.::REGULAR MEETING OF ZONING BOARD OF ADJUSTMENT
AUGUST 27, 1975
The Zoning Board of Adjustment convened in regular session at the Gity Hall
on Thursday, August 21, 1975, 7:30 p.m., with the following members present:
Vice-Chairman Wilkins presiding in the absence of Chairman Casey. Members
Ayres, Billings and Johnson. Alternate member Doughty had been designated
to sit as a member in the absence of Mr. Casey,
Vice-Chairman Wilkins announced that the Board would hold .the Public Hearing
called for this date and hour, hearing the case Docketed No. 75-75-7.
Motion by Mr. Johnson, seconded by Mr. Billings, that the public hearing was
now open to consider an application filed by Mr. Ralph Pokluda for permi sion
to enclose an existing front porch at his residence located at 3930 Rice Boule-
vard.

Mr. Wilkins introduced himself and identified his residents in the .city, followed
by each member of the Board.
Mr. Wilkins then ascertained from the secretary that Notice of Public Hearing
was published in the Southwestern Argus on Wednesday, July 30, 1975, and notice
was mailed to all property owners within a 200' radius of .the property in ques-
tion on July 31, 1975..
Mr. Wilkins administered the Oath to Mr; and Mrs. Ralph Pokluda and Assistant
Building Inspector Wayne Perry.
Mr. Pokluda presented the Board with photographs of his residence as it now.
appears and an architectural sketch of the improvements he hopes to make.
Mr. Pokluda stated: that the existing front porch would be completely removed
and replaced with new construction, Mr. Pokluda stated that much. of the
planned remodeling would be done by himself, however, he was certain he
would require professional assistance with the front of his ,residence.
Mr. Perry stated that Mr. Pokluda's application for a building. permit had been
denied under the provisions of the Zoning Ordinance which state that if twenty-
five (25%) percent of a block frontage is improved with. buildings the front yard
shall extend to the alignment of ,such existing buildings, but in no case sha17
the depth of such front yard be less than twenty (2O) feet.

Motion by Mr. Billings, seconded by Mr. Johnson, that the public hearing be
closed.

Motion by Mr. Billings, seconded by Mr, Johnson, that the public hearing was
now open to consider an application filed by Mr. Luther Trawick for permission
to enclose an existing front porch at his residence located at 3512 Amherst.

Mr. Wilkins introduced himself and identified his residence in the city,. followed
by each member of the board.

Mr. Trawick said that their primary reason for enclosing the porch was to keep
out rain. Mrs,. Trawick said enclosing the porch would provide an area 80" deep
by 22' across and would provide a place to put chairs and plants. Mrs. Trawick
also stated that it was their belief that enclosing the porch and using small
windows would upgrade the outside appearance of their home. and make it more
compatible with other homes in the area,
Mr. Timothy Jurgensen, 3514 Amherst, advised members of .the Board that it was
his belief that the enclosure would make the Trawick home more attractive and
that he had no objections to the proposed enclosure.
Mr. Wilkins read the following letters that had been received in connection with
the application filed by Mr. Trawick:
Gentlemen:
Please record my affirmative response to the application of Mr, Luther Trawick
of 3512 Amherst to enclose his front porch.
As an across-the-street neighbor, I feel the enclosure will add to the enjoyment
of their home by Mr. and Mrs. Trawick. They are very nice neighbors and I am
happy to see them make this alteration.

Zoning Board of Adjustment
If Mr. Trawick's plans for the enclosure of his front porch enhance the value..
of his property, and, in the opinion of the Zoning Board of Adjustment, have
no degrading effect on the appearance of the neighborhood and would not detract
from the value of other residences in the vicinity, I would suggest that a
variance might be in order.

Refurbishment of older houses in our community,if done tastefully, can only
serve to make WUP a better place for all of us to live.
Certainly, considerable weight should be given to the reactions to Mr. Trawick's
request fora variance by his immediate neighbors.

Dear Mr. Lockard:
I am in receipt of your notice regarding an application fora variance which has
been filed with the Zoning Board of Adjustment by Mr. Luther Trawick concerning
the property located at 3512 Amherst, in the VII Zone District. I understand
that the request, if approved, would authorize enclosure of an existing front
porch.
I am writing this letter since I will be required to be out of the city on Aug-
ust 2l, 1975 when a public hearing on this matter will be held. I would appreciate
my letter being submitted at such hearing for your consideration,
My wife and I own and occupy 3502 Amherst which is the property immediately east
of Mr. Trawick~s;,pnepe~ty. I have had an opportunity to investigate the proposed
enclosure and unqualifiedly feel that the Board of Adjustment should approve Mr.
Trawick's application .for a variance for the following reasons:
1. Such enclosure will, in my opinion, improve and add attractiveness
to the premises and the neighborhood.
2. There is already a permanent structure comprising the front porch and,
therefore, no new structure is being built.
Since such an enclosure will be enjoyed by the Trawick`s without adversely
affecting anyone I feel that as neighbors and as a city we should whole-
heartedly grant the variance with the hope. that the Trawick's will enjoy
the improvements to made to their property.
If you .have any questions concerning my comments herein, I will be glad to
discuss them them with you.

Mr. Perry advised the Board that Mr. Trawick had begun enclosure of the porch
without applying fora permit and construction was stopped because of an in-
trusion into the front setback. There is a thirty (30') foot front setback
requirement and the existing porch extends three (3') feet into such setback.
Motion by Mr. Billings, seconded. by Mr. Johnson, that the public hearing be
closed.

Mr. Wilkins recessed the meeting at this time,
Motion by Mr. Billings, seconded by Mr. Johnson, that the meeting be called to
order.

Members of the Board reviewed photographs and plans left for their considera-
~ tion by Mr. Pokluda and were of the opinion that the proposed remodeling
~ would be an asset to the neighborhood and the community in general.
Motion by Mr. Billings, seconded by Mr, Doughty, that application Docketed as
No. 75-7, filed by Mr. Ralph Pokluda for. permission to remodel his home be
approved as requested.

The Board reviewed the application filed by Mr. Luther Trawick, 3512 Amherst.

Motion by Mr. Johnson, seconded by Mr. Ayres, that the application filed by
Mr. Luther Trawick, 3512 Amherst, Docket No. 75-8, for permission to enclose
and existing front porch be approved.

Minutes of the regular meeting of the Board on July 37, 1975, were presented
for consideration and the following action taken. .Motion by Mr. Billings
seconded by Mr. Johnson, that the minutes of the regular meeting of the Zoning
Board of Adjustment on July 31, ]975, be approved as submitted.
