REGULAR MEETING OF ZONING BOARD OF ADJUSTMENT
JUNE I6, I977
The Zoning Board of Adjustment convened in regular session on Thursday,
June 16, 1977, 7:30 p.m., with the following members present: Chairman
Mike Casey, presiding; members Ayres, Billings and Wilkins. Member Bob
Johnson was absent, as were alternate members Burge and Doughty.
Mr. Casey requested that the Board Secretary read the Notice of Public Hear-
ing.
Motion by Mr. Wilkins, seconded by Mr. Ayres, that the public hearing was
~tiw open to consider an application Docketed 77-5, filed by Ms. A. W. Tullos,
4138 Amherst, for permission to let remain a screen of spaced cedar which had
been constructed to shield bedroom windows on the front of the house.

Mr. Casey ascertained from the secretary that Notice of Public Hearing had
been published in the Southwestern Argos on Wednesday, June 1, 1977, and
that notice was mailed to a1I property owners within a 200' radius of the
property on May 31, 1977. In accordance with the provisions of Article
6252-17 V.A.T.C.S. notice was posted on the City Hall bulletin board on
June 14, 1977.
Mr. Casey administered the Oath to Assistant Building Inspector Wayne Perry.
Inasmuch as Ms. Tullos was not in attendance at the meeting to present her
request, Mr. Casey requested that Mr. Perry present the violation of the
Zoning Ordinance requiring that a request for a building permit be denied.
Mr. Perry advised that the screen constructed of spaced cedar was located
in front of Ms. Tullos' residence and at this time was more or less a free
standing fence which was prohibited under the fence ordinance, and if at-
tached to the residence, as shown in a drawing submitted by Ms. Tullos,
the structure would be in violation of a provision of Section 23(1) of the
Zoning Ordinance which states, "However, if twenty-five per cent (250) of a
block frontage is improved with buildings the front yard shall extend to
the alignment of such existing buildings, but in no case shall the depth
of such front yard be less than twenty (20) feet.
Motion by Mr. Billings, seconded by Mr. Wilkins, that the Public Hearing
be closed.

Motion by Mr. Billings, seconded by Mr. Wilkins, that Appeal No. 77-5 be denied
inasmuch as no evidence had been submitted to show that literal enforcement
would result in unnecessary hardship.

Mr. Casey noted that Building Inspector J. D. Allston was retiring from
service with the city and that he had been of great service to the Board
and would be missed.. It was the decision of the Board that a Resolution
'~ be prepared and presented to Mr. Allston at his retirement reception on

~ Minutes of the regular meeting of the Zoning Board of Adjustment. on Thursday,
~ May 19, 1977, were presented for consideration and the following action taken:
Motion by Mr. Ayres, seconded by Mr. Wilkins, that minutes of the regular
meeting of the Zoning Board of Adjustment on Thursday, May 19, 1977, be
approved as submined.

With no further business to come before the Board at this time, upon motion
duly made, seconded and carried, the meeting adjourned at 8:15 p.m.
