1. Notices, Rules, Etc. John Cutrer, Presiding Officer, called the meeting to order at 6:15
p.m. John Cutrer asked staff to confirm that appropriate notices were given. Josie Hayes
stated notices were posted per state and local laws. John Cutrer asked commission
members and staff to introduce themselves.
2. Public Comments. There were no public comments.
3. 3/7 Exemption. Joe Newton briefly discussed the additional information that was
requested from the ZPC from the previous meeting. There was general discussion
regarding proposed changes. There was also discussion regarding the parameters for the
exception. After discussion, the ZPC asked that some of the language be revised for the
special exceptions and brought back to the next meeting for review.
4. Curb Cuts/Corner Lots. Joe Newton briefly described the additional information that
was requested from the previous meeting. There was general discussion regarding the
proposed changes and what sections were being moved to Chapter 70. The ZPC asked the
item to be brought back to the next meeting for discussion.

5. Old Stock Housing. There was general discussion regarding the proposed changes at the
previous meeting. After discussion, the ZPC asked that the preliminary report be brought
back to the next meeting for approval.
6. Sports Courts. Joe Newton briefly explained the additional information that ZPC asked
for at the previous meeting. There was general discussion regarding the current
ordinance's requirement for height around tennis courts and if sports courts should follow
the same requirement. There was also discussion regarding if sports courts should be
allowed in the side yard with a special exception or just on corner lots. The ZPC asked
that the modified changes be made and brought back to next month's meeting.
7. SF District Consolidation. Joe Newton gave a brief overview of the additional
information that ZPC requested from the previous meeting and the changes to the zoning
map. He stated there would be an overlay of a different color that showed the different
zoning districts. There was general discussion regarding the proposed changes. The ZPC
asked that this item be brought to the next meeting for additional discussion.
8. Artificial Turf. Joe Newton briefly explained the proposed draft. There was general
discussion regarding the proposed specified color and type of material. The ZPC asked
for some minor changes to be made and brought back to the next meeting for review.
9. Minutes. The commission reviewed the minutes of the meeting held on August 11, 2022.
Richard Wilson made a motion to approve the meeting minutes, as amended. Second by
John Cutrer. AYES: John Cutrer, Richard Wilson, Matthew Fisher, Myrenda Takashima
and John Howard. NOES: None. ABSTAIN: None. Motion carried.

2. Public Comments.There were no public comments.
3. 3/7 Exemption. Joe Newton briefly discussed the additional information that was
requested from the ZPC from the previous meeting. There was general discussion
regarding proposed changes. After general discussion, Richard Wilson made a motion for
the preliminary report to be taken back to the next meeting for approval. Second by
Myrenda Takashima. AYES: John Cutrer, Richard Wilson, Bob Powell, Myrenda
Takashima and Sam Mazzu. NOES: None. ABSTAIN: None. Motion passed.
4. Curb Cuts/Corner Lots. Joe Newton briefly described the additional information that
was requested from the previous meeting. There was general discussion regarding if the
"busy streets" should be modified and if corner lots should be expressly prohibited from
constructing a circular driveway which connects two intersecting streets. After general,
the ZPC asked that this item be brought back to the next meeting for discussion.

5. Old Stock Housing. There was general discussion regarding the proposed preliminary
report. Items discussed were the potential feasibility of implementing a tax-relief based
incentive program for the preservation of old stock housing. Upon further discussion, the
City Attorney determined that the creation of such a program would be outside of the
purview of the Zoning and Planning Commission. After discussion of the proposed
preliminary report, the ZPC asked that the report be brought to the next meeting with the
proposed changes.
6. Sports Courts. Joe Newton briefly explained the additional information that ZPC asked
for at the previous meeting. There was general discussion regarding the amount of noise
generated from pickle pall courts and if the ZPC should require some type of fencing to
be installed, including discussing the possible height of the fence and whether it should
be opaque or not. After general discussion, the ZPC asked that this item be brought to the
meeting with the modified changes for review.

