REGULAR MEETING OF ZONING BOARD OF ADJUSTMENT
FEBRUARY 26, 1976
The Zoning Board of Adjustment of the City of West University Place convened in
regular session at the City Hall on Thursday, February 26, 1976, 7:45 p.m.,-with
the following. members present: Chairman Casey, presiding; Member Ayres, Alternate
Members Burge and Doughty were designated to serve in the absence of Members Billings,
Johnson and Wilkins. Building Inspector J. D. Allstott and Assistant Building In-
spector Wayne Perry were also present.
Mr. Casey requested that the Board secretary read the Notice of Public Hearing.
~+ Motion by Mr. Ayres, seconded by Mr. Burge, that the Public Hearing was now open
?~ to consider application Docketed 76-1 requesting authorization to construct a
"'~ treated wood deck. extending from the rear and side of the residence and connecting
to the 6'0" high wood perimeter fencing, filed by William M. Burwell. ~,
Voting Aye: All .Voting No: .None
Mr. Burwell was not present at this time and the meeting recessed until Mr. Burwell
was contacted by telephone and appeared at the meeting..
Mr. Casey introduced himself and identified his residence in the city, followed by
each member of the Board.
Mr. Case ascertained from the secretar that Notice of Public Hearin was ublished

in the Southwestern Argus on Wednesday, February.. 71, 1'976, and notice was mailed to
all property owners within a 200' radius of thelproperty in question on February 9, 1976.'
Mr. Burwell presented a plat to the Board and explained that he desired to extend a
wood deck from the rear and side of the residence to the fence in order to utilize
the small area which. may or may not be servicabl'e. He advised that this deck was
not in the original plan submitted to the Inspection Department for permit to con-
struct the house.

Building Inspector J. D. Allstott advised the Board that the request for permit to
construct-the deck to extend to the fence was denied inasmuch as the Zoning Ordinance
required that there be no construction into the rear five (5') foot setback and the
side three (3') foot setback,
On .Questioning, Mr. Burwell stated the deck would. be roughly 62" to 8" in height.
Motion by Mr. Burge, seconded by Mr. Doughty, that he Public Hearing be closed.
Voting Aye: All
Voting No: None
Motion by Mr. Doughty, seconded by Mr, Burge, that the regular meeting of the Board
be opened.

A letter from Mr. John Yost, Vice-President, of Hamburgers by Gourmet, requesting
extension on the variance. granted by the Zoning Board of Adjustment on April 17, 1975,.
and extension of ninety (90) days granted September 18, 1975, was presented to the
Board for their consideration.

After reviewing previous action of the Board and discussion concerning in-
stallation of the precipitator, the following action was taken:
Motion by Mr. Ayres, seconded by Mr. Burge, that a second ninety (90) day
extension be granted Hamburgers by Gourmet, retroactive to January 18 , 1.9.76,
on the variance granted by the Zoning Board of Adjustment, subject to another
review at that time. to ascertain what action, if any, had been taken to improve
the property.
Voting Aye: All
Voting No: None
Motion by Mr. Burge to grant variance of application Docketed 76-1 to allow a
wood deck to extend into the setback and connect with rear and side fence.
Motion died for lack of a second.

Motion by Mr. Burge, seconded by Mr. Doughty, that application Docketed 76-1 re-
questing construction of a wood deck to extend into the rear and side setback and
connect with rear fence, filed by Wm. B. Burwell, be granted, provided that height
of deck not exceed eight (8'') inches above current grade and the bench shown on the
plat attached to the fence .not be a part of the structure.

Voting No: None
Minutes of the Zoning Board of Adjustment Recessed Meeting on January 8, 1976
were approved as submitted.
With no further business to come before the Board at this time, upon motion
duly made, seconded and carried,-the meeting adjourned at 9:00 p.m.
