Applicant's Request The applicant in Docket #2023-0010 — 3307 Sunset Boulevard, requests that the Zoning Board of Adjustment(the "ZBA") approve a special exception as allowed by Appendix A—Section 7-101, Table 7-1,Note 2,to allow the construction of a sports court on a residential building site where there is neither a currently existing nor a proposed principal structure on the building site. Background Information The applicants have recently acquired the lot contiguous to the rear of their current home and are seeking approval from the ZBA to construct a sports court on a building site where there is neither an existing nor a proposed principal structure. The applicants have expressed a desire to refrain from combining the two building sites to preserve the option of constructing a new home on the newly acquired lot at a later date. Combining the two building sites would render them ineligible for re-division, as they would no longer meet the minimum building site dimensions stipulated by Article 5,Table 5-1. Sec. 7-101.—Table 7-1, Note 2. Private Green Space. Vineyards, gardens, landscaping, private playgrounds and other similar uses that are predominantly pervious, vegetated and non-commercial are allowed in all districts. Unless otherwise authorized by a special exception, the only structures allowed are fences, playground equipment and landscaping structures (e.g., low, retaining walls, borders, etc.). The ZBA may issue a special exception to authorize other structures. The special exception shall include a site plan specifying and limiting allowable structures. If so ordered by the ZBA, the site plan controls over any other ordinance to the contrary. However, the site plan may not specify yards (or "setbacks") different from those otherwise required, unless the ZBA finds that the different yards are: (i) necessary for efficient use of the available space and (ii) compatible with nearby sites and their uses. Within a Private Green Space the only structures specifically permitted are fences, playground equipment, and landscaping structures, however, Note 2 authorizes the ZBA to issue a special exception to allow other structures that are not specifically referenced. Additionally, the special exception may allow such structures to be constructed without a principal building. If the ZBA determines that a sport court is a permissible Private Green Space structure and is deemed to be compatible with surrounding residential uses, the ZBA may only issue the special exception for the construction of a sports court if it finds that all the following circumstances are present: (1) The request is in harmony with the general purpose and intent of the Zoning Ordinance (2) The request will not cause any significant increase in on-street parking or traffic, traffic congestion or an unreasonable burden upon public utilities or services. (3) The ZBA has made any additional findings and determinations required by a specific provision of this section. (4) The special exception has been reduced to writing and includes any conditions prescribed by the ZBA or required by this section for the special exception in question. Narrative for Special Exemption Request re: Bacon Family To the Zoning Board of Adjustment of the City of West University Place, Texas, We live at 3304 Nottingham St. in West University (the "House") and recently purchased 3307 Sunset Blvd. (the "Lot"),behind our House. We are requesting a Special Exemption as permitted by Table 7-1,Note 2, in Appendix A of the Code of Ordinances of the City of West University (the "Code") in order to build a sports court on the backyard Lot for our two young boys without combining building sites in order to preserve the ability to build a residence on the Lot for a relative in the future. In October of 2022, we were fortunate to purchase the Lot from our backyard neighbor. Our House is an L shape, and the Lot largely lines up with our existing backyard. We decided to purchase the Lot for two reasons: (1) to have a bigger yard for our young boys (currently ages 11 and 8) to enjoy playing their sports, in particular basketball, and (2)to have the option of one day building a residence for a relative in the future. As presented in the site plan, we engaged Joby Bonnot of J Branch Landscaping to beautify the Lot, both inside and outside the fence, and make it more useable for our family. As part of that process, we would like to install a concrete sports court that is approximately 31' by 38', smaller than an actual half court. It would be approximately 9 ft from either neighboring fence. The sports court would be located on the back of the Lot, closest to our House. It would not cross building site lines. We intend to install a high quality hoop that can be raised and lowered, and if needed and possible, add a net behind the hoop to catch stray balls. The plan also includes planting holly trees along both neighboring fences to diminish sound and increase privacy. Unfortunately, if we combine building sites, the Lot loses its grandfathered status with respect to building site dimensions specified in Article 5 of the Code. Currently, the Lot is 7500 sq ft, like many of the building sites on that stretch of Sunset Blvd. If we lose grandfather status, we lose the ability to build a residence on the Lot for a family member in the future. This option is incredibly important to us, and why we are requesting a Special Exemption.
