REGULAR MEETING ZONING BOARD OF ADJUSTMENT
June 21, 1978
The Zoning Board of Adjustment convened in regular session at the City Hall on
Wednesday, June 21, 1978, 7:30 p.m., with the following members present: Chair-
man Wilkins, presiding; members Marshall. and Doughty. Alternate members Frank
Burge and Jim Cummings had been. designated to sit as members. in the absence of
Mr. Billings and Mr. Commander.
Mr. Wilkins requested that. the Board Secretary read the Notice of Public Hear-
ing.
Motion by Mr. Doughty, seconded by Mr. Burge, that the Public Hearing was now
open to consider an application Docketed 78-4, filed by Mr. Wilford L. Kimble,
6728 West Point, for permission to construct a two-story structure for a garage,
bedroom and bathroom to be entered through and attached to the existing residence.

Mr. Wilkins introduced himself and gave the location of his residence in_the
city, followed by other members of the Board.
Mr. Wilkins ascertained from the secretary that Notice of Public Hearing had
been published in the Southwestern Argus on Wednesday, June 7, 1978, and that
notice had been mailed to all property owners within a 200' radius of the pro-
perty in question on June 1, 1978. In accordance with the provisions of Arti-
cle 6252, V.A.T.C.S. notice was posted on the City Hall bulletin board on
June 19, 1978.
Mr. Wilkins administered the Oath to Mr. Kimble, Building Inspector Wayne Perry
and Mrs. H. K. Pitts.
Mr. Kimble presented plans for the proposed construction, noting that Cason is
a dead-end street and that he has difficulty backing out of his present carport
because of parking for the Y.M.C.A. property. Mr. Kimble noted that his resi-
dence is adjacent to the Y.M.C.A. parking lot and an office building.
Mr. Wilkins read the following correspondence received in connection with the
application:
"We have no objection if the Zoning Board of Adjustment allows Mr.
W.L. Kimble's request for a variance so that he can add on to his
home at 6728 West Point."

Discussion by members of the Board indicated that there were no utility ease-
ments in the area where the garage was to be located.

Building Inspector Wayne Perry advised the Board that Mr. Kimble's application
for a permit had been denied because the Zoning Ordinance requires that a garage
be located not less than ten (10) feet back from any street line, and plans pre-
sented indicated a proposed five (5') feet back from Gason Street.
Mrs. H. K. Pitts, 4148 Riley, advised the Board that she and her husband had
been required to move a support post on their carport prior to the issuance of
a building permit for construction of a second .story; that the support post
and carport had been in the same location for eighteen (18) years;. that they
were not advised that they could make an appeal to the Zoning Board of Adjust-
ment; and that if this application were approved they would consider themselves
as having been discriminated against. Mrs. Pitts stated that they did not know
the Kimbles and learned of the hearing from a neighbor.
Mr. Wilkins explained to Mr. and Mrs. Pitts that any application before the
Zoning Board of Adjustment was .considered only on its own merit and had no
bearing on any previous or future applications. Mr. .Wilkins expressed re-
gret that Mrs. Pitts was not aware of the existence of the Zoning Board of
Adjustment and her right to appeal a decision of the Inspection Department.
Motion by Mr. Burge, seconded by Mr. Doughty, that the public hearing be closed.
