corrections made. Voting No: 0 1) Concerning Application #82-6, add Commission members discussed the effects to the City, in particular the health, welfare, flood problems, sanitation problems, sewer problems and property values pertaining to 6422 Brompton, Voting Aye: Casey Voting No: 0 Norton Bettler Abell A11en 2) Delete paragraph eight on page two. 3) Show voting concerning application of Lot 12, Block 37, West University Place 1st. 6634 Mercer. Voting Aye: Abell Voting No: Casey Allen Bettler Norton Commission members discussed the effects to the City, in particular the health, welfare, flood problems, sanitation problems, sewer problems and property values pertaining to 6633 Mercer. Mr. Allen moved to approve the August 12, Mr, Norton seconded the move. Voting Aye: Casey Norton Abell Alien Better 1982 minutes with amended corrections made. Voting No: 0 SEPTEMBER 16. 182 1) Change paragraph nine to questioned "Commission members". 2) Commission members discussed that all the property was included in the Public Hearing concerning 1Nroxton between Kirby and Wakeforest with the exception of that ~_~8 i 119 Q which was already rezoned for commercial, just West of Kirby. 3) Delete "he-was more or less" 4) Paragraph nine, page three, "the Commission Board may need to get more information from the City Public Works Department". Mr. Allen moved to approve the September made. Mr. Abell seconded the move. Voting Aye: Casey Norton Bettler Abell Allen 16, 1982 minutes with amended corrections Voting No: 0 NOVEMBER 18. 1982 1) Show Mr. Bettler absent from meeting. 2) Page two, "The Zoning and Planning Commission began the discussion on application No. 82-7. This application was previously expanded and reflect same in the September 16, 1982 minutes. 3) Page three, Motion by Mr. Norton ---- change to: Mr. Norton made a motion to deny application No. 82-9 due to the fact that it was not applicable to the parking requirements of the City of West University Place Townhome Ordinance No. #1025. Mr. Norton moved to approve the minutes of November 18, 1982 with amended corrections made. Mr. Abell seconded the move. Voting Aye: Casey Voting No: 0 Norton Abell Bettler Allen The Zoning and Planning Commission betan discussion on the rezoning on Wroxton at 9:00 p.m. Mr. Allen left the meeting at 9:50 p.m. After a lengthy discussion: Mr. Norton moved to adjourn the meeting at 11:32 p.m. Mr. Bettler seconded the move.
