SPECIAL MEETING OF ZONING BOARD OF ADJUSTMENT September 2~, 197b ~-.~ The Zoning Board of Adjustment convened in special session at the City Ffall on Friday, September 23, 1976, 5:30 p.m „ with the fol- lowing-.members present: Chairman Mike Casey, presiding; Members Bob Johnson and Richard Wilkins. Alternate members Dan Doughty and Frank Burge were also present and had been designated to sit as members in the absence. of John Ayres and Frank Billings. Chairman Casey read the following letter which had been received ..,~ from Mr, & Mrs. A. T. Barrett requesting a re-hearing on their d, application docketed 76-11 requesting permission to rebuild a ~ front porch and enclose it with glass. '°~ ~ Dear Sirs: Lm After receiving notice that our appeal for a variance had been denied because hardship was not shown we determined. that there were three facts that had not been brought out in the hearing. The first is that without permission to glass the front porch we will not be able to gain access to the playroom except by going thru the living room., study, and kitchen. We will pre- sent drawings showing that opening the stairwell to both the living room and playroom will present a definite safety haz- ard due to the shape and width of the steps. Two architects have been in our home, viewed the situation and could not find a way to safely gain access to the playroom by opening the stairwell on both sides. This we will demonstrate. Secondly.,- we feel that having access to the playroom only thru the kitchen is a hazard. If fire broke out in the kitchen there would be only one exit thru a window & windows are often dif- ficult for a child to open especially in an emergency. (All our windows except two were inadvertently painted shut so we do not feel they are reliable means of escape.) Also, we are planning to invest a large sum of money in the house and the value of the house will be considerably lowered by a poor traffic pattern. Thirdly, at the last hearing the intended depth of the porch was not adequately defined. We have established that it will be five feet, For these reasons we ask for a rehearing on the appeal for a variance. Sincerely, Mr. & Mrs. A. T. Barrett, III ~~ Motion by Mr. Wilkins, seconded by Mr, Doughty, that Mr. & Mrs. Barrett would present additional evidence and that a rehearing should be called, Voting Aye: Berge Voting No: None Casey Doughty Johnson Wilkins Mr. Billings arrived at the meeting at this time. Members of the. Board determined that provisions of Article 6252-17 V.A.T.C.S. requiring that notice of a meeting be posted on the City Hall bulletin; board could be met and the hearing held on Thursday, September 30, 1976, 7:30 p.m. With no further business to come before the Board at this time, .upon motion duly made, seconded and carried the meeting adjourned at 6:05 p.m. ~1 Chairma ATTEST: ~~~r~/ Secretary 1 1 1