9. Front and Side yard Setback Requirements. There was general discussion regarding
free little libraries and if requirements should be set for these. Gerardo Barrara stated
these are not currently allowed in the zoning ordinance. If no action is taken,then
enforcement would have to be taken and they would be required to be removed. There
was general discussion about what other items are currently in the front yard that are not
covered under the current ordinance. The ZPC asked that staff draft up a proposed
ordinance and bring it back to the next meeting.

previous meeting. After a brief discussion, Matthew Fisher made a motion to approve the
preliminary report and forward it to the City Council for approval. Second by Richard
Wilson. AYES: John Cutrer, Richard Wilson, Bob Powell, Matthew Fisher, Sam Mazzu,
Myrenda Takashima and John Howard. NOES: None. ABSTAIN: None. Motion
passed.
4. Curb Cuts/Corner Lots. Joe Newton briefly described the additional information that
was requested from the previous meeting. There was general discussion regarding curb
cuts on corner lots being prohibited which connect two intersecting streets. The ZPC
asked that minor changes be made and brought back to the next meeting for review.

preliminary report that the ZPC asked for at the last meeting. After general discussion,
Richard Wilson made a motion to approve the preliminary report and forward it to the

currently enacted ordinances that pertain to sports courts. There was also a brief
discussion regarding possible outdoor lighting requirements and possible limitations on
the hours of operation. The ZPC asked staff to make the proposed changes and bring back
to the next meeting for review.

report. After brief discussion, Richard Wilson made a motion to approve the preliminary
report with minor changes and bring it back to the next meeting for approval. Second by

9. Front and Side yard Setback Requirements.There was general discussion regarding
the proposed ordinance regarding free little libraries(a/k/a book sharing exchanges),
including, for example, whether or not a permit should be required or if approval should
be at the discretion of the City's Building Official. Brian Hunt stated there is a Free Little
Library registry online where people can register them but this is not controlled by the
City. There was general discussion regarding a possible ordinance and its scope,
including size limitations, along with location of where permitted exchanges could be
placed. The ZPC requested that staff bring back some proposed criteria for review at the
next meeting.

not think it should be restricted in any way.
3. 3/7 Exemption. Joe Newton briefly discussed the proposed preliminary report. After a
brief discussion, Sam Mazzu made a motion to approve the preliminary report with minor
corrections and forward it to the City Council for approval. Second by Richard Wilson.

"report" instead of preliminary report since the ZPC is not asking for an ordinance
change. After general discussion, the ZPC had no recommendations to change the
ordinance and tabled this item.

proposed changes. The ZPC asked for the proposed changes to be made to the
preliminary report and be brought back to the next meeting for approval.
8. Front and Side yard Setback Requirements.Joe Newton gave an overview of the
proposed ordinance. There was general discussion over what documents would be
required to obtain a permit, where it should be located and if a fee would be associated
with the permit to install the free little libraries. There was also a brief discussion about a
permit being required; if the city could require the existing free little libraries that are in
the city to obtain a permit. The ZPC asked that staff put together a list of guidelines and
bring it back to the next meeting for review.
9. Sports Courts.Joe Newton briefly reviewed the changes that were discussed at the
previous meeting. Some of the items discussed included, for example,possibly removing
pickleball courts from the definition of sports court so it would have its own special
exception,possible setback requirements, possible requirements for a noise study as part
of obtaining a permit, and whether or not a property owner should need to obtain their
neighbor's permission. The ZPC asked that staff make the changes discussed and bring it
back to the next meeting for review.

discussion regarding the proposed regulations that would be required for free little
libraries (a/k/a book sharing exchanges) in order to obtain a permit. Discussed items
included the restriction of free little libraries from being placed in the right of way; City-

provided Installation Guidelines for public reference; and the definition of"book sharing
exchanges"and size requirements. After deliberation, Matthew Fisher made a motion to
approve the preliminary report with minor changes. Second by Sam Mazzu. AYES: John
Cutrer, Matthew Fisher, Sam Mazzu, Myrenda Takashima and John Howard. NOES:
Bob Powell. ABSTAIN: None. Motion passed 5-1.
5. Sports Courts. Evan DuVall briefly reviewed the changes that were discussed at the
previous meeting. Some of the items discussed were adding the definition of a"sports
court"and "practice enclosure(private)"and setbacks. After deliberation, the ZPC
decided to seek additional input from City Council regarding the matter at the City
Council/ZPC workshop meeting in February before proceeding further.

guidelines. There was also general discussion about whether or not the height should be
regulated. After discussion, Richard Wilson made a motion that the final report be made
with the proposed changes discussed. Second by Bob Powell. AYES: John Cutrer, Bob
Powell, Matthew Fisher, Sam Mazzu, Myrenda Takashima and John Howard. NOES:
Richard Wilson. ABSTAIN: None. Motion passed 6-1.

