• GENERAL APPEALS BOARD
MONDAY, JUNE 12, 1989
MUNICIPAL BUILDING
3800 UNIVERSITY BOULEVARD
6:30 P.M.
General Appeals Board convened in regular session in the Municipal
Building, 3800 University Boulevard, in the City of West University
Place, on Monday, June 12, 1989, with the following members present:
Philip C. Lewis, Nicholas J. Aschliman and Sharon Mathews. Also
present was Wayne Perry, Chief Building Official.
Mr. Lewis called the meeting of the General Appeals Board to order.
Members of the Board were introduced and purpose of the newly appointed
Board was explained.
Election of officers was postponed until all Board members are present.
COMMENTS OF CONCERNED RESIDENTS
There were none present who wished to speak.
CONSIDERATION OF FENCE REQUEST, 3203 CASON
• Mr. Jacobs, owner; John Howard, attorney; and Mark Shipley
architect, were introduced and sworn in by Mr. Lewis.
Complete plans were presented by Mr. Shipley indicating area
where a 8' - 0" tall masonry fence along the Buffalo Speedway
property line would be constructed and asked for variance.
Acting Chairman Lewis with consent of other board members changed
the request from a variance to an interpretation.
Wayne Perry, Chief Building Inspector, explained to the Board that
this particular property was a subdivided lot. A previous owner
had complained to City Council about a fence being erected on the
corner lot as it would cut off his view down the street and
concern was expressed about the fence coming to the property
line. Due to this incident, the requirement is that the fence
would be allowed to come out within 5 feet of the street side
property line if letters of permission were received from
residents within 200 feet.
Mr. Lewis made motion that the section of the subdivision
ordinance does not apply to this set of circumstances. Mr.
Aschliman seconded the motion.

• CONSIDERATION OF RETAINING WALL REQUEST AT 2640 ARBUCKLE
John and Sue Porretto were sworn in by Mr. Lewis.
Mr. Porretto stated he was the owner and also acted as the
general contractor of the project. A garden/landscaping element,
retaining wall, which holds in the soil and plants has been
constructed in the front yard. His request was for an
interpretation of the Code that deals with retaining walls. He
further explained that 1) the city inspector whose advise had been
followed advised it was fine to proceed, 2) the air conditioning
water lines are located in front of the 10 foot area from the
house so that moving the retaining wall back 2 feet would create
problems for the closed loop air conditioning system, 3) the
retaining wall is holding landscaping fill and plants, 4) there
would be considerable financial expense to alter the landscaped
site, and 5) the garden wall enhances the property and the
neighborhood.
Wayne Perry, Chief Building Inspector, stated it was first brought
to his attention as a porch, but after review he felt it would
come under the classification of a low retaining wall under the
fence ordinance.
• Mr. Lewis clarified the fact that there would be no modification
made of the area to make it a porch.
Mr. Lewis made motion to accept this as a retaining wall/flower
bed and not as a porch. Seconded by Mr. Aschliman.
