HomeMy WebLinkAbout04041966 ZBA Minutes SPECIAL MEETING OF ZONING BOARD OF ADJUSTMENT APRIL 4, '1966 The Zoning Board of Adjustment convened in special session at 7:30 p.m., Monday, April 4, 1966, at the City Hall, with the following members present.: Chairman Snyder, presiding; Members Frank, Livermore, Murff and Whenthoff. Mr. Snyder announced, that the Public Hearing called for 7:30 p.m. was now in session. Application 66-1, requesting a variance of setback requirements to allow a 15-foot extension into the front setback requirement, submitted by Mr. W. F. d* Bettis owner of the Cellar Door Restaurant, 6732 Stella Link, was presented ?r to the Board of Adjustment for consideration. The application requested that the Cellar Door Restaurant be permitted to extend 15 feet into the front set- m back requirement in order to construct additional cooking pits. Mr. Bettis advised the Board that he desired to make this addition to his cooking pits, as his present facilities were inadequate and that it would create a considerable hardship on his business if this request were not granted, inasmuch as he would have to completely close down his cooking operations for a considerable length of time if he had to remove the present pits before building new ones. He stated that the building front would still be 30 feet from the street and 15 feet from the property line if the addition were permitted. The following property owners were present for the Hearing: Messrs. E. R. Houck, Sr., and E. R. Houck, Jr., owners of the vacant property immediately across the street from the restaurant; Mr. Henry Lange, 3915 Ruskin and Mr. Leonard Watts, 3924 Ruskin. There was no objection to the proposed variance. The property owners desired information concerning whether this addition would increase the smoke in the area, and were advised by Mr. Eugene Riehl, engineer for Bovay Engineers, who designed the cooking stacks and was present at the hearing, that the new pits would create less smoke than the present ones, inas- much as the existing pits had brick stacks which were very difficult to clean, and the new ones would be of steel, which would be easier to clean and create less smoke. With no further property owners to be heard, upon motion by Mr. Whenthoff, seconded by Mr. Frank, the hearing was closed. At this time, those present were advised that the Board would go into executive session and would advise Mr. Bettis of their decision on Form Number 3 of the Board. After discussion concerning the fact that other buildings in this block had already extended into the setback requirement, and that the building would still be 15 feet from the property line and 30 feet from the street line after the addition to the cooking pits was made, the following act ion was taken by the Board: Motion by Mr. Livermore, seconded by Mr. Murff, that the request for variance of setback requirements submitted by Mr. W. F. Bettis, Cellar Door Restaurant, 6732 Stella Link, for permission to extend 15 feet into the a~ [ "n ~~ setback requirement with the addition of new cooking pits, be granted in accordance with the plans submitted, and that the decision of the Building Inspector be reversed. Voting Aye: Snyder, Livermore, Frank, Murff and Whenthoff Voting No: None With no further business to come before the Board at this time, upon motion duly made, seconded and carried, the meeting was adjourned.
