HomeMy WebLinkAbout10161975 ZBA Minutes REGULAR MEETING OF ZONING BOARD OF ADJUSTMENT OCTOBER 16, 1975 The Zoning Board of Adjustment convened in regular session at the City Hall on Thursday, October 16, 1975, 7:30 p.m., with the following members present. Chairman Casey, presiding; members Ayres and Billings. Alternate member Doughty had been designated to sit as a member in the absence of Mr. Johnson. Member Wilkins and Alternate Member Burge were also absent. Mr. Casey announced that the Board would hold the Public Hearing called for this date and hour to consider an application bearing Docket Number 75-12 filed by Mr. Thomas P. Taylor, 3613 Plumb. d~ Mr. Casey requested that the Board Secretary read the Notice of Public Hearing. '`~ ~ Motion by Mr. Ayres, seconded by Mr. Doughty, that the public hearing was now ~ open to consider an application filed by Mr. Thomas P. Taylor for permission to construct a redwood deck over the area between an existing porch and aside fence that is to be constructed. Voting Aye: Ayres Billings Casey Doughty Voting No: None Mr. Casey ascertained from the secretary that Notice of Public Hearing was published in the Southwestern Argus on Wednesday, October 1, 1975, and notice was mailed. to all property owners within 200 feet of the property in question,. on October 1, 1975. Mr. Casey introduced himself and identified his residence in the city, followed by each member of the Board. Mr. Casey administered the Oath to Mrs. Thomas P, Taylor, 3615 Plumb who was presenting the application inasmuch as Mr. Taylor was out of the city, and Mr. Wayne Perry, Assistant Building Inspector. u Mrs. Taylor referred to a sketch outling the existing house, a sun porch that is being enclosed with glass and the proposed location of a redwood deck. Mrs. Taylor stated that the house was small and it was their hope that putting the deck adjacent to the glass enclosed sun porch would provide an "open area" appearance from their home. Mrs. Taylor further stated that there were no plans to live or entertain on the deck inasmuch as they intended to put plants on it, and they also had planned no lighting for the deck. Mr. Perry stated that Mr. Taylor's application for a building permit had been denied inasmuch as his plans called for construction of a redwood deck to join the proposed fence and would thereby be over the three (3') foot setback that was required by the Zoning Ordinance. Motion by Mr. Billings, seconded by Mr. Ayres, that the public hearing be closed. Voting Aye: Ayres Billings Casey. Doughty Voting No: None ~7 Mr. Casey announced that the Board would hold the re-hearing called for this date and hour to consider a request by Dr. Monroe Jahns in accordance with the provisions of the "Rules of Procedure" whereby a request for a re-hearing could be made by an applicant within ten days after action had been taken by the Board. Motion by Mr. Ayres, seconded by Mr. Doughty, that the public hearing was now open to consider the request of Dr. Monroe Jahns fora re-hearing on his appli- cation-for permiss-ion to construct a carport on his property located at 6319 Vanderbilt. Voting Aye: Ayres Voting No: None Billings Casey Doughty Mr. Casey introduced himself .and identified his residence in the city, fo]lowed by each member of the Board, Mr. Casey ascertained from the secretary that Notice of-Public Hearing was. published in the Southwestern Argus on Wednesday, October 2, 1975, and notice was mailed to all property owners within 200 feet of the. property in question on September 30; 1975.. Mr. Casey administered the Oath to Dr. and Mrs, Jahns and Mr. Wayne Perry, Assis- tant Building Inspector. Dr. Jahns advised the Board that he requested a re-hearing inasmuch as he had re-drawn plans for the proposed carport after considering the feasibility of parking one automobile further east than was shown on the original drawing. Dr. Jahns pointed out on a sketch that placing the line of the carport supports as near to an existing column as practical to clear an automobile would still. place the supports beyond the setback requirements, however, the encroachment would be less than previously requested. Mrs.. .Jahns stated that it was their desire to be able to place two cars side by side to eliminate the necessity of having to move one car for the other to get out of the carport. Dr. Jahns stated if the Board was fearful that. a fence would be constructed alongside the carport essentially closing it in for a garage, he would be happy for the Board to put such a constraint on granting the application. Mr. Perry stated that the proposed carport would still be encroaching on the required three (3') foot side setback requirement of the Zoning Ordinance, therefore, making it necessary for the Inspection Department to deny an appli- cation fora permit. The Board reviewed the sketch of the proposed construction of a deck by Mr. Thomas P. Taylor, 3~i13 Plumb. Motion by Mr. Billings, seconded by Mr. Doughty, that inasmuch as the applica- tion filed by Mr. Thomas P. Taylor, bearing Docket No. 75-12, failed to show that literal. enforcement of the provisions of the ordinance. would result in un- necessary hardship, that such application be denied. Voting Aye: Ayres Voting No: None Billings Casey Doughty The Board reviewed the app]ication bearing Docket No. 7511 filed by Dr. , Monroe Jahns for permission to construct a carport on his property located at 6319 Vanderbilt. Motion by Mr. Doughty, that Application No. 75-11 requesting a variance by Dr. Monroe Jahns be granted pursuant to his signing an affidavit that no fence would be constructed or built alongside or next to the- carport,_and provided that said carport. be made to conform with the property setback line should title to the property be transferred and further provided that the carport not go beyond one foot four inches (l'4") into the property setback line..
