REGULAR MEETING OF ZONING BOARD OF ADJUSTMENT
MAY 17, 1965
The Zoning Board of Adjustment convened in regular session ~at the City Hall
on Monday, May 17, 1965, 7:30 p.m., with the following members present:
Chairman Snyder, presiding; Members Frank, Murff and Whenthoff. Alternate
Member Adam was also present.
Application number 65-6 was presented by Mr. Snyder. Inasmuch as Mr. J. D.
Woodson, applicant, was not present, this application was deferred unti l
those present could be heard.
Application number 65-7 was submitted to the Board. Mr. and Mrs. Charles D.
Watson, 6336 Rutgers, appeared before the Board in behalf of their request
for permission to make an addition of 24 feet to the existing greenhouse in
their rear yard. They explained that this Appeal from Decision of the Build-
ing Inspector was made because they desired to make the addition to their
greenhouse in order to have more room to pursue their hobby of hybridizing
orchids. They also stated that the orchids they grew were not of the type
sold commercially, and that they had previously executed an affidavit that
they would not sell orchids which they grew, that they had never sold any
and did not intend to do so. They stated that they would be willing to
sign another affidavit to the effect that they did not intend to grow orchids
for commercial purposes. They stated to the Board there is a large hedge
separating their lot from the adjoining lots, thus providing a screening
device. They presented a petition signed by eight neighbors, two of which
lived immediately to the west, two to the east, two to the south and two to
the north of their property, stating that they had no objections to the pro-
posed addition to the greenhouse. Mr. Watson stated that he would even be
willing to execute an affidavit that the structure would be dismantled in
the event he should ever sell the property, if this were necessary. Mr.
Snyder advised Mr. and Mrs. Watson that the Board would give full considera-
tion to all aspects of their case when it went into executive session after
hearing all applications, and that they would be notified of the decision
of the Board on Official Form number 3 of the Zoning Board of Adjustment.
Mr. and Mrs. Watson left the meeting at this time.
Application number 65-8 was submitted to the Board. Mr. C. J. Foster, 3034
Quenby appeared before the Board in behalf of his request for permission
to make an addition to the side of his detached garage of 8 x 16 feet, to
be used as a study, inasmuch as he is retiring from Humble and his two-
bedroom home will not accommodate a study room for his records, etc. He '
stated that he desires to build the room strictly for his own use and had.
no intentions whatsoever of using it for any business purposes: He stated
that he merely wanted a place to organize all of his things after retiring,
and that he might want to do some writing in his spare time. He advised
the Board that he had consulted with contractors concerning the ,possibility
of making an addition to his residence, that the brick construction of his
home and the arrangement of it would prevent his doing this. He stated
that his kitchen was also on the rear of the house and that the plumbing
comes into the back of the kitchen, making it impossible to add on at this
point. He stated that the type of construction he desired to use for the

study room would be siding and would be painted and landscaped and would
in no way detract from the appearance of the property. He stated that his
lot is 50 x 105 feet and that it i~ thus impossible to add to the side of
the residence.
Mr. Snyder advised Mr. Foster that the Board would give full consideration
to his application in executive session, and that he would be notified on
official form number 3 of the Zoning Board of Adjustment. Mr. Foster left
the meeting at this time..
.Consideration was then given to application number 65-6, submitted by Mr.
J. D. Woodson, 3825 Tennyson. Mr. Woodson requested permission to construct
~ a detached hobby room 8 x 12 feet on the rear of his property. He stated
~ in the application that he desired to place the structure on the property
~ lines, rather than having the required 3-foot side and 5-foot rear setback.
~~ He desired to use the room as a hobby room.

~ Motion by Mr. Murff, seconded by Mr. Whenthoff, that the decision of the
Building Inspector be affirmed, and that the permit be refused for construc-
tion of a detached building in the rear yard at 3825 Tennyson on the property
lines, inasmuch as the zoning ordinance requires a 3-foot setback from the
side property lines and a 5-foot setback from the rear property line, and there
is no substantial reason for this structure being placed on the property line,
and that the applicant be so notified.
Voting Aye: Snyder, Frank, Murff and Whenthoff
Voting No: None
Consideration was then given to application number 65-7, submitted by Mr.
Charles D. Watson, 6336 Rutgers, for a 24-foot addition to the existing
greenhouse in his rear yard. There was discussion concerning the fact that
this is a 150-foot lot, and that the proposed stricture, together with the
existing structure would not occupy 40% of the yard area required; also,
the fact that the structure is not to be used for any commerical purpose
but only as a hobby.
Motion by Mr. Whenthoff, seconded by Mr. Frank, that the decision of the
Building Inspector be reversed and that a permit be granted Mr. Charles D.
Watson, 6336 Rutgers, to construct a 24-foot addition to the rear of the
existing, greenhouse in his rear yard in accordance with the drawings submitted
to the Board, inasmuch as the proposed structure would not exceed 40% of the
rear yard area, and that the applicant be so notified.
Voting Aye: Snyder, Murff, Frank and Whenthoff
Voting No: None
The application of Mr--. C. J. Foster, 65-8, was then. given consideration. The
Board discussed the fact that Mr. Foster had made every effort to make the-
proposed addition to his residence and found it impossible; also, that the pro-
posed structure and the existing garage would not occupy 40% of the rear yard
area. Motion by Mr. Murff, seconded by Mr. Frank, that the decision of the
Building Inspector be reversed, and that a permit be granted Mr. C. J. Foster,
3034 Quenby, for construction of an 8 x 16 foot addition to the side of his

existing detached garage for use as a study, in accordance with the plans sub-
mitted to the Board, inasmuch as the proposed and existing structures would
not occupy 40% of the rear yard area, and that the applicant be notified.
Voting Aye: Murff, Frank and Whenthoff
Voting No: Snyder
With no further business to come before the Board at this time, upon motion
duly made, seconded and carried, the meeting was adjourned.
