HomeMy WebLinkAbout11201975 ZBA Minutes REGULAR MEETING OF ZONING BOARD OF ADJUSTMENT NOVEMBER 20, 1975 The Zoning Board of Adjustment convened in .regular session at the City Hall on Thursday, November 20, 1975, 8:00 p.m., with the following members pre- sent: Chairman Casey, presiding; members Billings, Johnson and Wilkins. Mr. Ayres was absent. Mr. Casey announced. that the request fora re-hearing on an application filed by Mr. Thomas P. Taylor for a variance to permit the construction of a redwood deck at his residence at 3613 Plumb had been withdrawn and Mr. Taylor planned to construct a brick patio. Mr. Casey announced that the Board would hold the Public Hearing ca1]ed for this date and hour to consider an application filed by Mr. Douglas Baggett, 3911 Southwestern, bearing Docket Number 75-13. Mr. Casey requested that the. Board Secretary read the Notice of Public Hearing. Motion by Mr. Billings, seconded by Mr. Johnson, that the public hearing was now open to consider an application filed by Mr. Douglas Baggett for permis~- Sion to construct a one car garage, utility room and bath. Voting Aye: Billings Voting No; None Casey Johnson Wilkins Mr. Casey ascertained from the secretary that Notice of Public Hearing was published in the Southwestern Argus on Wednesday, November 12, 1975, and notice was mailed to a71 property owners within 200 feet of the property-in question on November 5, 1975. Mr. Casey introduced himself and identified his residence in the city, fol- lowed by each member of the Board. Mr. Casey administered the Oath to Mr. Baggett, Mr. Walter Stokes, 3907 South- western, Mr. Billy Carpenter,. 3908 Southwestern and Mr. John Lucey, 3901 South- western and Mr. Wayne Perry,. Assistant .Building Inspector. Mr. Baggett furnished members of the Board plans of the .original construction when the garage apartment was converted into a two-story residence, plans of his proposed addition ..and a model indicating the appearance of the finished residence. Mr. Baggett stated that the proposed construction would provide a garage/parking facility inasmuch. as there is only a driveway at this time; that the addition would make. the house plan more functional as far as living space and would im- prove the overall appearance of the house and neighborhood. Mr, Stokes stated that the structure was originally built as a garage apart- - ment with plans for construction of a residence in front at a later date, However, the additional residence was never built and the previous owner had converted the garage portion of the structure into downstairs living area. ~2 Mr. Stokes further stated that he was pleased with the plans for the proposed addition and would have opposed an addition to the front of the structure in- asmuch as he enjoyed being able to see the park like front yard of the resi- dence. Mr. Carpenter stated that he lived across the street from Mr. Baggett and believed that the addition would enhance not only Mr, Baggett"s residence but others in-.the neighborhood as .well. Mr. Lucey stated that the proposed addition indicated the use of imagination and it was his belief that this was important in remodeling older homes, Ne thA~ght it to be functional design and one that would add to the neighbor- hood, Mr. .Baggett stated that_f his application for the addition was denied by the Board that he would probably continue to live in the house for another year or so, but would have no desire to make it a permanent home in which to raise his family. Chairman Casey read the following letters that had been received in regard tonotiees mailed: "Zoning Board of Adjustment; This is to certify that my wife and I have examined plans of the proposed variation by Mr. Douglas G. Baggett, property owner, next door-to our residence. As a result, we concur in approval of the application, as submitted* Walter L, King 3815 Southwestern" "In regard to the application Mr, Douglas. G. Baggett has made to the Zoning Board.- I have been a resident twenty-seven years of WEst University Place and- I am in favor of this permit as I feel it would be a great improvement to the community and on the block of 3800 Southwestern, I submit this in writing as it is impossible for me to attend this~meet- ing, Mr. Bi]ly Carpenter will represent me. Mary E. Sutter 39D4 Southwestern" "Dear Sir: A man should have the right to make improvements to his home and there are many .homes in WUP that could stand improvement. This type of zoning is a detriment to the community. Mr. & Mrs, S, A, Whitsett 39l 5 Ri 1 ey" Mr. Perry stated that the city's Zoning Ordinance requires. that there be a rear yard along the rear line of the lot with a minimum depth of twenty (20') feet. Mr. Perry further stated that the original construction of the garage. apartment was in violation of the Zoning Ordinance, but it-was his belief that this construction was prior to the passage of the Zoning Ordinance. Motion by Mr. Billings, seconded by Mr. Johnson, that the Public Hearing be closed. Voting Aye: Billings Voi;ing No: None Casey „~ Johnson ~ Wilkins Mr. Casey recessed the meeting at this time, 00 Motion by Mr. Billings, seconded by Mr. Wilkins, that the meeting be called to order. Voting Aye: Billings Voting-No: None Casey Johnson Wilkins Members of the Board further examined the model and plans left by Mr, Baggett, giving consideration to adjoining property owners on either side of the residence and the property at the rear. Motion by Mr. Wilkins, seconded by Mr. Billings, that the application filed by Mr. Douglas Baggett for the addition of a garage, utility room and bath to extend into the rear twenty (20') feet of his property be approved, Voting Aye: Billings Voting Noy None Casey Johnson Wi 1 ki ns Minutes of the regular meeting of the Zoning-Board of Adjustment on -0ctober 16th and a special meeting on October 23rd were presented for. consideration. Motion by Mr. Wilkins, seconded by Mr. Johnson, that minutes of the Zoning Board of Adjustment on October 16th and October 23rd be approved as sub- mitted. Voting Aye: Billings Voting No: None.
