Notices, Rules, Etc. Bruce Beneke welcomed BSC members and staff to the meeting. Josie M. Hayes stated that agenda was posted per state and local laws. Josie M. Hayes stated the alternate voting members were Jonathon Hance and Charles Marshall. 2. Discussion Items from City Council. Gerardo Barrera gave a brief update regarding the minimum flood county for Harris County. Since then, staff went back and discussed with City Attorney and City Engineer to modify the ordinance. Carol Harrison explained the changes to the updated map. Some of the proposed changes discussed were: 1.) for all new construction outside the special flood hazard area and moderate flood hazard area shall be constructed so that the lowest floor is a minimum of two feet above the crown of the nearest street or the highest grade adjacent to the building; 2.) In all areas of special flood hazards and moderate flood hazards where base flood elevation and 500-year floodplain elevation date has been provided as set forth in (i) subsection 18- 273(b), (ii) subsection 18-274(b)(8), or (iii) (c)(3) the following provisions are required: new construction and substantial improvement of any residential structure shall have the lowest floor (including basement), elevated to two feet above the base flood elevation or to or above the 500- year floodplain elevation, whichever is higher. Hayes stated the alternate voting members were Gerry Spedale and David Flame. Eddie Matthews reviewed the general rules for the meeting and all members and staff introduced themselves. 2. Meeting Minutes James Craig made a motion to approve the meeting minutes of May 5, 2022. Second by Gerry Spedale. AYES: Muddy McDaniel, James Criag, Eddie Matthews, Gerry Spedale and David Flame. NOES: None. ABSTAIN: None. Meeting minutes approved. James Craig made a motion to approve the June 2, 2022 minutes. Second by Gerry Spedale. AYES: Muddy McDaniel, James Craig, Eddie Matthews, Gerry Spedale and David Flame. NOES: None. AYES: None. Meeting minutes approved. James Craig made a motion to approve the July 7, 2022 minutes. Appeal of an order, requirement, decision or determination made by the Building Official (or other administrative official) of the City for the property located at 5928 Auden St., West University Place, TX 77005. Spyros Maragos gave a brief background of the appeal. The issues 3826 Amherst St. www.westutx.gov West University Place, TX 77005 713-662-5830 City of West University Place Public Works Department discussed were as follows: 1.) developer raised the yard elevation with dirt on their side of common property line; 2.) wooden fence gate encroaching on Maragos property; 3.) the placement of the a/c units and the distance from the side property line. Mr. Maragos stated he previously had a meeting with the Chief Building Official, City Manager and a City Council member regarding the issues and at a city council meeting. Brian Hunt, Chief Building Official visited the jobsite and did not find any violations. Alida Drewes spoke in favor of the appeal. Justin Coddington, property owner of 5928 Auden stated he is unaware of any gate encroachment onto the neighbor's property at 5932 Auden; the spring on the fence has been changed and the issue has been corrected and it was his understanding that the home was built in compliance to West U codes. The BSC discussed the issues at hand and found no violations since everything was done according to West University Place regulations. Gerry Spedale asked if BSC had the authority to deal with the issues at hand. Scott Bounds stated the board does not have the authority to take action on the items detailed in the appeal since the new build was completed as per city ordinances. David Flame asked if there was a violation regarding the fill dirt that was between the two fences. Scott Bounds stated that would be a civil issue between the property owner and the neighbor. Gerry Spedale made a motion to dismiss the appeal because (a) the requests relief is outside the scope of the building code and (b) Mr. Maragos is not a permit applicant or permittee, both as defined in Section 18-7 of the city's Code of Ordinances.
