• GENERAL APPEALS BOARD
SPECIAL SESSION
MONDAY, JULY 24, 1989
MUNICIPAL BUILDING
3800 UNIVERSITY BLVD.
6:30 P.M.
General Appeals Board convened in special session in the Municipal
Building, 3800 University Boulevard, in the City of West University
Place, on Monday, July 24, 1989, with the following members present:
Philip C. Lewis, John M. Farrell, Nicholas J. Aschliman, and Sharon
Mathews. Also present were Curtis R. Cooper, Director of Operations;
and Wayne E. Perry, Chief Building Inspector.
Mr. Lewis called the Special Session of the General Appeals Board to
order.
COMMENTS OF CONCERNED RESIDENTS
There were none present who wished to speak.
ELECTION OF OFFICERS
Mr. Cooper made the motion that Philip C. Lewis be appointed
President; John M. Farrell be appointed Vice President; Curtis
R. Cooper be appointed Ex Officio Member; Nicholas J.
• Aschliman and Sharon Mathews be appointed as alternates. Mr.
Lewis seconded the motion.
Voting Aye: All
Voting No: None
Absent: None
CONSIDERATION OF 2907 QUENBY, DANGEROUS BUILDING
Mr. Perry stated the inspection division started working on this
case in April of 1987 with the health inspector. In January of
1988 another letter was written in reference to violations. In
May 1989 complaints were received from neighbors. On May 26,
1989, a Notice of Violation was given asking that the following
violations be corrected before June 14, 1989:
1) Building in need of repair, and
2) Area must be cleaned up.
Also there was a Violat~on Notice given by the animal control
officer in reference to having excessive number of cats.
The conditions which cause such buildings to be dangerous are
described as follows:
1) Roof in deteriorated condition,
• 2) Exterior is badly in need of repair and painting,
3) Window frames are deteriorating, and
4) Garage structure and roof are in very bad condition; roof
is deteriorated and probably leaking.

Options were given 1) Repair such building so that the conditions
causing them to be dangerous are completely corrected on or before
the 60th day following the date this order becomes effective,
or 2 Demolish such buildings on or before the 90th day
following the date this order becomes effective. As of this date,
July 24, 1989, there has been no appreciable effort to repair or
clean the area.
Curtis Cooper made the motion to 1) check with the city attorney
in reference to procedure, 2) check with city attorney in
reference to getting permission to view inside of the house, and
3) check into the homestead. Mr. Farrell seconded the motion.

This item is to be researched and postponed until next meeting.
CONSIDERATION OF 3809 SOUTHWESTERN, FENCE
Mr. Leonard David Reiner, 3809 Southwestern, and Mr. Wayne Perry
were sworn in by Mr. Philip Lewis.
• Wayne Perry, Chief Building Inspector, explained to the General
Appeals Board that the fence constructed of brick is on the rear
property line which is located on the utility easement in which
there are utilities, water and sewer.
Mr. Reiner stated the fence had been built in June of 1989 and
is a 5-1/2 foot brick wall around both sides and back of his
property. This brick fence replaced a wooden fence built by the
contractor. He also stated that a permit had not been granted for
this work. Mr. Reiner advised that Councilmember Jenkins had
been out to look at his fence and had told him that in about four
to five years all the water and sewer lines in the back would be
abandoned. Mr. Cooper explained that this would be the last
priority area to be done by the City provided additional bonds are
passed. Mr. Reiner said that he would get a letter from his
lawyer stating that anytime the fence needs to come down the City
would have the right to do so.
Mr. Farrell made the motion that Mr. Reiner remove the masonry
fence that runs along the property line in the easement on the
rear of his property and replace it with a conforming fence or no
fence. Mr. Cooper seconded the motion.

• It was decided that 90 days would be given Mr. Reiner to remove the
fence and report back to Mr. Perry.

Motion was made by Mr. Lewis, seconded by Mr. Farrell that the
meeting be adjourned.
