REGULAR MEETING
ZONING BOARD OF ADJUSTMENT
FEBRUARY 20. 1985
The Zoning Board of Adjustment of the City of West University Place convened in
regular session at the City Hall on Wednesday, February 20, 1985, 7:30 p.m.,
with the following members present: Chairman Billings, presiding; members Crain,
Feasel, Lusk and McKelvey.
Chairman Billings introduced himself and gave his address in the city, followed
by other members of the Board.
Chairman Billings ascertained from the secretary that Notice of Meeting had been
posted in the City Hall on February 15, 1985; Notice of. Public Hearing published
in the Houston Chronicle on February 4, 1985; and Notice to Interested property
owners were mailed on February 1, 1985.
The Secretary read the Notice of Public Hearing as published:
Notice is hereby given that the Zoning Board of Adjustment of the City
of West University Place, 3800 University Boulevard, Houston, Texas
77005, will hold a public hearing on Wednesday, February 20, 1985, at
7:30 p.m., at which time it will hear all persons desiring to be heard
in connection with an application docketed number 85-1 filed by Jack F.
Browder and involves the following property in West University Place:

Chairman Billings administered the Oath to all those persons in attendance desiring
to speak and requested that each give their name and address when speaking. Motion
made, seconded and carried that the Public Hearing.. be opened..
Mr. Browder explained that he would like to upgrade his property at 4149 Amherst
by replacing the existing dilapidated garage and by adding two bedrooms and two
bathrooms to the existing house. Mr. Browder stated that his objectives were
1) avoid chopping down two large trees, 2) make garage big enough to accommodate
two full size cars, 3) allow adequate spacing between the garage and the addi-
tion to the house and, 4) minimize the disturbance to the existing house .and foun-
dation. Mr. Browder stated that he had a corner lot and was required to have the
garage set back 10' from the side property line instead of 3' as required.for_in-
side lots.
Mr. Browder stated that the plan he had submitted for consideration was the least
costly plan he could come up with and if his application were denied he would pro-
bably re-do the entire plan and put the washer/dryer inside the house.
Speaking for the city in opposition to the application, Building Inspector Perry
stated that the proposed garage was .located 5' from the street property line on
a corner lot rather than the 10' required by the. zoning ordinance.
Following his determination that there were no additional opposition to the ap-
plication and that no correspondence had been received in opposition, Chairman
Billings entertained a motion to close the Public Hearing. Motion made, seconded
and carried that the Public Hearing be closed on Appeal ~~85-1.

8:00 P.M., at which time it will hear all persons desiring to be heard
in connection with an application docketed number 85-2 filed by David R.
McDaniel and involves the following property in West University Place:
Lot 4-B, E2 Lot 4-C, Block 52

Mr. McDaniel stated he was adding a kitchen to-the back of his house and desired
to construct a carport on the side of the house, however, if the carport is con-
structed three (3') feet from the side property. line as required by the zoning
ordinance it would not be large enough to cover his car. Mr. McDaniel further
stated that if the support posts for the carport could be located 1'S" in the
side setback the construction. would be adequate.
Mr. McDaniel reviewed his plans with members of the Board showing-the location of
an extending chimney which would require either making the carport smaller or using
a portion of the three (3') side setback.
In response to Chairman Billings' request that anyone in attendance desiring to
speak in favor of the application, Mr. Joe Barbaria, 3515 Amherst, which is
directly across the street stated that he had no problem with the planned adds-
tions by Mr. McDaniel and that many of the houses in the neighborhood had some
construction in the three (3') foot side setback and to him the proposed construc-
tion did not seem to be any hindrance to the neighborhood or any of the neighbors.
The contractor for Mr. McDaniel's remodeling stated that when the plans were drawn
up there was approximately two {2"0)inches on either side of the carport and get-
ting a car parked in such'.a small area was almost impossible.
In response to Chairman Billings' question regarding correspondence received in
favor of the application, the secretary read the following:
This meeting with our approval since we believe it will attract to the
house.

Building .Inspector Wayne Perry stated that Mr. McDaniel's request for the side set-
back of 1'S" had been .denied because of the provision of the zoning ordinance re-
quiring a 3' side setback for all inside lots and .that the extension of the carport
into the front setback made two violations of the zoning ordinance.

Chairman Billings read the following letter received in opposition to the applica-
tion:
This letter is in response to the attached Appeal ~~85-2 dated 1-4-85.
Not only do I feel the request for the carport should be denied, I
feel the agency which allows an individual to build an addition
between the street and his garage needs some strengthening.
It might be useful for the parties involved to examine the architectural
~' style of Lamar Terrace before making a request for judgement.

Motion made, seconded and carried that the Public Hearing be closed.
Following a general review and discussion of Appeal ~~85-1, motion by Mr. Lusk,
seconded by Ms. Feasel, that Appeal 485-1 to extend a proposed garage 5' from
the street side property line on a corner lot be denied on the basis that the ap-
plicant had not proven an .undue hardship.
Voting Aye: All
Voting No: No
Following a general review and discussion of Appeal ~~85-2, motion by Ms. Feasel,
seconded by Mr. Crain, that Appeal 485-2 to permit an encroachment on the 3` side
setback line and the front setback line be denied on the basis that the applicant
had not proved an undue hardship.
Voting Aye: All.
Voting No: None
Building Inspector Wayne Perry reviewed provisions of a new amendment to the zoning
ordinance covering such points as lot coverage, pervious material, etc.
Motion made, seconded and carried that the meeting adjourn.