2. Public Comments. Alida Drewes spoke in regard to curb cuts and doesn't think it should
be discussed again. As far as artificial turf, she doesn't think it's going to make a
difference; there should be other things that need to be looked at. She is against the book
sharing ordinance.
3. 3/7 Exception. Joe Newton stated there were only minor drafting changes, not any
content changes to the final preliminary report that was approved at the last meeting. Sam
Mazza made a motion to submit the final report as drafted to the City Council. Second by
Myrenda Takashima. AYES: John Cutrer, Sam Mazzu, Myrenda Takashima and John

4. Curb Cuts. There was discussion regarding the few minor changes to the Zoning
Ordinance that Sam Mazzu made to the approved preliminary report at the last meeting.

7. SF District Consolidation.Joe Newton stated the drafting is still underway; Mr. Newton
indicated that staff were making sure there were no inconsistencies throughout the current
Zoning Ordinance. All draft changes should be completed by the end of April and
brought back to ZPC at the next meeting for discussion.
8. Sports Court.John Cutrer stated he met with City Council at the workshop in February
and gave a brief overview of their concerns and direction. Sound, lighting and visibility
of the sports courts were some of the items City Council highlighted as concerns. There
was general discussion regarding the proposed draft ordinance. This item will be brought
to ZPC at its next meeting for further discussion.
John Cutrer made a motion to approve the ordinance language as drafted for the four final
reports (3/7 Exception; Curb Cuts; Artificial Turf; and Book Sharing Exchanges)that
were approved earlier in the meeting by ZPC. Second by Myrenda Takashima. AYES:

1. Notices, Rules, Etc. John Cutrer, Presiding Officer, called the meeting to order at 6:15
p.m. John Cutrer asked staff to confirm that appropriate notices were given. Josie Hayes
stated notices were posted per state and local laws. John Cutrer asked commission
members and staff to introduce themselves. John Cutrer gave an update regarding the
final reports. All four were presented to City Council and were approved. Items would be
put on the next consent agenda for approval.
2. Public Comments. There were no public comments.
3. SF District Consolidation. Joe Newton gave an update regarding the proposed changes
from the previous meeting. The new zoning map has not yet been received from HDR.
ZPC engaged in a lengthy discussion regarding all of the proposed changes. There was
some discussion of hyperlinks that could be added to the zoning map that directs any user
to the section of the zoning code that references a particular section. There was some
discussion regarding when the joint public hearing could be held with the new City
Council. The ZPC asked staff to submit a redline version of the proposed changes and a
clean copy for their review at the next meeting.
4. Sports Court. Joe Newton briefly discussed the changes from the last meeting. Some of
the proposed changes that were discussed included requirements that sports courts could
not project into the rear yard setback, unless the rear yard of the proposed building site
abuts the rear yard of an adjacent building site, in which case a ten-foot projection into

the rear yard setback is permitted. There was also general discussion regarding the
Zoning Board of Adjustment's ability to issue a special exception to locate a sports court
or practice enclosure in a different design or location than prescribed by the ordinance;
what items would be required to submit for a permit; previous; non pervious area
calculations, plans, etc. The ZPC asked that changes be made and brought back for their
review at the next meeting.

members and staff to introduce themselves. There was an introduction of the new
Building Official, John McGowan.
2. Public Comments. There were no public comments.
3. SF District Consolidation. David Cole stated he had several concerns that some of the
language was going to be deleted from the current ordinance, especially the height
requirement of buildings and the requirement of screening of mechanical equipment. Joe
Newton stated there was not any language deleted; it has just been separated into the
newly created article. ZPC asked if the relocation of verbiage could be identified
separately and provide a clean copy for the next meeting. Joe Newton briefly discussed
the additional information that was requested from the ZPC from the previous meeting.
HDR provided staff with the proposed updated map that shows the new overlay districts.
There was some discussion that the overlay needed to be in a different shade so that it is
legible. Staff asked that Joe Newton also make any minor drafting changes to the existing
ordinance. There was general discussion about changing the name of the districts. There

was general discussion regarding where the projections schedule should be located. The
ZPC asked the item to be brought to the next meeting with the proposed changes for
discussion.
4. Sports Court.Joe Newton briefly discussed the changes from the last meeting. There
was general discussion regarding setbacks on through lots; limits on basketball goals and
if there should be a side yard or rear yard setback requirement. After deliberations,
Richard Wilson made a motion that staff prepare a preliminary report that is consistent
with the proposed draft to review at the next meeting. Second by Matthew Fisher. AYES:
John Cutrer, Richard Wilson, Bob Powell, Matthew Fiser and Sam Mazzu. NOES: None.
