Beginning at 6:30 p.m. in the Bill Watson Conference Room of the Municipal Building, 3800 University Boulevard, West University Piace, Texas The subject(s) of the meeting are as follows: (Call to orderJ Notices, Rules, Etc. Matters relating to notices, rules and meeting procedures, identifying parties, swearing of witnesses, etc. 2. Docket No. 05-02, House at 3027 Quenby (Special Exceptions) a. Public hearing regarding the following matters: (1) Certuin Yard Encroachment. Matters relating to the property owner's request for a special exception to grant PNC status for side yard encroachment of structure. (2) Modest Extension/enlargement. Matters relating to the property owner's request for a special exception to allow for a modest extension/enlargement. (Allowance of 2.7 to 2.8 feet continuous for modified structure.) ~ b. Deliberation, decisions, other action, etc. regarding the preceding matters. 3. Docket No. 05-03, Church at 6218 Auden; 3821, 3831, 3835 & 3836 Amherst Street; 3804, 3810 Milton & Lots 11,13,14 & 15, block 15 College view, Section 3(Special Exceptions/Variances) . a. Public hearing regarding the following matters: (1) Church and ancillary uses. Matters relating to the trustee's request for a special exception to authorize the existing church and customary ancillary uses (which may include day care, gymnasium, parking, etc.) in a single-family disfict ~ (2) PNC Status/Certain Yard Encroachnzent. Matters relating to the trustee's request to grant PNC status for yard encroachments (1G ft. side along Amherst, 5 ft. side next to City's water tank, and a 5 ft rear to grant PNC status for side yard encroachment of structure. (3) Yards/Setbacks. Matters relating to the trustee's request for variance(s) to allow: (i) a side yard setback of 16ft. along the south side of Lots 6, 7 and 8 in Block 19 (adjoining Amherst St.), (ii) a side yard setback of 5 ft along the north side of Lots 6, 7 and 8 in Block 19 (adjoining city water tank) and (iii) a 5 ft rear setback along the west side of Lot 6, Block 19 (adjacent to city shop building). (4) Principal Buildings/Height Maximum. Matters relating to the trustee's request for a variance to allow a building height of 43 ft. above base elevation (40' - 10" above finish floor). b. Deliberation, decisions, other action, etc. regarding the preceding matters. 4. Docket No. 05-04. New house at 3936 Marlowe (Appeals/Variance) a. Preliminary matters such as filing deadlines, hearing date, party status, etc., including • suspension of the rules. b. None of the decisions mentioned in this paragraph was appealed. Action Requested: Both Mr. Pohl and the owner/permittee request interpretations of the Zoning Ordinance. See above. Mr. Pohl requests that the building permit be rescinded and that the owner/permittee be required to "re-permit the work." The owner/permittee apparently requests that the building permit be reinstated (or perhaps un-suspended) and, if necessary, a variance be granted. Applicable Regulations: Applicable regulations include the City's Zoning Ordinance, Chapter 211 of the Texas Local Government Code and the rules of the ZBA.
