REGULAR MEETING
ZONING & PLANNING COMMISSION
SEPTEMBER 14; 1983

The Zoning and Planning Commission of the City of West University Place -
convened in regular session, Wednesday, September 14, 1983: at 7:30 p.m.,
with the following members present: Chairman Kendrick; presiding Members
Bettler, Norton, 0'Leary and Taitte.
Chairman Kendrick introduced himself and gave his address in the City,
followed by other members, ascertained~from the secretary that Notice
of Meeting had been posted in:'City Hall on September 12, 1983.
Hearing of Residents: Ms. Joan McKay suggested that in Legal Notices
the street address~be included after the legal description of property in
question. ~ ~ -
The Zoning and Planning Commission have been asked to review Ordinance ~Ei204,
which was passed changing definitions. Specific items were not included in
Ordinance 4~1204 that were in the original ordinance. The Board members
have been asked to discuss possible changes for modification.
Section 2(33); PROPOSED ZONING AMENDMENTS DATED 1981
Non-living area: As it relates to accessory buildings, non-living
area shall be defined as areas not to be used for sleeping, bathing,
cooking, or other activities and functions normally performed in
the primary building on the lot. As it relates to the primary or
main use building, non-living area shall be defined as any kitchen,
bathroom, foyer, hallway, stairway, or other utility space.
Members of the Zoning and Planning Commission discussed the use of accessory
builings i.e. rooms above or attached to garages.
Motion by Mrs. Taitte, seconded by Mr. 0'Leary that a policy concerning
enforcement of the single family zoning be requested from the'_-City Council.

Section 24 (1) 3rd Paragraph; PROPOSED ZONING AMENDMENTS DATED 1981
Which reads, "The front yard may be occupied by porous material not to exceed
the established grade at the street lot line or the average natural ground
level of the lot, provided that a minimum of twenty-five percent (25%) of
the front yard remains open space, be eliminated.

Section 26 (3); PROPOSED ZONING AMENDMENTS DATED 1981
Side and Rear Yards: The space is a side or rear yard shall be open-~and
unobstructed except for the ordinar.y projection of window sills, belt courses,
cornices, eaves and other ornamental features not to exceed fifteen (15")
inches.

Side and Rear Yards: The space is a side or rear yard shall be open and
unobstructed except for the ordinary pr.ojectio~ of window sills, belt
courses, cornices, eaves and other ornamental features not to exceed
fifteen (15'') inches. * Except accessory buildings may occupy up to a-~
maximum of forty (40%) percent of the rear yard to a maximum height of
twenty-five '(25') feet.

be made.

Forms and Procedures were reviewed by the Board members with changes to be
made.
There were discussion pertaining to if twenty (20%) percent of residence
opposed in writing of subdividing a piece of property, the twenty percent
would be sufficient basis for the Commission to deny application, but that if
the proponent should come before the Commission at anytime thereafter with
66 2/3 in favor, we would at that time re-consider the application.
The chairperson,of the Comprehensive Plan and Future Land Use Plan
subcommittees presented a progress report of their findings. After the
reports were given, recommendations for further review and study were made.
Minutes of the following meetings of the Zoning and Planning Commission
were approved as submitted:
Regular Meeting - March 10, 1983
Emergency Meeting - August 23, 1983
Regular Meeting - August 11, 1983

Chairmari Kendrick stated that the City Attorney, Mr. David Allums will ineet
with the Board members to discuss the new Subdivision Ordinance ~~1212.
With no further business to come before the Commission, upon motion duly
made, seconded and carried, the meeting adjourned at 11:30 p.~n.
