HomeMy WebLinkAbout01081976 ZBA MinutesI~' RECESSED MEETING OF 7DNING BOARD OF ADJUSTMENT JANUARY. 8, 1576 The Zoning Board of Adjustment convened in recessed session at the City Hall. on Thursday, January 8, 1976, 7:30 p.m., with the following members present: Chairman Casey, presiding; members Ayres, Billings, Johnson and Wilkins. Al- ternate members Burge and Doughty were, also present.. Mr. Casey announced that this meeting was for the purpose of continuing con- sideration of an application docketed 75-14 filed by M11r, Charles T. McBride for permission to complete construction of a utility building at his resi- dence located at 4121 Judson. Motion by Mr. Wilkins, seconded by Mr, Johnson, that the recessed meeting of the Zoning Board of Adjustment be called to order. Voting Ayer Ayres Voting No; None Billings Casey Johnson Wilkins Inasmuch as Mr. Billings was not in attendance at the meeting of the Zoning Board of Adjustment on December 18, 1975, when consideration was given to Mr. McBride's application, Mr. Doughty was designated to sit as a voting member of the Board during .discussion of this application, Chairman Casey advised the Board that in accordance with. their request he had discussed .the. application with City Attorney Charles Cockrell with re- gard to any liability the city mgiht have by way of a permit being issued and had been advised that the city had no liability, Also in accordance with a previous request of the Board. a sketch was submitted by the Inspection Department indicating distances from building lines of other garages and storage buildings in the area. Johnson, that Application docketed for permission to complete construction Voting No: None 1 1 Motion by Mr. Billings, seconded by Mr. Johnson, that the minutes of ±he regular meeting of the Zoning Board of Adjustment on December 18, 1975, be considered out of order on the agenda. Voting Aye: Ayres Billings Wilkins Voting No: None 1 a Mr. Casey and Mr. Johnson .abstained from voting, Motion by Mrt Billings, seconded by Mr, Wilkins, that minutes of the regular meeting of the Zoning Board of Adjustment on-December 18,.7975, be approved as submitted. Voting Aye: Ayres Voting. No: None Billings Casey Johnson Wilkins Mr. Casey announced that the Board would now hold the Public Hearing called ,~ for this date and hour to consider an application bearing Docket Number 75-16 d„i filed by Mr. Gerald Kerbow, 6330 Wakeforest. -~ Mr. Casey requested that the Board Secretary read the Notice. of Public Hearing. ~ Motion by Mr. Johnson, seconded by Mr. Wilkins, that the Public Hearing was now open to consider an application for construction of a single family dwelling at 6330 Wakeforest filed by Mr. Gerald Kerbow. Voting Aye: Ayres Voting No: None Billings C~sev Johnson Wilkins Mr. Casey introduced himself .and identified his residence in the city, followed by each member of the Board. Mr. Casey ascertained from the secretary that Notice of Public Hearing was published in the Southwestern Argus on Wednesday, December 24, 1975., and notice was mailed to a l property owners within a 200' radius of the property... in question on December 37, 1975, Mr. Casey administered the Oath to Mr. Kerbow and Building Inspector J, D. Allstott. Mr. Kerbow stated that it was his desire to construct a new single family residence on the property located at 6330 Wakeforest using a thirty (30') foot front setback rather than having to comply with the provisions of the Zoning Ordinance requiring that if twenty-five per cen (25/) of a block frontage is improved with buildings the front yard shall extend to the align- ment of such existing buildings. Mr. Kerbow presented a sketch showing the irregular front building lines used by residences already located on the block, indicating setbacks varying from 45'0" to 89'6". Mr. Kerbow advised the Board that construction of the house as designed would be impossible without use of a thi~r`ty (30') foot front setback. and that exist- ing fence and hedge rows would prohibit visual comparisons of the various setbacks used in the block. ,3 Building Inspector J. D. Allstott advised the Board that under the provisions of the Zoning Ordinance the. request for a permit had been denied:".inasmuch as the existing residence nearest the front setback line was-forty-six (46') feet. Motion by Mr. Wilkins, seconded by Mr. be closed.
