REGULAR MEETING
ZONING AND PLANNING COMMISSION
CITY OF WEST UNIVERSITY PLACE
DATE: NOVEMBER,12, 1987
7:30 P.M.
The Zoning and Planning Commission of the City of West
University Place, Texas convened in regular-special session
in the City Counsel Chambers, City Hall, 3800 University
Boulevard, Houston, Texas. The second Thursday of November,
being November 12, 1987.
Members present were:

Notice of ineeting was posted in the City Hall of West
University Place, Texas at least seventy-two (72) hours
preceding the day of the meeting as required by law.
A quorum was declared and the meeting convened.
1. Hearing of Residents:
a. No residents wished to be heard.
2. Procedural Matters:
a. Adoption of Rules of Procedure:
The Commission reviewed the Rules of Procedure
that the Zoning and Planning Commission
adopted and were used by the 1985-87 Zoning
and Planning Commission and which had
previously been circulated to all members.
The prior Rules of Procedure were modified to
update references to.State law, to allow any
two offices to be he'ld by one person, and to
add a new Article X dealing with the form of
agenda and a new Article XI validating actions

• taken. On Motion by Mr. Lindsey, seconded by
Mr. Rachlin, the Rules of Procedure, as
amended, were unanimously adopted. A copy of
the Rules of Procedure is attached.
b. Election of Officers:
The following Officers were elected
unanimously:
Reid Wilson, Chairman and Secretary
George Ruhlen, Vice Chairman
Frank Billings, Parliamentarian
3. Zoninq Matters:
a. Request for rezoning:
Rezoning Request 87-1, The West University
Baptist Church for rezoning of Lots 10 and 11,
Block 15, College of University, Section 3
from single family to Church parking lot was
heard. Mr. Roy Harper, AIA, agent for west
University Baptist Church explained that the
two adjacent lots, located at 3804 and 3808
Milton Street, adjacent to the Harris County
• Library and across from the West University
Baptist Church, have been owned and used by
the Church for many years. Due to the
Church's popularity, parking during Chruch
functions have become a problem with overflow
parking on adjacent single family streets.
The Church wishes to alleviate this problem by
removing the presently existing single family
structures from the Lots and paving them for
parking purposes.
After discussion, the Commission recommended
that Mr. Harper make an application for a
special exception under the new Zoning
Ordinance which became effective October 12,
1987, subsequent to the September 24, 1987
filing of the rezoning application. Mr.
Harper was referred to Section 7-100(b)(2)
which provides that the Zoning Board of
Adjustment may issue a special exception for
church uses within any single family district.
The Commission requested that the City apply
the filing fee received from the Church to the
filing fee for the special exception.

• b. Long Range Planning Committee zoning matters:
Chairman Wilson discussed the history of the
boundaries of the various zoning districts in
the City and reviewed the current zoning map.
Particular attention was given to several
areas of concern, including the area around
JMH No. 3, the western end of the Bellaire
Townhouse PDD, and the northern end of the
Kirby Drive Townhouse PDD, as well as the
partial commercial zoning of certain lots on
Lake Street. The Commission discussed the
existence of commercial structures in the
Kirby Drive Townhouse PDD, the construction of
a townhouse project fronting Bellaire
Boulevard, but outside the Bellaire Townhouse
PDD, and the single family character of Milton
Street and other streets surrounding JMH No.
3.
The Commission agreed it should move forward
expeditiously to clarify, unify and correct
the boundaries of various districts in the
City so as to carry forward the intent of the
City's original zoning legislation and to
• protect the single family character of the
City. The Commissioners agreed to physically
inspect the areas discussed so that concrete
recommendations could be made at the December
meeting. Copies of the current zoning map
were distributed to all members.
3. Other Matters:
a. Tree Rules:
The Commission discussed proposed tree rules
circulated among the members and which were
derived from the tree rules adopted by the
1985-87 under the new Commercial Zoning
Ordinance. The Commission deleted Hackberry,
Palms and Waxleaf Ligustrum from the list of
qualified trees, reduced the size of a
qualified tree in a single family residential
district to a 2" caliper, deferred to the
existing City Ordinances on street inter-
section visibility, removed any restrictions
regarding the size of trees planted in the
street right of~ way~ and removed the City
maintenance provision for trees from the
single family zoning district. Upon motion by

• Robert Lindsey, seconded by Susan Rachlin, the
Tree Rules, as amended, were adopted. A copy
of the Tree Rules is attached.
The Commissioners agreed to ask a landscape .
architect or forester to speak to the -
Commission regarding the species of trees
selected so that no acceptable species would
be eliminated. Commissioner Wilson agreed to
obtain a copy of the City's current ordinance
regarding street intersections and visibility.
