ZONING BOARD OF ADJUSTMENT
NOVEMBER 21, 1985
7:30 P.M.
The Zoning Board of Adjustment of the .City of West University Place convened
in regular session at the City Hall on Thursday, November 21, 1985 at 7:30 p.m.
with the following members present: Chairperson Billings, presiding; members
Opal McKelvey, Sterling Minor; alternate members Robert Heaton, Doris J. Marshall.
Chief Building Inspector, Wayne E. Perry, was also present.
Chairperson Billings introduced himself and gave his address in the City, follow-
~° ed by other members of the Board.
Chairperson Billings ascertained from the secretary that Notice of Public Hearing
had been posted in the City Hall on Friday, November 15, 1985; Notice to Interested
Property Owners was mailed on October 28, 1985; Notice of Public Hearing was pub-
lished in The Houston Chronicle on November 4, 1985.

The secretary read the Notice of Public Hearing as published:
Notice is hereby given that the Zoning Board of Adjustment
of the City of West University Place, 3800 University Boule-
vard, Houston, Texas 77005, will hold a Public Hearing on
Thursday, November 21, 1985, 7:30 p.m., in the Conference
Room at which time it will hear all persons desiring to be
heard in connection with an application docketed 485-9, filed
by Dr. Marcos Calderon and involves the following property in
the City of West University Place, Texas:

Block 11
West University Place 1st Addition
6527 Buffalo Speedway
Chairperson Billings administered the oath to all those persons in attendance
desiring to speak and requested that each give their name and address when
speaking. Motion was made, seconded and carried that the Public Hearing be
opened.
The first speaker was the applicant, Dr. Marcos Calderon, of 6527 Buffalo
Speedway. Dr. Calderon explained his reasons for applying for a variance to
allow him to construct a fence that extends across in front. of the main build-
ing line of the newly built residence at 6535 Buffalo Speedway and the existing
residence at 6527 Buffalo Speedway. Dr. Calderon distributed several pictures
of the subject properties in order to support his request.
Those wishing to speak in support of Dr. Calderon's application were given the
opportunity to do so. There were none in support of the application.
Ms. Audrey Burgess of 6546 Vanderbilt spoke in opposition to the application.
Ms. Burgess wanted to know why the same application was being brought before
the Board again. Chairman Billings explained that the Zoning Board of Adjust-
ment handles each application separately without precedence being set. Ms.
Burgess stated that the Zoning Ordinance should be abided by and the application
not granted.

Also speaking in oppostion was Mr. Mitchell Lukin of 6542 Vanderbilt. Mr. Lukin
stated it would be more appropriate for Dr. Calderon to go before the Zoning and
Planning Commission and have the lots subdivided.
After ascertaining that there were no other speakers, the Public Hearing was
closed.
After a short recess, the Baord reconvened to make a decision. on the application.
The Board then discussed that the hardship alleged was arbitrary, that there were
many alternatives including replatting, going ahead with overall plans and build-
ing a fence at an alternative location.
Motion by Mr. Minor, seconded by Mrs. McKelvey, that the variance be denied, inas-
much as literal enforcement of the Zoning Ordinance would cause no undue hardship.

Minutes of the regular meeting of the Zoning Board of Adjustment on September 18,
1985 were to be resubmitted with corrections to the Board at the next scheduled
meeting on December 19, 1985.
With no further business to come before the Board, upon motion duly made, seconded
and carried, the meeting adjourned at 8:50 p.m.
