REGULAR MEETING OF ZONING BOARD OF ADJUSTMENT
August 25,1977
The Zoning Board of Adjustment convened in regular session at the City Hall
on Thursday, August 25, 1977, 7:30 p.m., with the following members present:
Chairman Casey, presiding.; members Ayres, Billings and Wilkins. Alternate.
member Doughty had been designated. to sit as a member in the absence of Mr.
Bob Johnson. Alternate member Frank Burge was absent.
Mr. Casey requested that the Board Secretary read the Notice of Public Hear-

Motion by Mr. Wilkins, seconded by Mr. Doughty, that the Public Hearing was
now open to consider an application Docketed 77-7, filed by Mr. Winfield M.
Cq Campbell, for permission to construct a carport with an elevated deck at
~ his residence at 6135 Fordham.~

Mr. Casey ascertained from. the secretary that Notice of Public Hearing had
been published in the Southwestern Argus on Wednesday, August 10, 1977, and
that notice was mailed to all property owners within a 200' radius of the
property on August 15, 1977. In accordance with the provisions of Article
6252-17 V.A.T.C.S. notice was posted on the City Hall bulletin board on
Monday, August 22, 1977.
Mr. Casey administered the Oath to Building Inspector Wayne Perry and Mr.
Winfield Campbell.
Mr. Campbell presented plans for proposed remodeling of an existing two-story
garage explaining that the lower portion of the garage would be used as a den,
family room area and that an elevated deck would be built above a carport over
the existing driveway to provide usable space. Inasmuch as Mr. Campbell was
not certain of the provisions of the Zoning Ordinance he would be violating,
Chairman Casey stated that the usual procedure would be changed to permit Build-
ing Inspector Wayne Perry to present the violations..
Mr. Perry stated that Mr. Campbell's application comprised two violations of the
Zoning Ordinance inasmuch as his residence .was located on a corner lot and the
proposed carport would be on a side street, such carport could not be located
within ten (10) feet of .the side street property line and the construction of
the carport would be in violation of a requirement that there must be a 60%
open area in the rear 20' from the property line.
In response to a question regarding his plans, provided his application for an
exception was denied by the Board, Mr. Campbell advised that he would continue
his remodeling program without the addition of the carport to protect his cars.
Mr. Casey presented the following correspondence that had been received regard-

ing Mr. Campbell's application.
The Campbell's. have our vote of approval to carry out their plans for
renovation of their property.

Gentlemen, regarding the request for exception filed by Mr. Winfield
Campbell, 6315 Fordham, West University Place, Texas.
As the immediate next door neighbor of Mr. Winfield Campbell, my wife
and myself are more than casually interested in the development and im-
provements which go on at his-home as well as those of others in the
immediate area of our home. I have reviewed the design and drawings
of the project which Mr. Campbell proposes to build at this residence
and both my wife and myself feel as though this project is an extremely
worthwhile effort, not only to the benefit. of Mr. and P1rs. Campbell as
home owners but also to the other residents of our immediate area and
the balance of the City of West University.
Activity of this nature in and around our city would certainly benefit
the entire community of West University. We both heartily endorse your
authorization of his request for exception on the elevated deck for the
residence located at 6135 Fordham.

We are familiar with the plans that William and Lynn .Campbell have
concerning the remodeling of their home at 6135 Fordham. We believe
that the plans are well thought out, and will enhance the value of
their property and that of the neighborhood. Everything .that we
have observed indicates that the improvements will be in keeping
with the building style commonly used in remodeling homes in blest
University.
I do not believe. that the proposed deck will cover so much of the.
property or any section of it to create any problem. The Campbells
have our support and we are sure they will enjoy their remodeled home.

Mr. Perry advised the Board that Mr. Campbell had executed an Affidavit stat-
ing that the existing garage apartment would not be rented or used for any
type commercial project.

Members of the Board reviewed Mr. Campbell's application giving consideration
as to whether the request was for an exception or a variance; the two viola-
tions that were involved in the proposed. construction; and whether the 40%
coverage of the rear yard meant from the rear of the residence or 40% of
the rear 20' from the property. l i me..
Motion by Mr. Billings, seconded by Mr. Ayres, that even though the applica-
tion. docketed 77-7 was couched in terms of a special. exception, it is in the
opinion of the Board a request fora variance, and was considered by the Board
as a variance, and inasmuch as the applicant had not shown that literal enforce-
ment would result in unnecessary hardship, that the application be denied.

Minutes of the regular meeting of the Zoning Board of Adjustment on Thursday,
July 21st were presented and the following action taken: Motion by Mr. Wilkins,
seconded by Mr. Ayres, that minutes of the regular meeting of the Zoning Board
of Adjustment on July 21, 1977, be approved as submitted.

With no further business to come before the Board at this time, upon motion
duly made, seconded and carried the meeting adjourned at 9:15 p.m.
