RECESSED MEETING
ZONING BOARD OF ADJUSTMENT
March 25, 1985
The Zoning Board of Adjustment of the City of West University Place convened in
recessed session at the City Hall on Monday, March 25, 1985, 7:30 p.m., with the
following members present: Chairman Billings, presiding; members Crane, Lusk,
Padgett and McKelvey.
Chairman Billings announced that the meeting had been recessed on Wednesday,
March 20, 1985, because of the lack of a quorum.
~' Chairman Billings ascertained from the secretary that Notice of Meeting had been
posted in the City Hall on March 15, 1985; Notice of the Recessed Meeting had been
posted March 21, 1985; Notice to Interested Property Owners had been mailed on
March 5, 1985; and Notice of Public Hearing had been published in the Houston
Chronicle on March 4, 1985.
The Secretary read the Notice of Public Hearing as published:
Notice is hereby given that the Zoning Board of Adjustment of the City
of West University .Place, 3800 University Boulevard, Houston, Texas
77005, will hold a public hearing on Wednesday, March 20, 1985 at 7:30 p.m.,
at which time it will hear all persons desiring to be heard in connection
with an application docketed number 85-3 filed by Exxon Company USA and.
involves the following property in West University Place, Texas:
Lot 1, Block 6
Cunningham Terrace Addition
Chairman Billings introduced himself and gave his address in the city, followed
by other members of the Board.
Chairman Billings administered the Oath to all those persons in attendance desiring
to speak and requested that each give their name and address when speaking. Motion
made, seconded and carried .that the public hearing be opened.
Mr. Bob Rice, representing Exxon Company .USA,. stated .that his office. was located
at 16945 Northchase Boulevard and he resided at 4814 Silverchase. Mr. Rice showed
Board members a sample of the type metal Exxon had been using in the construction
of its stations and photographs of existing stations using this material. Mr: Rice
stated that it was their belief that the building they will put up will contribute
to the neighborhood and certainly nothing that would look bad. Mr. Rice stated
it was believed that the use of steel frame and laminated steel and plastic wall
panels would provide construction which would be superior to masonry.
In response to a question, Mr. Rice stated that he could not say that Exxon is not
constructing masonry buildings anywhere in the United States and that he could not
say that the proposed construction material would be less expensive than masonry
construction, but that he did not believe there would be that much difference in
erecting masonry as opposed to the proposed material and that it was believed the
proposed structure would look much better with less maintenance than would be re-
quired of a block building.

Speaking in opposition to the application, Building Inspector Wayne Perry read the
provision of the Zoning Ordinance regarding type of construction of buildings in
Retail Business Districts:
Every building hereafter erected, altered or enlarged within retail.
business districts shall be enclosed on all sides with walls con-
structed wholly of stone, burned brick or reinforced concrete, and
shall have the roof, also the roof and sides of all roof structures
covered with incombustibll material. All cornices. shall be of incombustible
material. The purpose of this section is to prohibit the erection of
buildings in the retail business district of wood, ironclad, stucco and
veneer type.
Mr. Rice extensively reviewed detailed plans for all of the construction of the. new
station with members of the Board. Upon motion made and seconded the public hearing
adjourned.
After a short recess, Chairman Billings called the meeting back to order and
announced that the next order of business was to consider the appeal 85-3. Thereupon,
a general discussion of the application and testimony was held. It was pointed
out that there were numerous alternative methods of building on the property and that
even the applicant admitted that the station could be built without violating the
ordinance.
Motion by Mr. Lusk, seconded. by Ms. Padgett, that the variance requested by Exxon
Company USA, Appeal ~~85-3, be denied inasmuch as an undue hardship has not been
shown.
Voting Aye: All Voting No: None
Chariman Billings again directed attention to the fact that minutes of previous meet-
ings had not been provided to Board members.
Building Inspector Glayne Perry advised that the application filed by Mr. Dwight
K. Nishimura, Appeal ~~85-4, had been withdrawn inasmuch as a lease had not been
obtained on the property for which the application had been applied.
Motion duly made, .seconded and carried that the meeting be adjourned.
