HomeMy WebLinkAbout02241977 ZBA Minutes REGULAR MEETING OF ZONING BOARD OF ADJUSTMENT Februa~ 24, 1977 The Zoning Board of Adjustment convened in regular session at the City Hall on Thursday, February 24,.1977 , 7:30 p.m., with the following members present: Chairman Casey, presiding; members Ayres, Billings and Johnson. Alternate mem- ber Doughty was also present and had been designated to sit as a member in the absence of Mr. Johnson. Alternate member Burge was absent, Mr. Casey requested that the Board Secretary read the Notice of Public Hearing. Motion by Mr. Ayres, seconded by Mr. Dought~ that the public hearing was no ~ open to consider application Docketed 77 1, Bled by Mrs. Irene Oliver, 3323 ~ Cason,. for permission to enclose a portion of an existing front porch with glass. ~ Voting Aye.: Ayres Voting No: None Billings Casey Doughty Johnson Chairman Casey ascertained from the secretary that Notice of Public Hearing had been published in the Southwestern Argus on Wednesday, February $, 1977, and that notice was mailed to all property owners within a 200' radius of the property in .question on February 1, 1977. In accordance with the provisions of Article 6252- 17 V.A.T.C.S. notice was posted on the City Hall bulletin board on September l3, 1977. Mr. Casey administered the Oath to Assistant Building Inspector Wayne Perry and Mrs. Irene Oliver, Mrs. Oliver presented members of the Board with a sketch she had prepared show- ing the approximate location of her home in regard to the house next door and houses fronting on Rutgers Street and on Westchester Street. Mrs. Oliver stated that she wanted the side portion of the porch glassed in so that it could be used for plants and as a place she could leave her painting easel without the bother of having to set it up when she was ready to paint, Mrs. Oliver stated that the front of the porch extended 42' into the front set- back line and she was of the opinion that the appearance of the house would be enhanced by enclosure of the entire area with glass rather than enclosing only that portion adjacent to the living room wall which would require no application to the Zoning Board of Adjustment.. In response to questions from members of the Board, Mrs. Oliver stated that it was her belief that the project would be cancelled if permission was not re- ceived from the Board to enclose the porch in the manner in which she desired. Mr. Casey read the following correspondence which had been received concerning Mrs. Oliver's application: "This is to acknowledge receipt of your letter advising that an application for a variance has been filed with the.. Zoning Board of Adjustment by Mrs. Irene B, Oliver at 3323 Cason. I am certain that Mrs. Oliver has good and justifyable reasons for wanting to enclose her front porch with glass. Utilization of the space with safety, to me, would be an excellent reason for this improvement, We have been neighbors to Mrs. Oliver for twelve years.. During this period Mrs. Oliver's property has been maintained in above average manner. I strongly recommend that an exception be made and Mrs. Oliver be granted a permit to procede with her improvements. Sincerely, P•1. E . Hines 3046 W. I do not plan to attend the meeting on February 24, 1977, .but I do wish to submit my ..view about the matter under _consideration, My vote is "Yes", as I think that my .neighbor, Mrs. Oliver, should be Qranted permission needed to make the enclosure of the existing front porch at her residence, and I sincerely hope that all others concerned will submit the -same answer." Second, it is in the best interest of the residents to make for them- selves a more secure place to live, It would certainly be much safer to sit on an enclosed porch than an open one in .such times as we live in. Enclosing porches should certainly be incouraged by all of the people desiring same, Third, we should be thankful that residents want to improve their homes, Fourth, I enthusiastically endorse approval to enclose this porch,"' Yours very truly, Justin G, Bradburn, Jr. 3412 Bellaire Boulevard "I see no reason not to grant her request; it would improve the property" Mrs. Paul D. Jones -6635 Westchester "I see no reason why enclosing the porch at Mrs. Oliver's could be offensive. The porch has existed for the 10 years I`ve lived across the street. Mrs. Oliver paints and enclosing the porch would give her better light and more room to pursue her hobby, She is one of our very active, delightful Senior Citizens who shares her talents and her interests with. her friends." Wendt ~ 6646 Westchester Assistant Building Inspector Wayne Perry adivsed the Board that the request for a permit to enclose the porch had been denied because it extended five (5') feet into the front setback line which is in violation of the zoning ordinance. Motion by Mr. Ayres, seconded by Mr. Johnson, that the Public Hearing be closed. Voting Aye: Ayres Voting No: None Billings Casey Doughty Johnson Discussion of the application for enclosure of an existing porch at .3323 in- dicated that the roof-line or foundation of the house will not be involved in the enclosure, and that the front entryway into the house would remain as it is. Motion by Mr. Johnson, seconded by Mr. Ayres, that the application filed by Mrs. Irene Oliver, 3323 Cason Street, and docketed #77-1 fora variance to per- mit the enclosure with glass of an existing porch, be approved. Voting Aye: Ayres Voting No: None Billings Casey Doughty Johnson Minutes of meetings of the Zoning Board of Adjustment on September 16, 1976, September 24, 1976, September 30, 1976 and November 18 ,1976 were submitted for consideration.
