HomeMy WebLinkAbout03211979 ZBA Minutes2i REGULAR MEETING ZONING BOARD OF ADJUSTMENT MARCH 21, 1979 The Zoning Board of Adjustment of .the City of West University Place convened in regular session at the City Hall on Wednesday, March 21,1979, 7:30 p.m., with the following members present: Chairman Wilkins, presiding; Members Commander, Doughty and Marshall. Alternate Member Jim Cummings had been designated to sit as a member in the absence of Mr. Billings. Chairman Wilkins ascertained from the secretary that notice of meeting had been posted on March 16, 1979. Motion by Mr. Commander, seconded by Mr. Doughty, that Public Hearing to con- sider an application docketed #79-6 by Larry M. Lee, 4104 Cason, for permission to construct a three foot by 12 foot second-story cantilever while adding a second story to the house, be opened. "~ Voting Aye: Commander Voting,No: None Cummings Doughty Marshall Wilkins Chairman Wilkins ascertained from the secretary that publication of notice of public hearing appeared in The Houston Chronicle on March 3, 1979 and notice to property owners mailed on March 6, 1979.. Mr. Wilkins introduced himself and gave location of his residence in the city followed by other members of the Board. Chairman Wilkins administered an oath to Mile Lee,. John Allen and W. E. Perry, Building Inspector. Mr. Lee Advised aht he desired to construct a cantilevered second story extending 3 ft. 6 inches into the front setback to provide entry protection for the door below and to improve the aesthetics of the structure; that bay windows are allowed from the ground. John illen, architect for Mr. Lee, reiterated the comments of Mr. Lee and reviewed blueprints for the house with the Board. .During discussion and questioning it was elicited that Mr. Lee owns two lots on which the house will be located and that the property directly adjacent is vacant. Mr. Lee presented the following petition signed by David Cole, 4109 Cason; Wm, L. Partridge, 4040 Ruskin; Esther E. Partridge, 4040 Ruskin; Mary-Ann Prentice, 4120 Cason; Rebecca Langley, 4119 Cason; Bonnie Smith, 4113 Cason; Mrs. Jerry Lowe, 4112 Ruskin; Muriel White, 4103 Cason' Mrs. W. G. White, 4103 Cason;-Linda McKeon, 4111 Ruskin; Dennis J. McKeon, 4111 Ruskin; J. K. McCartley, 4115 Ruskin; B. M. Krohn, 4036 Ruskin; Leonard C. Buxton, 4104 Ruskin; Jerry R. Lowe, 4112 Ruskin; Mary DeFoy, Vincent DeFoy, 4120 Ruskin; Jeanette Monger, 4107 Ruskin; Henry P. Audley, 4103 Ruskin: "I...residing at...., do certify that I have seen the plans for the renovation of the residence at 4104 Cason and have no objection to the variance requested 22 from the Zoning Board of Adjustment by Mike Lee." W. E. Perry, Building Inspector, stated a permit had been denied because the zoning ordinances requires that only corniies or eaves of the main building may project into the front yard. Mr. G. J. Volcklandt, 4119 Ruskin, after being administered an oath by the Chairman, stated that he was against allowing this variance; that when he built his house. in 1947 he was not allowed to building beyond the setback line; and that if you had a law you should not allow it changed. Chairman .Wilkins inquired of Mr. Lee if he had considered alternatives to the proposed plan. Mr. Lee stated that alternative plans had been considered but he thought .this one would be more aesthetically pleasing. Motion by Mr. Doughty, seconded by Mr. Cummings, that Public Hearing be closed. Voting Ayer Commander Voting No: None Cummings. Doughty Marshall Wilkins The meeting was recessed for five minutes. The Board discussed and reviewed the proposed plan in relation to requirements of cornices, eaves, bay window and open porches and if Mr. Lee would have a hardship if the application was denied. Motion by Mr. Commander, seconded by Mr. Marshall, that application docketed #79-6 by Larry M. Lee, 4104 Cason, for permission to construct a three-foot by 12 foot second-story cantilever while adding a second story to the house, be approved. Voting Aye: Commander Voting No: Doughty Cummings Wilkins Marshll Motion failed in accordance with Rules of Procedure for the Zoning Board of Adjustment which required that every application shall be disallowed unless the concurring vote of four members of the Board shall. favor the appeal or applica- tion. Minutes of the regular meeting of the Zoning Board of Adjustment on February 21, 1979 were approved as submitted.
