REGULAR MEETING OF ZONING BOARD OF ADJUSTMENT
NOVEMBER 18, 1976
The Zoning Board of Adjustment convened in regular session at the City Hall
on-Thursday, November 18, 1976, 7:30 p.m,, with the following members present:
Vice-Chairman Wilkins, presiding; Members Ayres and Billings. Alternate mem-
ber Doughty was also present and designated to sit as a member in the absence
of Mr. Johnson. Alternate member,Burge was absent.
Mr. Wilkins introduced himself and identified his residence in the city fol-
~ lowed by each member of the Board.

~ Mr. Casey appeared at the meeting at this time and chaired the remainder of
'";) the meeting.
~ Motion by Mr. Wilkins, seconded by Mr. Doughty, that Public Hearing was now
open to consider application Docketed 76-13, filed by Mrs. Carla Derryberry,
6601 Brompton, for conversion of an existing garage into a third bedroom and
second bathroom.

Chairman Casey ascertained from the secretary that Notice of Public Hearing had
titan published in The Southwestern Argus on Wednesday, October 27, 1976 and
that notice was mailed to all property owners within a 200 ft. radius. of the
property in question on November 1, 1976. In accordance with the provisions of
Article 6252-17 V.A.T.C.S., notice was posted on the City Hall bulletin board
on November 15, 1976.
Mr. Casey administered the Oath to Building Inspector J. D. Allstott, Assistant
Building Inspector Wayne Perry and Mrs. Carla Derryberry and outlined the pro-
cedure to be followed during the Hearing..
Mrs. Derryberry presented architects plans for the conversion of the existing
garage into a bedroom and bathroom, noting that the garage was attached to the
house by the enclosure of a breezeway between the original house and garage. She
stated that she, her son and daughter lived at this address which is a two bedroom
house and that she made her bedroom in a narrow area connecting the house and
garage.
The Building Inspector stated that a permit had been denied for this construction
because it would be in violation of the Zoning Ordinance requiring that no
living space shall be constructed in the 20 ft, backyard area.
In answer to questions, the Building Inspector stated that it would be permissible
for construction to be made to the front of the house within setback requirements.
Mrs. Derryberry stated this manner of remodeling had not been pursued because of

the increased cost of new construction (outside walls) as opposed to finishing
of existing walls.
Chairman Casey read the following letter in regard to this application:
"I own the house at 6620 Brompton, but do not live in it. Sorry I
cannot attend meeting. However, I would have no objection to the
above stated improvement if all else is o.k.
Sincerely,
Mrs. J. L. Keeper"
Motion by Mr. Billings, seconded by Mr. Wilkins, that the Public Hearing
be closed.

Board members reviewed the plans and it was pointed out that the area which
could be constructed on the front of the house within the required setbacks
would only be 10 square feet smaller than the garage area requested in the
application.
Motion by Mr. Billings, seconded by Mr. Wilkins, that inasmuch as the applicant
failed to show a hardship which is one of the. elements required for a variance
that the application Docketed 76-13 be denied.

With no further business to come before the Board, upon motion duly made,
seconded and carried, the meeting adjourned at 8:20 p.m.
