The General Appeals Board convened in regular session in the Municipal Building, 3800 University Boulevard, in the City of West University Place, on Monday, February 12, 1990, with the following members present: Philip C. Lewis, John M. Farrell and Sharon Mathews. Also present were Wayne Perry, Chief Building Official and Cecil Boles, Assistant Building Official. Mr. Lewis called the regular meeting of the General Appeals Board to order. COMMENTS OF CONCERNED RESIDENTS: Mr. Lewis invited residents to speak who had matters they wished to bring to the attention of the General Appeals Board. There were none present who wished to speak. CONSIDERATION OF 6602 RUTGERS: Margaret Williamson appeared ~ before the General Appeals Board requesting to extend the height of fence on the South side of property or build a new fence to the height of the back fence for the following reasons: 1) to screen back yard, 2) to have something nice to look upon and 3) to keep cat enclosed. Mr. Perry, Chief Building Official, explained to the Board the side yard butts up against a porte cache and under the terms of the fence ordinance if the fence is within six feet of a neighboring house you can only have a six foot fence. The house structure is within three feet of the side property line. Mrs. Williamson presented drawings in reference to adding on to the fence that is the neighbor's fence or build chain link fence back to back to the neighbor's fence. Motion was made by Sharon Mathews, seconded by John Farrell, to grant an interpretation to allow Mrs. Williamson to build an eight foot metal fence on portion between her back fence and the rear part of her house to a maximum height of eight feet. Voting Aye: Philip Lewis, John Farrell, Sharon Mathews Voting No: None Absent: None ~ CONSIDERATION OF 3737 NOTTINGHAM: Mr. and Mrs. James J. Tobin with builder John St. John came before the General Appeals Board to ask for a variance in reference to a front stair rail that was _ General Appeals Board Minutes, February 12, 1990 • approximately two inches lower than current Code as measured from the front bullnose of the stairway tread. Mr. Perry informed the Board that 3737 Nottingham is a new house in final stages of construction. The plans came through showing that the hand rail on the stairway was to be between the required 34 inches - 38 inches in height from the leading edge of the step, up to the top of the hand rail. At the final stages, inspections found the top of the hand rail to be only 32 inches above the leading edge of the step. Mr. Tobin presented graphs to the Board stating they are pleased with the stairway and have no desire to have it changed as they believe it will not be as strong when reconstructed; concern over possible construction conditions which could cause harm to a new baby in the home; that it would be a great hardship at this point and time. Mr. Lewis asked for a motion to grant a variance on the basis of which the Board is allowed to grant a variance. As there was not a motion, request was denied by the Board. A time frame of six months was given for correction. CONSIDERATION OF 3112 AMHERST: An inspection report was received from Mr. Hollis in reference to a termite inspection being made and rodent treatment being performed by Texas Termite and Pest Control. The report showed there was no evidence of rat infestation, but . treatment was performed nevertheless.
