HomeMy WebLinkAbout08161978 ZBA Minutes1 REGULAR MEETING OF ZONING BOARD OF ADJUSTMENT AUGUST 16, 1978 The Zoning Board of Adjustment convened in regular session at the City Hall on Wednesday., August 16, 1978, 7:30 p.m., with the following members present: Mem- ber Dan Doughty, Acting Chairman, presiding; Member MArshall. Alternate mem- bers Burge, and Cummings had been designated to sit as members in the absence of Mr. Billings, Commander and Wilkins. Motion by Mr. Burge, seconded by Mr. Cummings, that the Public Hearing be opened to consider an application Docketed 78-7, filed by Diana Lindsay, 2717. University Boulevard, for permission to enlarge living room by enclosing from ~° porch which would extend 4 ft. 10 inches into the front setback. Mr. Doughty introduced himself and gave the location of his residence in the city, followed by other members of the Board. Q Mr. Doughty ascertained from the secretary that Notice of Public Hearing had been published in The Houston Chronicle on Saturday, July 29, 1978, and that notice had been mailed to all property owners within a 200' radius of the pro- perty in question on July 31, 1978. In accordance with the provisions of Article 6252, V.A.T.C.S. notice was posted on the City Hall bulletin board on August 11, 1978. Mr. Doughty administered the Oath to Mrs. Lindsay and Building Inspector Wayne Perry. Mrs. Lindsay presented plans showing the proposed remodeling and stated that this is a high pitched roof underneath the roof line of the main house; that the existing architecture .has an ungainly look and the house appears to be tipping forward because of the porch construction;. that the house is to be remodeled for sale; that the porch foundation is poured the same. level as the house; that the house is very old and cavity type construction; that in accordance to her plan for remodeling this would enlarge the living room area and allow for a small study; and that it would not be economical to only enclose a small portion of the porch which is in the setback. Building Inspector Wa-ne Perry advised the Board that Mrs. Linday's application for a permit was denied because the Zoning Ordinance requires a front yard to be a minimum depth of twenty (20') feet on lots having a depth of 1110 ft. or less. Mr. Marshall inquired of the Building Inspector if the application approved would this then set the front setback at the front of the enclosed portion so that someone later might want to go even further into the setback. Mr. Pery advised that the front setback remained the same (20 ft. regardless of any construction allowed into the setback. Board members discussed with Mrs. Lindsay her plans for front steps or entry, type of design and general plans for the house. Motion by Mr. Burge, seconded by Mr. Cummings, that the public hearing be closed. 2 Voting Aye: Burge Voting No: None Cummings Doughty Marshall Members of the Board reviewed Mrs. Lindsay's plans and discussed the archi- tecture and esthetics of the property, and alternate plans which could be instituted without causing any hardship. Motion by Mr. Burge, seconded by Mr. Cummings, that application Docketed 78-7 filed by Mrs. Diana Lindsay for permission to enlarge living room by enclosing front porch which would extend 4 ft 1D inches into the front setback be denied as applicant failed to show that hardship would exist if variance denied. Voting Aye: Burge Voting No: None Cummings Doughty Marshall It was the decision of the Board members to defer discussion of certain zoning questions until all members were present.
