HomeMy WebLinkAbout04191965 ZBA Minutes`~ REGULAR MEETING OF ZONING BOARD OF ADJUSTMENT APRIL 19, 1965 The Zoning Board of Adjustment convened in regular session at the City Hall on Monday, April 19, 1965, 7:30 p.m., with the following members present: Chairman Snyder, presiding; Members Frank and Livermore. Alternate Member Reinhart was designated by the City Manager to sit as an acting member of the Board at this meeting, as it was determined a quorum would not be available. Chairman Snyder announced that the Board would at this time hold the Public Hearing which was called for this date, and for which notice was mailed to all property owners within 200 feet of the property in question on April 2, 1965, to consider a variance of setback requirements on property located at the north- west corner of Kirby Drive and Wroxton Road. Application received from Mrs. F. A. Krenzler, Docket number 65-4 filed on March 31, 1965, was presented to the Board. Mr. Ben Weil presented information in connection with the request on behalf of Mrs. Krenzler. He stated that Mrs. Krenzler desired the following setback allowances on this property: 10 feet setback from Kirby Drive property line, 10 feet setback from Wroxton Road property line, 5 feet from west pro- perty line and no setback from north property line. He presented a layout which showed the property with the setback as now required, then showing the proposed building to be placed on the property with the setback they are requesting.. He presented a copy of ordinance number 682, which allowed a 15 foot setback from Kirby Drive property line and 10 feet from Wroxton Road property line on the property immediately south across Wroxton. He also stated that Triangle Refin- eries was allowed a 10 foot setback from Kirby Drive property line, by ordinance number 527. Mrs. Krenzler stated that she had made an agreement with Conoco that no building would be constructed nearer than 30 feet from the property line on Kirby Drive for at least fifteen years. However, this would be a matter of private contract and would have no bearing on the decision of the Board in this matter. With no further evidence to be presented, and no property owners desiring to be heard in connection with the request, the hearing was closed. Mr. Snyder advised those present that the Board would give full consideration to all aspects of the request for variance, in executive session when all other cases before the Board had been heard. The next application docketed was number 65-5, which was the request of Mr. W. P. Walling, 6417 Belmont, for an interpretation of the zoning ordinance and appeal from the decision of the Building Inspector, to allow him to construct an addition of one bedroom, one bath and a utility room with sink, to his house, all downstairs. The request fora permit was denied by the Inspector on the basis that he could not issue a permit for an additional sink in a single family dwelling. Mr. Walling stated that he desires to make the addition for use of his mother at the present time, and for their own use as well. He stated that he would be willing to sign an affidavit that the addition would not ever be rented or used for commercial purposes. Mr. Snyder advised Mr. Walling that the Board would give full consideration to his request in executive session. At this time, those present for the meeting left, and the Board went into executive session. s~ Cr1' d'* ~~ CSY 1 In executive session, the following action was taken by the Zoning Board of Adjustment in connection with the request of Mrs. F. A. Krenzler: Motion by Mr. Livermore, seconded by Mr. Frank, that the Zoning Board of Adjust- ment grant a variance from the 30 foot setback required on retail business property, as requested by Mrs. F. A. Krenzler for the property located at the northwest corner of Wroxton Road and Kirby Drive described as acreage 106' x 177', as follows: Ten foot setback from the south property line on Wroxton Road, 15 feet setback from the east property line on Kirby Drive, (rather than 10 feet from Kirby property line as requested), and 5 feet set- back from the west property line, and no setback from the north property line, and that the Secretary so advise Mrs. Krenzler on Zoning Board of Adjustment Form no. 3. Voting Aye: Frank, Livermore, Reinhart and Snyder Voting No: None In connection with the request of Mr. W. P. Walling, 6417 Belmont, the follow- ing order was adopted by the Board: Motion by Mr. Reinhart, seconded by Mr. Frank, that the decision of the Building Inspector be reversed, and that Mr. W. P. Walling be allowed to construct an addition consisting of one bedroom, one bath and utility room with sink, down- stairs, to the rear of his residence at 6417 Belmont, provided that he sign an affidavit that the addition will never be rented or used for any commercial purposes, and that the applicant and Building Inspector be notified of the .decision on Zoning Board of Adjustment form no. 3. Voting Aye: Frank, Livermore, Reinhart and Snyder Voting No: None With no further business to come before the Board at this time, upon motion duly made, seconded and carried, the meeting was adjourned.
