I~I~TL'TFS OF ZONING BOARB OF ADJUSTMENT
SEPTEMBER 16, 1968
The Zoning Board. of Adjustment convened in regular session at
the City Hall at 7:30 p.m. nlonday, September 16, 1968, T,aith the
following members preser_t: Chairman Livermore, presiding; Mem-
bers Murff, Neisrhbors and. Wheeler. Alternate member Waldt r~Jas
also oresent.
Chairman Livermo~~e announced that a. public hearing had. been call-
ed for 7x30 p.m. to consider Rocket No. 68-8, filed. on August 22,
1968 by i~r. Thomas M. Wetzel., X717 Arnold. Street. He stated. that
notice of the hearing had been publ~.shed. in the ~Tewslife Section
of the Houston Chronicle on T~Jednesday, !august 28, 1968, and. notices
?~~iled to all xroperty owners within 200 feet of the property on
August 28, 1968.
Chairman Livermore advised. that a letter had. been received. from
M='. 6T. B. Allstott, City ~?~a~~ding Inspector, stating that Mr.
Wetzel's request for ~~. ~er~.it heel been denied. by ris office inas-
m.uch as it would.. constitute a violation of the single-family dwell-
ing provision of Zoning Ordin~.nce ?lTumber 1.11. Mr. Livermore also
read a letter from.P~iss. Fl.izabeth Mosny, 3706 Tangley Road., setting
forth her apprerH~~r..si or_s with reg~.rd to f~zture possibilities of t'r~e
property ber.:~g, ;red. for rent purposes. A letter from Mrs. A. J.
Smith, 371, Arnold., in which she st~.ted that she h~~d no objections

dlr. Wetzel appeared. before the Loa?°d in be.r~?_f of his annlication
and reader letter that he had: submitted i~Tith his application. The
letter set forth the circtx;~stances creatir~,~ Mr. ?~Ietzel's need for
additional space; the ~;~ror?~ that has already been perfor~.ed rehabil-
it~~.ting the garage; and.. the requirements to finish completing the
attachec'; room.
Mr. A. F. Smith, 1722 Arnold, a~l.vised the Board. that he had lived
r_ext door to n"r. t~letzel for eight years, understood. his problem and.
had.. no objections to his pl~.nnad construction.
i~Tr. Perry Lass, Jr. 3723 ~4rnold, stated. thsvt he understood Mr. Wetzel's
problem, but he was quite concerned ti.Tith the r~ossibility that the
property could. bf~ used. for ren'c purposes in tYie advent that it should

i~rs. A. E. Smith, 372.2 ~irnold, adtiised the Board that the existing
room on the rear of the garage h~?.d, been built by previous o:ti*ners and
that srie had. no objections to 1~1r. Wetzel's planned. construction :inas-
much as it l;~as her belief that it ;~aould be improving the property.

rs. E. .~. Plant, X715 Arnold., req~aested information as to what
could be done Urith regard. to existing ga.ra~;e apartments and other
separate living quarters looted. in single-famil~r residence areas.
Chairman Livermore advised Mrs. Plant that it was his understand-
ing that such units constructed prior to the passage of the City's
Zoning Ordinance were not in violation thereof.
Mrs. Wetzel directed. the attention of the Board to the fact that
they were not requesting kitchen facilities of any kind in the
proposed. iu;provements and this should be a deterrent in future
renting possibilities.
Chairman Livermore advised. those present that the Board. would. go
~ into executive session at this time and.. arrive at a decision based
~ on the facts presented. to them.
C® It was agreed iay members of the Boarca. that Mr. Wetzel had a definite
need. for additional space. It was further agreed. that similar re-
quests had. been received. to provide care for aged. parents and depend-
ent children, and. any application for the construction of separate
living quarters woald. constit~.zte a direct violation of the single-
family dwelling provision of Zoning Ordinance No. 111.
After discussion concerning a possible solution, the Board. took the
fol].o~nTing action: Motion by Mr. Wheeler, seconded. by Mr. Waldt,
that the application be denied for the reason that it would. constit-
ute a direct violation of the single-family occupancy provision of
Ordinance Number 111 and. the recommendation be made that Mr. Wetzell
fully investigate the possibility off' adding on to the existing d_well-
ing.
