REGULAR MEETING OF ZONING BOARD OF ADJUSTMENT
NOVEMBER 15, 1978
The Zoning Board of Adjustment of the City of West University Place convened
in regular session at the City Hall on Wednesday, November 15, 1978, with the
following members present: Chairman Wilkins, presiding; Members Billings,
Commander and Doughty.
Chairman Wilkins ascertained from the secretary that notice of meeting had
been posted.
Motion by Mr. Billings, seconded by Mr. Commander, that Public Hearing to con-
sider an application docketed 78-10 filed by Henry Lee Darilek, 3826 Case, for
permission to enclose an existing front porch which extends 28-3/4" into the
front setback, be opened.

The Chairman ascertained from the secretary that Notice of Public Hearing had
been published in The Southwestern Argus on October 25, 1978 and that Notice of
Interested Property Owners were mailed on October 24, 1978.
Mr. Wilkins introduced himself and gave the location of his residence in the
city, following by other members of the Board.
Chairman Wilkins administered the Oath to PRr. Henry Darilek and Wayne Perry,
Building Inspector.
Mr. Darilek presented a scale model showing the existing house and his pro-
posed enclosure of the porch, along with sketch also showing the proposed en-
closure.
It was determined from questioning, that Mr. Darilek plans to use the porch
for a closet and entrance foyer, that a portion of the porch is behind the
front setback and only the 28-3/4" go into the front setback and that. all of
the porch is .under the same roof.
Mr. Wayne Perry, Building Inspector, advised that Mr. Darilek applied for a
permit and the drawings presented did not indicate that the porch extended into
the front setback, but at the time of inspection this was discovered and work
stopped on the enclosure. Mr. Perry also stated that Mr. Dailek is making ex-
tensive improvements to the house.
Mr. Darilek presented a petition signed by twenty-seven residents who live
within the 200 ft. radius of the property stating this enclosure would add to
the aesthetics of the house and the neighborhood.
Motion by Mr. Billings, seconded by Mr. Commander, that Public Hearing be
closed.

sider an application docketed 78-11 filed by Mr. and Mrs. Curtis Cantrell, 2620
Quenby, for permission to extend the front of an attached garage two feet into
the front setback, be opened.

Building Inspector, and others in attendance desiring to speak.
Mr. and Mrs. Cantrell presented a petition signed by five adjacent residences
stating they had no objection to the proposed extension. Mr. and Mrs. Cantrell
stated they had a carpenter who had done. work in the neighborhood and they were
not aware that a permit was necessary to do this work; that they had had wheel
covers stolen on two separate occasions because they could not .close their
garage. door; that the foundation in the garage is cracked and this addition
was needed so the door will close properly, that the addition was 90% completed
when Mr. Perry stopped work on it, and that inasmuch as it was located on a
curve on Quenby, the addition would blend in with the other homes in the neigh-
borhood.
Mr. Doughty asked Mrs. Cantrell to make a freehand sketch of the floor plan of
the residence. It was ascertained through questioning that a washer and dryer
is located at the rear of the garage, that the hearing unit is on the side to-
wards the dwelling alongside a workbench on the same side and that a small porch
opens directly into the garage and another door on the porch opens .into the kit-
chen.
Richard S. Hollyer, 2616 Quenby, stated he had no objection to the proposal.
Hugh Frazier, 2612 Quenby, stated that he also -did not object and that he per-
sonally is in favor of zoning and thought it very fine that there was a Board
to appeal such instances. He also .complimented the Inspection Department on
its performance.
Larry Dagley, 2624 Quenby, stated that he concurred and did not think it would
be an eyesore or problem to the neighborhood and he was in favor of getting
cars off the street,

Harry Patton, 2611 Quenby, stated that his house is in full view of this one
and that he has no objection to the. construction and he believes it will en-
hance the value of the house and that he feels the carport is of sounc con-
struction.
Jim McNeil, 2628 Quenby, stated he had no objection.
A4r. Billings stated his concer that the carpenter had been doing work over the
neighborhood and not obtaining permits.
Mrs. Cantrell said they had taken it for granted that the carpenter got the per-
mit.
Wayne Perry, Building Inspector, stated that the construction was a violation
of the Zoning Ordinance setback requirement. He stated that a few months ago
he had had occasion to see that the front setback was established on the pro-
perty adjacent to this so there was no doubt where the setback line is located.
Motion by Mr. Billings, seconded by Mr. Doughty, that the Public Hearing be closed.

Discussion of the Darilek application docketed 78-10 included roof line, usage,
appearance, entry way instead of going directly into the living room.
Motion by Mr. Billings, seconded by Mr. Commander, that application docketed
78-10 be granted on the following conditions; that the applicant shall not
construct any further structure, including a porch or deck, on the front of the
house except steps andJor landing not exceeding 4 ft. x 3 ft. and that this be
construed as a contractural covenant between the city and the owner running with
the land and filed for record.

Discussion of Cantrell application docketed 78-11 included roof line, alterna-
tives, usage; and appearance.
Motion by Mr. Doughty, seconded by Mr. Commander, that application docketed 78-11
be denied since the applicant in the sketch indicates that other alternatives
.are available, therefore no undue hardship has been shown.

Motion by Mr. Billings, seconded by Mr. Doughty,-that the minutes of the
regular meeting of the Zoning Board of Adjustment on September 20, 1978 be
approved as corrected.
