HomeMy WebLinkAbout03151978 ZBA Minutesn 1 :'~'~ d'i "'J REGULAR MEETING ZONING BOARD OF ADJUSTMENT March 15, 1978 The Zoning Board of Adjustment convened in regular session at the City Hall on Wednesday, Marh 15, 1978, 7:30 p.m., with the following members present: Chair- man Wilkins, presiding; members Billings, Commander, .Doughty, and Marshall. Alternate member Cummings was also present. Mr. Wilkins requested that .the Board Secretary read the Notice of Public Hearing. Motion by Mr. Billings, seconded by Mr. Commander, that the Public Hearing .was now open to consider an application Docketed 78-2, filed by Mr. R. Barry Baker 2602 Arbuckle, for permission to construct a breezeway between his existing re- sidence and a proposed two-story garage which would constitute construction in excess of the 40% rear yard coverage. Voting Aye: Billings Commander Doughty Marshall Johnson Voting No: None Mr. Wilkins introduced himself and. .gave the location of his residence in the city, followed by other members of the Board. Mr. Wilkins ascertained from the secretary that Notice of Public Hearing had been published in the Southwestern Argus on Wednesday, February 22, 1978, and that notice had been mailed to all property owners within a 200' radius of the property in question on February 23, 1978. In accordance with the provisions of Article 6252-17, V.A.T.C.S. notice was posted on the City Hall bulletin board on March 13, 1978. Mr. Baker advised the Board that the architect with whom he was work had been out of the city and he did not have a complete set of plans for presentation, however, he did present a sketch that he had prepared showing the location of the proposed construction. Mr. Baker stated that the proposed construction of the breezeway was envisioned as a future project, but that he would like to get the concrete slab all poured at one time if a permit was granted. In response to questions by members of the Board Mr. Baker advised that the pro- posed over-all construction would meet all of the existing set-back requirements; that there was a chain link fence located behind the garage; and a wooden fence only on the Kirby Drive portion of the lot. Mr. Baker further advised that the second floor of the new garage would house library books, an art collection, and provide a place for his wife's stained glass hobby and his .painting. In response to a question regarding alternatives in the event a permit was denied, Mr. Baker stated that he would. work within the provisions of the ordi- nance to obtain as much of the proposed construction as would be possible. It was determined that the proposed garage would be approximately 20' x 25' and the extra portion of the breezeway was planned for casual living area overlooking a courtyard. 12~s Motion by Mr. Billings, seconded by Mr. Commander, that the public hearing be closed. Voting Ayer Billings Voting No: None Commander Doughty Marshall Wilkins Members of the Board discussed Mr. Baker's application and the sketch presented, noting that use of the addition as guest facilities would make it easy for the addition to be rented and that there appeared to be no hardship involved in the proposed construction. Motion by Mr. Billings, seconded by Mr. Doughty, that the application for a variance be denied. Voting Aye: Billings Voting No: .None Commander Doughty Marshall Wilkins Minutes of the regular meeting of the Zoning Board of Adjustment on Wednesday, January 18, 1978, were presented for consideration and the following action taken: Motion by Mr. Doughty,. seconded by Mr. Billings, that minutes of the regular meeting of .the Zoning Board of Adjustment on Wednesday, January 18, 1978, be approved as submitted. Voting Aye: Billings Voting no: None Commander.
